Darkmin Apartments Assessment
Pursuant to Chapter 21.45.080, there are at least three development standards that would
restrict the applicant from altering the current use designation.
1. Projects of ten or less units are required to have a 15 x 15 patio or 120 square feet
of balcony area.
2. The garages for each unit are required to have a five-foot minimum building
setback to the driveway (project).
3. Every lot in the R-3 zone shall have a front yard of not less than twenty feet,
except on lots that are side adjacent to commercial or industrial zones.

The Engineering Department has completed its review of the above referenced project.
Engineering staff does not have any comments to add to the project. Please add the following
conditions of approval to the approving resolution:
1. Prior to issuance of any building permit, the developer shall comply with the
requirements of the City's anti-graffiti program for wall treatments if and when such a
program is formerly established by the City.
2. The developer shall pay all current fees and deposits required.
3. The owner of the subject property shall execute an agreement holding the City harmless
regarding drainage across the adjacent property.
4. The developer shall comply with the City's requirements of the National Pollutant
Discharge Elimination System (NPDES) permit. The developer shall provide best
management practices as referenced in the "California Storm Water Best Management
Practices Handbook" to reduce surface pollutants to an acceptable level prior to
discharge to sensitive areas. Plans for such improvements shall be approved by the
City Engineer. Said plans shall include but not be limited to notifying prospective
owners and tenants of the following:
A. All owners and tenants shall coordinate efforts to establish or work with
established disposal programs to remove and properly dispose of toxic
and hazardous waste products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil,
antifreeze, solvents, paints, paint thinners, wood preservatives, and other
such fluids shall not be discharged into any street, public or private, or
into storm drain or storm water conveyance systems. Use and disposal
of pesticides, fungicides, herbicides, insecticides, fertilizers and other
such chemical treatments shall meet Federal, State, County and City
requirements as prescribed in their respective containers.
C. Best Management Practices shall be used to eliminate or reduce surface
pollutants when planning any changes to the landscaping and surface
improvements.

5. The developer shall exercise special care during the construction phase of this project to
prevent offsite siltation. Planting and erosion control shall be provided in accordance
with the Carlsbad Municipal Code and the City Engineer.

COMPLETENESS & ISSUES REVIEW
Engineering Department staff has completed a review of the above-referenced project for
application completeness. The application and plans submitted for this proposed project are
considered complete. Additionally, staff has conducted a review of the project for engineering
issues of concern. Engineering issues which need to be resolved or adequately addressed prior
to staff making a determination on the proposed project are as follows:
1. The driveway must be designed to accommodate the circulation of trash trucks. Per the
Private Street-Driveway Criteria of Section 1 (B) & (S) of the City of Carlsbad Standards
for Design and Construction of Public Works Improvements, the driveway must be
designed to preclude vehicles from backing onto a public street. Trucks traveling on the
project site must be able to maneuver using a 42 foot turning radius per California
Department of Transportation Highway Design Manual, Figure 407E.
NOTE: This standard was not mentioned in the Preliminary Review comments (PRE 98-
20) since the proposed preliminary review design contained a driveway extension
providing the necessary turn around for trucks and autos.
2. The parking spaces proposed at the rear of the property must have adequate turn-
around space at the aisle terminus to accommodate a maximum three-point turn for a
standard passenger vehicle (Private Street - Driveway criteria of Section 1(P) of the City
of Carlsbad Standards for Design and Construction of Public Works Improvements).
3. Provide confirmation from Pacific Bell that the driveway can be located within its
proposed distance to the telephone pedestal.
4. The minimum drainage flow allowed on aggregate concrete and lawn area is at one
percent grade. This standard is met on the driveway but not the lawn area. Also, we
discourage placing concrete swales within the center of a driveway. The preferred
method is to create a tipped section to concrete curb and gutter.
As an alternative design, you may want to consider establishing the high elevation
points at the rear and middle point of each duplex and establish grade so that all runoff
flows west. The runoff could collect at the west end of the driveway where a concrete
curb and gutter/swale would then transfer it towards the street. The minimum grade
required for a concrete swale is 0.5%. The concentrated runoff would have to flow to an
inlet and be directed to a curb drain outlet to eliminate the concentrated runoff from
collecting over the driveway and sidewalk.
