Dear Bob,
Discussions on the above referenced project over the last 9 months have
indicated a desire by the City to have the access easement that services the
above two lots also dedicated to the City to further insure better access to the
Buena Vista Lagoon weir. The present easement is across a vacant open space
lot which is owned by The Beach Homeowners Association. I have spent the last
three months working diligently with the association to gain their support in
regranting said easement to the City as well as other agencies. Although they
have not come forward and said absolutely no to my requests, it is quite obvious
to me that I have, at best, only an outside chance they will "grant" my request.
I must proceed forward with the "project" with the assumption that no assistance
from the homeowners will be granted to me. Based on the preceeding I must
obtain a letter from the City that indicates they recognize the access easement
to the two lots as being valid and no further dedications in favor of the City
would be necessary for construction of a house on each of the above referenced
lots.
I've included a copy of the site plan and easement with said existing access
easement hi- lited in yellow on the plan.
