Re: LCWD Saxony Sewage Pump Station; Appeal A-6-CEB-99-089
Dear Larinda:
As a follow up to our telephone call of this morning, this will confirm the following:
1. The undersigned represents LCWD as its general counsel.
2. Pursuant to direction from the LCWD Board of Directors and General
Manager at an LCWD Board meeting last night (July 21, 1999), LCWD is requesting that
the above-referenced appeal be continued from the August 10-13, 1999 Commission
meeting to a future meeting date.
3. The purpose of LCWD's request is to allow time for LCWD staff to meet with
Commission staff in an effort to resolve any Commission concerns.
Because the Commission's Notification of Appeal of this matter does not disclose
any of the specifics that lead to the filing of the appeal and because, in spite of some back
and forth communication between Commission staff and Dudek, LCWD's design
engineers, LCWD does still not fully understand the Commission's concerns that lead to
the filing of the appeal, we would like the opportunity to meet with staff and see if the
matter can be resolved. As I mentioned on the telephone, LCWD, its Board of Directors
and Manager have a strong commitment to addressing and resolving, if at all possible, any
legitimate Commission concerns.
I appreciate your assistance and cooperation. LCWD staff will be in touch with you
with regard to a follow up meeting. LCWD's Board has continued this entire matter,

including the award of the construction contract, which was scheduled for last night's
LCWD Board meeting, until its August Board meeting in the hopes that the pending coastal
issues can be resolved within that time frame.
