Please submit a Public Facilities Agreement and a $50.00 filing fee. The attached agreement must be signed and notarized. Please submit the original and one xerox copy. 2. Although you have already obtained approval of a variance for the front and rear setback reductions through Administrative Variance 96-01, you will also need to submit a letter requesting a sideyard reduction in accordance with section 21.10.040 Side Yards, subparagraph (2), (See attached). The La Costa Downs Specific Plan requires a minimum side setback of 6 feet or 10% of the lot width, whichever is most restrictive. However, such sideyard need not exceed ten feet. In this instance, the lot width includes the easement area. The sideyard reduction is an administrative action and has been granted to other properties in this subdivision. 3. Show both the gross and net lot area on the plans. 4. Please show the dimension of the front property line. 5. Show the square footage of the roof deck and the total roof area. The roof deck area may not exceed 25% of the total roof area. 6. The interior garage dimension must be 20' x 20' clear. Either the post in the middle of the garage must be eliminated or the garage spaces must be increased in size to 12'x 20'each. 7. The second floor balcony may not project more than 2 feet into the front yard setback. Please show the dimension on the site plan and floor plan. Consider redesigning the balcony with an open railing to help reduce the mass of the structure within the front setback. Engineering: 1. Add a note to the plans stating "no grading of the property is proposed". 2. Unless the surface drainage course is being altered, indicate that the arrows represent existing drainage flow. CDP 98-49 - LA COSTOT6wNS LOT 11 July 27, 1998 Page 3 ISSUES OF CONCERN Planning: The proposed architectural design does not appear to be consistent with the Architectural Guidelines for the La Costa Downs Specific Plan. Although no one style of architecture is required, certain architectural elements should be incorporated into the design as illustrated in the attached guidelines. For example, varied roof planes should be utilized rather than a flat roof design and the building faces should be varied for architectural interest. Because setback reductions have been granted for this property, it is important to integrate these design features to help reduce the building mass and maintain the desired street character. The application and plans submitted for this proposed project are considered complete. Additionally, staff has conducted a review of the project for engineering issues of concern. Engineering issues which need to be resolved or adequately addressed prior to staff making a determination on the proposed project are as follows: 1. Add a note to the plans stating "no grading of the property is proposed". 2. Unless the surface drainage course is being altered, indicate that the arrows represent existing drainage flow. Also, will runoff from driveway sheet flow onto the lawn area? Once these items are addressed, the following conditions need to be added to the project: 1. The developer shall pay all current fees and deposits required. 2. The owner of the subject property shall execute an agreement holding the City harmless regarding drainage across the adjacent property. 3. Prior to the issuance of a building permit, the applicant must obtain an encroachment permit from the City to allow the proposed driveway within the 30 foot wide public utility easement. After careful consideration of the circumstances surrounding this request, it has been determined that there has been no change of circumstances in relation to coastal resources per Section 13169 of the California Code of Regulations since the original granting of the permit and that the findings required for granting a Coastal Development Permit can be made and therefore, APPROVES this request based on the following findings and conditions. The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.03 of the Zoning Ordinance) in that the project will adhere to the City's Master Drainage and Storm Water Quality Management Plan and Grading Ordinance to avoid increased runoff and soil erosion, no steep slopes or native vegetation is located on the subject property and the site is not located in an area prone to landslides, or susceptible to accelerated erosion, floods or liquefaction. Conditions: 1. This Coastal Development Permit extension is valid for a period of one (1) year from the original project expiration date of December 2, 2000. PROJECT DESCRIPTION AND BACKGROUND Project Site/Setting: Infill lot located on the east side of Surfside Lane as shown on the attached Location Map. The gross lot area is 4,800 square feet with a net lot area of 2,800. A 30 foot sewer, water and utility easement is located parallel to the south property line. Proposed Residential Construction: New residential structure totaling 1,880 square feet. Proposed Grading: No grading is proposed which would require a grading permit.
