Dear Dennis:
Thank you for your response letter dated January 19, 2000 (to my letter of January 11,
2000).
I just wanted to confirm our mutual understanding as set forth in your letter: SDG& E
will demolish and haul away all of the block retaining wall, footings and concrete house-
keeping pad that is currently located in front of our property at 5185 Carlsbad Blvd. We
will place a permanent asphalt driveway around the remaining handhole. SDG&E at its
expense will adjust the handhole one time to an acceptable driveway grade angle (the
grade to be provide to you by our contractor) which will conform to SDG& E acceptable
grade standards are per the SDG& E standards pages 3483.1,2,3 and 4 (and you have
provided Mr. Soto, our contractor, with these standard pages) . (If in the future we want
or request further adjusts in excess of Vi" after this initial adjustment we will be billed for
work.) We will agree to provide you with our final grade plans to confirm the above.
If the City of Carlsbad modifies Carlsbad Blvd in the future, SDG & E will adjust (at no
expense to us) to eliminate any conflict with the handhole per SDG &E's current
Franchise Agreement.
