RE: SDU 98-02 - Gunter Second Dwelling Unit
Dear Mr. Wojcik:
Thank you for taking the time to discuss the engineering conditions that were placed on the
Administrative Permit approval for our Second Dwelling Unit. Based on our conversation, I
understand that Engineering Condition #18 will be removed/withdrawn from this permit approval.
As you requested at the end of our phone conversation, the following is a summary of what we
discussed.
Condition 18 requires that we engineer and build "full half street improvements" including
sidewalk, curb, etc. You indicated that this does not include undergrounding of the electrical
main service across our frontage. You also indicated that it is now policy for the Carlsbad
Engineering Department to require these improvements on all qualifying projects, if possible.
I pointed out that this portion of our project would not meet the $50,000 minimum cost, and thus
may not qualify to require the street improvements. I understand that the Engineering
Department does plan to condition these improvements on our Coastal Development Permit for
construction of the new single family residence
We discussed the fact that there have been recently approved projects in our neighborhood that
have been approved with the condition that the developer sign a future improvement agreement
in lieu of making improvements. You indicated that this option would be at the discretion of the
Planning Commission and will need to be requested when we go to hearing on the CDP.
Since the Second Dwelling Unit portion of our project will not meet the $50,000 minimum cost
value for street improvements, and the street improvement condition will be a condition of the
remainder of the project that will be considered at the Planning Commission public hearing for
our Coastal Development Permit, I understand that you have agreed to withdraw condition #18
from the approval of SDU 98-02. Based on the removal of this condition, it will not be
necessary for us to appeal this to the Planning Commission.
