The project involves a four lot parcel map. Three of the lots are intended to be buildable. The fourth lot is intended to be a beach access lot, open to the public pursuant to §846 of the California Civil Code, and further pursuant to an agreement previously entered into by and between myself and the City of Carlsbad. Please also note that the fourth lot consisting of public access was the subject of a prior approval Case Number SUP 96-07; CDP 96-05; and HDP 97-03. Following the approvals of the above-numbered applications, the beach access and stairway was provided and built. In addition, and during the above applications, an environmental assessment was conducted and a declaration was issued and approved at the public hearing. It is my present understanding that the administrative approval of the parcel map will require no environmental issues and/or assessments or findings since the project encompasses infill and no construction work. Please also note that the submissions pursuant to the present administrative minor coastal development permit process are, to a large extent, included in the above files, and to the extent possible, please incorporate the submittals necessary for this application from the pre-existing files regarding the prior above-stated applications. Please also incorporate in this application the submittals included in the Parcel Map Application Number 98.1 JON A. JENSEN & ASSOCIATES ATTORNEYS AT LAW Planning Department City of Carlsbad January 15, 1998 Page 2 previously submitted to the engineering department on January 13, 1998, which is a companion application to the present minor coastal development permit application or other permits. It is of primary importance that the application for a parcel map filed in the engineering department number 98.1 be tracked with this application and that all permits and applications are included in the mailing and notices which have been submitted as part of the 98.1 application. In reviewing the general application requirements, please note that the information contained in those requirements is contained in application 98.1 with the exception of a land use review application form, a completed coastal development supplemental application form, and a disclosure statement. In this regard, please find enclosed and attached to this correspondence and application, a new land use review application form, a new coastal development supplemental application form and a new disclosure statement for the purpose of completing the application for the administrative minor coastal development permit or other permits. I am also enclosing a correspondence to Bob Wojack, principal civil engineer, for the City of Carlsbad, regarding the Parcel Map Application 98.1. In this correspondence, various historical facts regarding the project as well as other pertinent information is provided. Please note that a specific planning issue will need to be addressed regarding the beach access lot. In this regard, I have had previous discussions with Mr. Gary Wayne of the planning department. In addition, and during the discussions, it is acknowledged and clearly understood by applicant that planning and Mr. Wayne's concerns regarding the beach access lot will need to be addressed and incorporated into conditions of approval. As part of this process, I would be willing to meet with staff members or Mr. Wayne again to ensure that all of the concerns regarding the beach access lot are appropriately addressed. In addition to the above, I have also included one copy of the tentative parcel map, one copy of the recent preliminary title report, and one copy of a site map. Although these items are included in the engineering Parcel Map Application 98.1, I wanted to include them here for convenience and immediate access. JON A.
