Include any details necessary to adequately explain the scope and/or operation of the proposed project. You may also include any background information and supporting statements regarding the reasons for, or appropriateness of, the application. Use an addendum sheet if necessary. Description/Explanation: The proposed amendment seeks to replace condition #12 of the Thompson/Tabata conditions of approval with language from Chapter 15 of the Carlsbad Municipal Code. Condition #12, as contained in Planning Condition Resolution No. 5073, approved on December 5, 2001, reads as follows: If a grading permit is required, all grading activities shall be planned in units that can be completed by October 1st. Grading activities shall be limited to the "dry season," April 1 to October 1st of each year. Grading activities may be extended to November 1&h upon written approval of the City Engineer and only if all erosion control measures are in place by October 1st. The condition as written would preclude grading activities during the winter season. The approved condition limits grading to that part of the year when residents in the surrounding area are most likely to be disturbed by the noise, dust, and potential traffic delays caused by the grading of the Thompson/Tabata site. In addition, the LCP no longer strictly prohibits grading during the winter season, so long as there is no immediate danger to Coastal Resources and all erosion control measures are in place. Thompson/Tabata is an infill residential subdivision, surrounded on all sides by existing single and multi-family residential development. The applicant will comply with all regulations of adopted Carlsbad Grading Ordinance and the approved SWPPP; however, the unavoidable impacts to the surrounding residents, such as noise and dust, will be diminished significantly if the grading activity is to take place during a period of time when the grading activities and existing home-owner outdoor activities are least likely to conflict. The optimal period of time is during the winter months when residents are least likely to be outdoors and windows in homes are most likely to remain closed. In addition, Poinsettia Lane, which traverses the northern portion of the site, is the main route from Interstate 5 to the Aviara resort and golf course and is being used more as a beach access route from the east via Aviara Parkway. Grading during the winter months has the c added benefit of reducing the aesthetic impacts and travel delays along the main route to the resort during the high volume tourist season. In terms of environmental protection, the ultimate downstream facilities to protect the lagoon are in place. The placement of these structures allowed the Aviara Master plan to grade during the winter season and became the basis for permitting other grading operations during the restricted period. None of the drainage from the Thompson/Tabata site enters any water body without first being treated by these facilities. In addition, in order to comply with the requirements of the National Pollutant Discharge Elimination System (NPDES), the project site must have a site-specific storm water pollution prevention plan (SWPPP) approved by the City prior to the start of grading. The applicant has prepared a SWPPP which was submitted for City review and approval in conjunction with the review and approval of the project's mass grading plan. Reflective of these existing conditions and regulations, Section 15.16.120(A)7 of the Carlsbad Municipal Code (Grading Ordinance) currently permits grading in the rainy season provided that on-site erosion control measures are installed prior to the commencement of any grading activities. The adopted (but as yet un-codified) amendment to the Coastal Resources Protection Overlay Zone, Section 21.203.040(B)(4)(e), also allows for grading during the rainy season in areas of very low risk of impact to coastal resources.. As described above, the Thompson/Tabata residential development is surrounded on all sides by pre-existing residential development. The small area of sensitive habitat on the Thompson/Tabata site is located along the eastern property line and will not be impacted by the proposed grading activities. With the environmental considerations of the adopted condition #12 satisfied through the existing erosion control devices and the project site's approved SWPPP, and out of consideration for the existing residents in the established neighboring communities, the applicant proposes to replace the language cited above with the following: If a grading permit is required, all grading activities shall comply with Chapter 15.16 of the Carlsbad Municipal Code, and particularly with Section 15.16.120 as it pertains to storm damage precautions. Subject: CDP 98-68 Amendment Dear Mr. Grim: Please find the attached packet prepared on behalf of Standard Pacific Homes, applicant and owner of the Thompson/Tabata residential development, CT 98-14, requesting an amendment to CDP 98-68. The requested amendment seeks to replace condition #12 of Planning Commission Resolution 5073 with language from Chapter 15 of the Carlsbad Municipal Code. The result would permit the approved project grading activities to take place between January 1 and April 1. The rationale for this request is two-fold. First, the Thompson/Tabata residential development is an infill project, surrounded on nearly all sides with existing residential development. The unavoidable inconveniences, including noise, dust, and traffic delays associated with grading would have a greater impact on the adjacent developments during the summer dry season than in the winter months when residents are more likely to be indoors with windows closed. Second, the negative environmental impacts previously associated with winter grading have been eliminated through the combination of installed off-site and required on-site erosion control and protection measures. As a result, grading in the least inconvenient time for the existing residents no longer would result in deleterious environmental impacts.
