Box 10549 Scottsdale, AZ 85271 SUBJECT: CDP 98-01 - RUSSELL RESIDENCE Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning Department has reviewed your Minor Coastal Development Permit, application no. CDP 98-01, as to its completeness for processing. The application is complete, as submitted. Although the initial processing of your application may have already begun, the technical acceptance date is acknowledged by the date of this communication. The City may, in the course of processing the application, request that you clarify, amplify, correct, or otherwise, supplement the basic information required for the application. In addition, you should also be aware that various design issues may exist. These issues must be addressed before this application can be scheduled for a hearing. The Planning Department will begin processing your application as of the date of this communication. Please review the Planning Issues listed on the attached sheet; the proposed project can not be approved given the applicable regulations for bluff face/stringline development in the coastal zone. The subject site is located in the Coastal Zone and also on the coastal bluff which makes it subject to the Coastal Shoreline Development Overlay Zone (Chapter 21.204). Section 21.204.050 (B) specifies that "...no decks or other appurtenances shall be permitted further seaward than those allowed by a line drawn between those on the adjacent structures to the north and south." The submitted exhibits do not reflect compliance with this coastal development regulation. Since the project can not be approved, the project will be denied in accordance with the minor coastal permit processing procedures outlined in Section 21.201.080. Staff will initiate the process during the week of February 9-13. The above referenced code sections are attached for your convenience.
