SUBJECT: LEVY RESIDENCE - CDP 97-59
Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Coastal Development Permit, application no. CDP 97-59, as
to its completeness for processing.
INCOMPLETE
The application is incomplete, as submitted. The first list is
information which must be submitted to complete your application. This list of items must
be submitted directly to your staff planner by appointment. All list items must be
submitted simultaneously and a copy of this list must be included with your submittals. No
processing of your application can occur until the application is determined to be complete.
The second list is issues of concern to staff. When all required materials are submitted the
City has 30 days to make a determination of completeness. If the application is
determined to be complete, processing for a decision on the application will be initiated. In
addition, please note that you have six months from the date the application was initially
filed, December 24, 1997, to either resubmit the application or submit the required
information. Failure to resubmit the application or to submit the materials necessary to
determine your application complete shall be deemed to constitute withdrawal of the
application. If an application is withdrawn or deemed withdrawn, a new application must
be submitted.

LIST OF ITEMS NEEDED
TO COMPLETE THE APPLICATION
NO. CDP 97-59
Planning:
1. Pursuant to Section 21.10.01 5 of the Carlsbad Municipal Code, please submit a Second
Dwelling Unit permit application for the proposed guest apartment which is located above
the detached garage.
2. Please submit a copy of the conceptual project site plan (dated January 7, 1997) which
you submitted to the U.S. Fish and Wildlife Service for review and comment.
3. Pursuant to Section 21.203.040(8)(3) of the Carlsbad Municipal Code, please submit a
site specific report identifying mitigation measures needed to avoid increased runoff and
erosion into Buena Vista Lagoon.
4. Please submit an Environmental Impact Assessment (Part I) application and required fee.
5. Please include floor area calculations on each floor plan exhibit.
6. Because the property is located within the Coastal Plain, there is a high probability that
cultural resources may exist on the site. Accordingly, please submit a cultural resources
survey of the property.
Engineering:
Engineering Department comments will follow under separate cover.
ISSUES OF CONCERN
Planning:
1. ' Please revise the architectural plans to eliminate the proposed galvanized steel roofing.
Pursuant to Section 21.10.100(4) of the Carlsbad Municipal Code (R-1 Zone), "no roof
shall be made of corrugated, extruded or stamped metal".
2. The proposed access drive and project fence appears to encroach into the 100'
wetlands buffer area which is located along the eastern side of the property. Please
redesign the project to move the driveway and fence outside of this buffer area or submit a
mitigation proposal (acquisition, or creation and preservation of marsh habitat within the
lagoon vicinity) for this project impact.
3. The proposed-6 foot tall chain link fence encroaches into the front yard setback areas
of both parcels "A" and "B". Please redesign the plan to either move the proposed 6 foot
tall fence to the west and out of the front yard (see redlined exhibit) or reduce the height of
the fence within the front yard to a maximum of 42".
4. The project letter of comment from the U.S. Fish and Wildlife Service (February 13,
1997) specifies that the project be graded to prevent urban runoff containing herbicides,
insecticides and pesticides from draining into the marsh and Lagoon. Accordingly, please
revise the proposed drainage plan to incorporate a de-pollutant basin into the project.
5. Please submit an exterior lighting plan for review. The plan should include a
combination of low level lights and shields on all outdoor lighting fixtures to avoid light
impacts on the adjacent marsh and Lagoon environments.
7. Please submit evidence that the property owner has made an irrevocable offer of
dedication of the 100’ wetlands buffer to the California Department of Fish and Game. The
100’ wetlands buffer setback shall also be required to be placed in an open space
easement.
8. The City of Oceanside is proposing to reconstruct the weir at the mouth of Buena Vista
Lagoon, which is located in the vicinity of the project site. Please consult with the City of
Oceanside to determine what effects this project will have on your property and project.
