HomeMy WebLinkAboutCDP 98-26x1; DeJong Residential Project; Coastal Development Permit (CDP) (4)1 June 7, 2001 City of Carlsbad Arie deJong, Jr. Family Trust 24596 Crown Hill Lane Escondido CA 92027 SUBJECT: CDP 98-26x1 - DEJONG PROPERTY TENTATIVE MAP EXTENSION The Planning Department has completed a review of your application for a Coastal Development Permit Extension, CDP 98-26x1 located on the northeast corner of Black Rail Road and Poinsettia Lane. After careful consideration of the circumstances surrounding this request, it has been determined that there has been no change of circumstances in relation to coastal resources per Section 131 69 of the California Code of Regulations since the original granting of the permit and that the findings required for granting a Coastal Development Permit can be made and therefore, APPROVES this request based on the following findings and conditions. Findings: 1. That the proposed development is in conformance with the Certified Local Coastal Program and all applicable policies in that the project complies with all applicable requirements of the Mello II Segment of the Local Coastal Program such as policies concerning the conversion of coastal agriculture and environmentally sensitive habitat areas 2. The project complies with the requirements of the Coastal Agricultural Overlay Zone as the project has been conditioned to pay the agricultural conversion mitigation fee to develop the property with uses other than agricultural uses. 3. The project also complies with the requirements of the Coastal Resource Protection Overlay Zone as slopes over 25% containing coastal sage scrub and chaparral are being preserved. Approximately .29 acre of duel criteria slopes will be impacted for the construction of a circulation element roadway, Poinsettia Lane, which is not subject to this limitation as specified in Section 21.201.040 A.l .a. of the Carlsbad Municipal Code. Conditions: 1. This Coastal Development Permit extension is valid for a period of one (1) year from the original project expiration date of May 1 1, 2001. This Coastal Development permit extension is subject to all of the conditions of approval for CDP 98-26 contained in Planning Commission Resolution No. 4508. This decision may be appealed by you or any member of the public to the Planning Commission within ten days of receipt of this letter. Appeals must be submitted in writing to the Planning Commission at 1635 Faraday Avenue in Carlsbad, along with a payment of $440.00. The filing of such appeal within such time limit shall stay the effective date of the order of the Planning Director until such time as a final decision on the appeal is reached.
