As a result I am forwarding the following information to you: 1. A copy of your January 23,1998 letter. 2. A Second Dwelling Unit permit application,associated plans, and $250.00 processing fee[ def iciency #I 1. 3. A copy of the January 27,1997 conceptual project site plan that was submitted to the U.S. Fish and Wildlife Service. The Fish and Wildlife letter of February 13,1997 that refers to a January 7,1997 plan was incorrect. I’ve included a copy of a fax from Fish and Wildlife dated February 5,1998 that clarifies the correct date of the conceptual planldeficiency #2]. 4. The site plan has been modified to show the use of a Sedimentation Catch Basin to significantly reduce the introduction of silt into the lagoon. The site is almost flat which results in two positive facts. Erosion will be almost non existant because no steep gradeslmax. 1 %I are proposed and the lack of gradient will allow storm or irrigation waters to soak into the sandy material rather than run off the site. In addition the 100 foot buffer around the house will absorb any water that may flow on to it and thus never reach the lagoon[deficiency #3]. 5. An Environmental Impact Assessment and $220.00 processing fee[deficiency #;Ql- 6.Floor area calculations have been included on each floor plan exhibit and new prints are included[deficiency #SI. A portion of Exhibit C [letter from M. Jay Hatley, Archaeologist, dated April 16,1980, 3 pages] of said document is enclosed which clearly addresses the subject site and clears it of any cultural resources. In addition an aerial photo of the site dated November 9,1972 by Aerial Fotobanktnegative # 76,083Afinvoice #27400] confirms the grading fill activity on the site which substantiates the inability for early cultural resources to have existed[deficiency #5]. Your letter of January 23,1998 also expressed Issues of Concern. My response to these are as follows: 1 .Via separate submittal, the owner of the property [ John Levy ] has provided you with technical, visual, and architectural data to justify the use of galvanized steel roofing on the building. 2. The proposed access drive and project fence do encroach into the 100 buffer area. This encroachment has been reviewed and approved by U.S. Fish and Wildlife, California Fish and Game, and the California Coastal Commission. To mitigate that encroachment the owner must remove non-native plants in the buffer area and then augment the plant base with a native non irrigated hydroseed mix. The landscape plans reflect this requirement. 3. The plans have been revised to move the 6 foot fence out of the front yard set back. Copies of the revised plan[site plan and landscape plan] are included. 4. A de-pollutant basin has been incorporated into the revised site/grading plan and copies are included for your review. 5. Proposed exterior lighting is shown on the architectural plans. Cut sheets of the fixtures are included with this letter. 6. Contact was made with California Fish and Game regarding executing an irrevocable offer of dedication over the 100 wetlands buffer. A copy of the proposed document is enclosed. I am working with CF&G on the exact wording of the "exhibit" defining the area and a few other items before execution. A fully signed copy will be sent to you after completion of recording of said document. Please provide me with the base documents for the open space easement so work can begin on those. 7. I have been in constant contact with the City of Oceaqside over the last year regarding the weir issue. Their cohsultant is presently in the design stage of the new weir.
