This supplemental application is to be filed for any development requiring a Coastal
Development Permit issued by the City of Carlsbad.
I. GENERAL BACKGROUND
A. Estimated Cost of Development:
Development costing $60,000 or more does not qualify as a Minor Coastal
Development Permit. The Planning Director shall make the final determination
regarding a project's cost of development.
The primary basis for determining cost of development will be the application of
dollar costs per square foot for different types of residential construction. These
costs are set by the International Conference of Building Officials (ICBO) and
are applied throughout San Diego County.
Please complete the following information to assist in the determination of this
project's cost of development (Contractor proposals may also be submitted for
consideration by the Planning Director).

JUSTIFICATION FOR VARIANCE
By law a Variance may be approved only if certain facts are found to exist. Please read these
requirements carefully and explain how the proposed project meets each of these facts. Use additional
sheets if necessary.
1. Explain why there are exceptional or extraordinary circumstances or conditions applicable to the
property or to the intended use that do not apply generally to the other property or class of use in
the same vicinity and zone:
Subject property is located on Ocean Street (westerly side) and
as all the adjacent properties have existing Front Yard setbacks
8f fifteen feet fromt the "NEW" line established for the purposes of
providing the City of Carlsbad with a five feet of "Public Dedication".
2. Explain why such variance is necessary for the preservation and enjoyment of a substantial
property right possessed by other property in the same vicinity and zone but which is denied to
the property in question:
As decribed above, other properties adjacent have been provided with sv
such reduced setbacks. For thts property to enjoy similar benefits^ the
five feet reduced setback should be granted.
3. Explain why the granting of such variance will not be materially detrimental to the public
welfare or injurious to the property or improvements in such vicinity and zone in which the
property is located:
Granting the reduced setback will only provide this property with the
same conditions as the other properties' adjacent and will be consistent
with previously issued variances - not being detrmental to the public
welfare or injurious to the property or improvements in the vicinity
adjacent to same .
4. Explain why the granting of such variance will not adversely affect the comprehensive general
plan:
As this is for a reduced setback (from 20 feet to fifteen) which has been
granted to other surrounding proprtie^, it has no affect on the comprehensive
general plan.

Description/Explanation:
Project consists of demolishing and removing existing 2 - level single family dwelling
with attached garage and associated exterior balcony decks, on-grade concrete
walks, driveway, patios and the following existing site improvements:
• masonry and wood frame gazebo
certain low stone masonry garden and retaining walls associated with the
proposed grading.
Construction of new 2-level single family dwelling, four-car garage, exterior balcony
decks, on-grade swimming pool & spa with associated concrete decks.
The front yard has a standard 20 ft. requirement - as the City of Carlsbad requests a
5'-0" dedication for future street improvements, this project respectfully requests a
variance for the front yard setback to be reduced to 15'-0".
Side yards are in conformance with the 10% of the property width and all structures
respect "stringline" setbacks along the oceanfront as follows:
A "stringline" setback for structures has been established from the southwest
corner of the existing residence on the property immediately north of the
subject property - extending to the northwest corner of the existing residence
on the property immediately south of the subject property.
A "stringline" setback for "above grade decks and patios" has been established
from the southwest corner of the existing residence on the property
immediately north of the subject property - extending to the northwest corner of
the existing above grade deck / balcony of the residence on the property
immediately south of the subject property.

• A "stringline" setback has been established for the swimming pool / spa and
related deck in accord with previous Coastal Development Permit (6-82-153),
identified from the southwest corner of the existing seawall of the property
immediately north of the subject property - extending to the northwest corner of
the existing balcony of the residence on the property immediately south of the
subject property.
Copies of the above referenced coastal development permit (6-82-153) and
letter from Van Lynch (dated November 16, 1998) addressing same is attached
herewith for reference.

Description/Explanation:
The project is a single family dwelling, intended for use by the Onwers,
Ron and Mary Day.
Itnincludes attached garages for 4 cars, two levels of living space
and associated pool and spa with decks and patios.
The City has requested five feet of "Public Dedication" ertong Ocean
Street, which reduces the existing twenty feet to fifteen feet. Similar
front yards along Ocean Street have been granted for similar uses over
the recent years.
We hereby request an "Administrative Variance" to reduce the front
yard setback from twenty feet to fifteen feet, thus accommodating the
Coastal Development Permit process.
