At the Planning Commission meeting of July 7, 1999, your application was considered. The
Commission voted 7-0 to APPROVE your request. The decision of the Planning Commission became
final on July 7, 1999.
The time within which judicial review of this decision must be sought is governed by Code of Civil
Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad
Municipal Code 1.16. Any petition or other paper seeking judicial review must be filed in the
appropriate court not later than the ninetieth day following the date which this decision becomes final;
however, if within ten days after the decision becomes final a request for the record of the proceedings
accompanied by the required deposit in an amount sufficient to cover the estimated cost of preparation of
such record, the time within which such petition may be filed in court is extended to not later than the
thirtieth day following the date on which the record is either personally delivered or mailed to the party,
or his attorney of record, if he has one. A written request for the preparation of the record of the
proceedings shall be filed with the Planning Director, Michael J. Holzmiller, Secretary of the Planning
. Commission, 2075 Las Palmas Drive, Carlsbad, CA 92009.

The Engineering Department has completed its review of the above referenced project.
Engineering staff does not have any comments to add to the project. Please add the following
conditions of approval to the approving resolution:
1. Prior to issuance of any building permit, the developer shall comply with the requirements of
the City's anti-graffiti program for wall treatments if and when such a program is formerly
established by the City.
2. Prior to issuance of a building permit for any buildable lot within the subdivision, the property
owner shall pay a one-time special development tax in accordance with City Council
Resolution No. 91-39.
3. The developer shall pay all current fees and deposits required.
4. The owner of the subject property shall execute an agreement holding the City harmless
regarding drainage across the adjacent property prior to the issuance of building
permits.

Your application has been tentatively scheduled for a hearing by the Planning
Commission on July 7, 1999. However, for this to occur, you must submit the
additional items listed below. If the required items are not received by June 1,
1999, your project will be rescheduled for a later hearing. In the event the
scheduled hearing date is the last available date for the City to comply with the
Permit Streamlining Act, and the required items listed below have not been
submitted, the project will be scheduled for denial.
1. As required by Section 65091 of the California Government Code, please
submit the following information needed for noticing and sign the enclosed

A) 600' Owners List - a typewritten list of names and addresses of all
property owners within a 600 foot radius of the subject property,
including the applicant and/or owner. The list shall include the San
Diego County Assessor's parcel number from the latest equalized
assessment rolls.
B) 100' Occupant List - (Coastal Development Permits Only) a
typewritten list of names and addresses of all occupants within a 100
foot radius of the subject property, including the applicant and/or
owner.

made regarding the furnishing of alcoholic beverages at the above referenced

1. Furnishing of alcoholic beverages to hotel guests and their invitees during
a limited daily "happy hour" period would be a permitted as an accessory
use to the hotel so long as the use is not open to the general public.
2. Furnishing of alcoholic beverages to hotel guests by means of controlled

COMPLETENESS & ISSUES REVIEW
Engineering Department staff has completed a review of the above-referenced project for
application completeness. The application and plans submitted for this proposed project are
considered complete. Additionally, staff has conducted a review of the project for engineering
issues of concern. Engineering issues which need to be resolved or adequately addressed prior
to staff making a determination on the proposed project are as follows:
1. The plan indicates that 20 feet of cut and fill is proposed. Show where the proposed
grading will occur with new contour lines, spot elevations, etc.
2. Provide a profile of the proposed retaining walls. Indicate top of wall and finish surface
elevations.
3. Is the "new" property line location proposed or existing? Our records indicate that they
exist in the position shown. Please clarify.
4. There is an additional 3 ft wide public street and utility easement on the property.. Also,
the title report states that there is an SDG&E easement along the westerly 5 feet of the
easterly 8 feet of lot 7. Please show these easements.
5. Provide north arrow on site plan.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Coastal Development Permit, application no. CDP 99-14, as
to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is
information which must be submitted to complete your application. This list of items must
be submitted directly to your staff planner by appointment. All list items must be
submitted simultaneously and a copy of this list must be included with your submittals.
No processing of your application can occur until the application is determined to be
complete. The second list is issues of concern to staff. When all required materials are
submitted the City has 30 days to make a determination of completeness. If the
application is determined to be complete, processing for a decision on the application will
be initiated. In addition, please note that you have six months from the date the
application was initially filed, March 29, 1999, to either resubmit the application or submit
the required information. Failure to resubmit the application or to submit the materials
necessary to determine your application complete shall be deemed to constitute withdrawal
of the application. If an application is withdrawn or deemed withdrawn, a new application
must be submitted.

Planning:
1. Please submit two additional copies of the Preliminary Title Report.
Engineering:

ISSUES OF CONCERN
Planning:
1. Please show the height of the proposed retaining walls. The maximum height for
walls (retaining, freestanding, or a combination) within the 20 foot front setback is
42 inches. Walls beyond the front setback may have a height of 6 feet.
2. The site plan needs to be revised so that the posts supporting the hobby room porch
are located behind the 20 foot front yard setback.
3. Franciscan Road is incorrectly labeled as "Drive" on the site plan and vicinity map.
4. Please show the interior dimension of the garage. The minimum required dimension
is 20' x 20' clear.
5. The window seat projection may not extend to the ground level. Please revise the
right side building elevation and also show the window seat on the left side
elevation.
6. Please dimension the roof overhang on the building elevation sheet.
7. When the Planning and Engineering corrections have been made, please resubmit 4
sets of plans and one set of plans reduced to 8 Ya" x 11".
