The Planning Department has reviewed your Coastal Development Permit request, application no. CDP 98-12, as to its completeness for processing. The application is complete, as submitted. Although the initial processing of your application may have already begun, the technical acceptance date is acknowledged by the date of this communication. The City may, in the course of processing the application, request that you clarify, amplify, correct, or otherwise, supplement the basic information required for the application. In addition, you should also be aware that various design issues may exist. These issues must be addressed before this application can be scheduled for a hearing. Engineering: None. ISSUES OF CONCERN Planning: 1. The Poinsettia Shores Master Plan (p. 117-l 19) regulates the development and build out of the five vacant lots located in the Rosalena project. Consistent with those regulations, one of the five remaining lots must be a single story residence with a maximum building height of 18 feet. Since an application for Lot 21 has been submitted for approval of a one story home, the remaining lots may develop with two story residences. 2. No building permits will be issued for Lots 20-24 until a trail easement has been secured to the satisfaction of the City Attorney; or the trail is completely constructed to the satisfaction of the City Engineer and Planning Director. 3. Rear yard improvements within the 45-foot bluff top structural setback are regulated by a previous master plan amendment and associated ordinance (NS-71) approved in 1989. A copy of the pertinent rear yard regulations was sent to you with the letter dated November 13, 1997 regarding your preliminary application review (97-76). Please revise the project plans to move all parts of the proposed structure outside of this 45 foot setback. Be advised that the City will not issue permits for any rear yard improvements until the Coastal Commission provides a letter allowing the proposed improvements to be permitted. The reason for this is that the required bluff top trail has not been constructed. The City and Coastal Commission have worked extensively with the Rosalena Homeowners Association (HOA) over the past several years to provide guidance on amending the master plan to formally re-align the trail off of the bluff top. The HOA has not responded to this situation and the lack of a bluff top trail or pending master plan amendment to re-align the trail now prevents the Coastal Commission from sanctioning any rear yard improvements. Therefore, the City will not issue any rear yard structure permits until the trail is constructed; or until the Coastal Commission informs the City in writing that permits may be issued. 4. The maximum building height of 25 feet to the peak appears to be complied with. 5. Review of the letter from the Rosalena HOA Architectural Review Committee to the previous land owner indicates the Hoe’s approval contingent upon a list of changes to the proposed architectural elements. Please be advised that these issues should be resolved directly with the homeowners’ association and that the City will not enforce these requirements as conditions of project approval. CDP 98-12 - FORTH RESIDENCE March 13, 1998 Page 3 6. Please be sure all setbacks and dimensions are labeled property. 7. Please provide the engineer’s address on the plans. 8. Please indicate the location, size and use of all easements applicable to this parcel, 9. Please show driveway location. 10. Maximum roofline projections into required yards is two feet. This appears to be exceeded on the rear yard roof projections in some areas. 11. Please show location, height, and materials of all walls and fences. 12. Please revise the Summary Table on the cover page to indicate the existing land use as RM (Residential Medium Density) and the zoning as PC (Planned Community). 13. Please verify the building coverage and square footage. 14. There is no grading or information on the site plan. Please show limits of grading and development. If no grading is proposed, please indicate the criteria for this determination. 15. Please show the spot elevations at the corners of the pad. 16. Indicate the method of draining the lot. Please show the location and size of all drainage facilities and sewer and water utilities. 17. Please submit a location map at 8.5” by 11” size. 18. Please indicate the bluff top line and the existing topographic and vegetative conditions. 19. Please be advised that the applicant must bring one copy of a colored site plan and one copy of a colored elevation to the Planning Department by 12:00 noon, eight (8) days prior to the Planning Commission meeting. Do not mount the exhibits. 20. Please be advised that when the application is tentatively scheduled to be heard by the decision making body, the project planner will contact the applicant and advise you to submit the radius map, two sets of property owners list and labels, as required for Coastal Development Permits. Engineering: 1. Please indicate the street called Navigator Circle on the site plan. Include with the street dimensions, the curb and gutter and existing barricades. 2. Please modify the plans to indicate that the top of the driveway flare must be 3’ from the property line. (Refer to Standard GS - 15). 3. Please indicate the location of existing storm drains, inlets, sewer cleanouts, sewer mains, and sewer easements. Utilities can not be located in the driveway. Also provide distance from curb and easement lines. Please indicate any proposed fences, their location in relation to the property line, materials and heights. Please indicate the distance of the Bluff Trail to your property line. Also indicate whether you have provided access to it, and if so, where. Please show the Bluff and existing topographic and vegetative conditions. Please show the limits of grading and development. If grading is not proposed, please indicate the criteria for this determination. The line of the drainage swale must be 5’ from the building. (Refer to Standard GS-14). As an alternative, a letter from a registered soils engineer recommending the swale be less than 5’ from the building may be accepted.
