HomeMy WebLinkAboutCDP 98-78; Hosp Grove Trail; Coastal Development Permit (CDP) (6)Citvof , I M . l - . e MINOR COASTAL DEVELOPMENT PERMIT NOTICE OF DECISION January 14,1999 TO: ALL INTERESTED PARTIES SUBJECT: CDP 98-78 - HOSP GROVE TRAIL The City has completed a review of the application for a Minor Coastal Development Permit for development of a public trail to be located in the Hosp Grove property owned by the City of Carlsbad. It is the Planning Director’s determination that the project, CDP No. 98-78, is consistent with the applicable City’s Coastal Development Regulations (Chapters 21.201 - 21.205) and with all other applicable City ordinances and policies. The Planning Director, therefore, APPROVES this request based upon the following: Findinas: 1. That the total cost of the proposed development is less than $60,000. The trail will be constructed using volunteer labor. 2. That the proposed development requires no discretionary approvals other than a Minor Coastal Development Permit. 3. That the development has no adverse effect individually or cumulatively on coastal resources or public access to the shoreline or the coast, in that Hosp Grove is a eucalyptus woodland whose primary resource is visual. Construction of the trail will not impair the visual qualities of the area and will provide enhanced public access to the area. In addition, the trail will improve the public’s visual access to other coastal resources such as Buena Vista Lagoon by providing viewpoints. 4. That the proposed development is in conformance with the Certified Local Coastal Program and all applicable policies in that Mello II Policy 7-6 calls for improved trail access adjacent to Buena Vista.Lagoon. 5. That the development is in conformity with the public access and public recreation policies of Chapter 3 of the Coastal Act, in that the purpose of the project is construction of a trail for public access. That this request for a minor coastal development permit was adequately noticed at least fifteen (15) working days before the date of this decision pursuant to Section 21.201.080(B) and (C) of the Carlsbad Coastal Development Regulations (see attached copy of notice). 7. That the Planning Director has determined that the project is in prior compliance with the requirements of the California Environmental Quality Act (CEQA) per Section 15153 of the State CEQA Guidelines in that the project was analyzed as part of the Master Environmental Impact Report for the General Plan (EIR 93-01) certified on September 6, 1994. That EIR adequately addressed the potential environmental effects of construction of the Citywide Trail system. Construction of this trail segment will not have a negative effect on the environment because the trail alignment has been designed to avoid any sensitive vegetation and the trail will follow gentle slopes to prevent erosion. . . The Planning Director does hereby APPROVE the MINOR COASTAL DEVELOPMENT PERMIT CDP 98-78 for the Hosp Grove Trail project entitled “HOSP GROVE“ (Exhibit “A”, dated January 14, 1999), on file in the Planning Department and incorporated by this reference, subject to the conditions herein set forth. Staff is authorized and directed to make, or require the Developer to make, all corrections and modifications to the documents, as necessary to make them internally consistent and in conformity with the final action on the project. Development shall occur substantially as shown on the approved Exhibits. Any proposed development substantially different from this approval, shall require an amendment to this approval.
