At the Planning Commission meeting of September 15, 1999, your application was considered. The
Commission voted 6-0 (Trigas Absent) to APPROVE AS AMENDED your request. The decision of
the Planning Commission became final on September 15, 1999.
The time within which judicial review of this decision must be sought is governed by Code of Civil
Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad
Municipal Code 1.16. Any petition or other paper seeking judicial review must be filed in the
appropriate court not later than the ninetieth day following the date which this decision becomes final;
however, if within ten days after the decision becomes final a request for the record of the proceedings
accompanied by the required deposit in an amount sufficient to cover the estimated cost of preparation of
such record, the time within which such petition may be filed in court is extended to not later than the
thirtieth day following the date on which the record is either personally delivered or mailed to the party,
or his attorney of record, if he has one. A written request for the preparation of the record of the
proceedings shall be filed with the Planning Director, Michael J. Holzmiller, Secretary of the Planning

Dear David,
As follow-up with our discussions, we have performed a detailed calculation of the grading quantities for
the subject project.
As previously approved, the quantities were "roughly" estimated for the initial purpose of review for the
Coastal Permit application and consequently indicated 213 c.y. of grading "outside" the structural
envelope of the building.
Upon performing the detailed calculation of grading quantities, we find that there is actually 69.8 c.y.
associated with grading "outside" the structural envelope of the building.
The "lower" patio / deck area (elevation 22.21) is a part of the foundation system supporting walls and
stairs extending to the second floor and roof. Including this area as a part of the "building structure" along
with the detailed calculations of the balance of the site, creates the correct grading quantities as follows:
Excavation limited to structure: 803.20 c.y.
Excavation outside structure: 69.80 c.y.
Total Excavation: 873.00 c.y.
Graded area as a factor of c.y. / s.f. of site area: 69.80 c.y. -t 5781.00 s.f. = 0.0120 (Where allowable is

Your application has been tentatively scheduled for a hearing by the Planning Commission on
September 15, 1999. However, for this to occur, you must submit the additional items listed
below. If the required items are not received by August 18, 1999, your project will be
rescheduled for a later hearing. In the event the scheduled hearing date is the last available date
for the City to comply with the Permit Streamlining Act, and the required items listed below
have not been submitted, the project will be scheduled for denial.
1. Please submit the following plans:
A) 10 copies of your (site plans, landscape plans, building elevation plans, floor
plans) on 24" x 36" sheets of paper, stapled in complete sets folded into S'/a' x
11" size.
B) One 8Vz" x 11" copy of your reduced site plan, building elevation and floor
plans. These copies must be of a quality which is photographically
reproducible. Only essential data should be included on plans.
2. As required by Section 65091 of the California Government Code, please submit the
following information needed for noticing and sign the enclosed form:
A) 600' Owners List - a typewritten list of names and addresses of all property
owners within a 600 foot radius of the subject property, including the applicant
and/or owner. The list shall include the San Diego County Assessor's parcel
number from the latest equalized assessment rolls.
B) 100' Occupant List - (Coastal Development Permits Only) a typewritten list of
names and addresses of all occupants within a 100 foot radius of the subject
property, including the applicant and/or owner.
C) Mailing Labels - one (1) separate set of mailing labels of the property owners
within a 600 foot radius and occupants within a 100 foot radius of the subject
property. The list must be typed in all CAPITAL LETTERS, left justified,
void of any punctuation. For any address other than a single family residence,
an apartment or suite number must be included but the Apartment, Suite and/or
Building Number must NOT appear in the street address line. DO NOT type

PROPOSED MINOR SUBDIVISION NO. MS 99-02,140 CHESTNUT CONDOMINIUM
A preliminary decision has been made, pursuant to Section 20.24.120 of the City of Carlsbad Municipal
Code, to approve the tentative parcel map of the proposed minor subdivision subject to conditions that
follow in this letter.
Unless specifically stated in the condition, all of the following conditions, upon the approval of this
tentative parcel map, must be met prior to approval of a final parcel map.
1. Prior to issuance of any building permit, the developer shall comply with the requirements of the
City's anti-graffiti program for wall treatments if and when such a program is formerly
established by the City.
2. Approval of MS 99-02 is granted subject to the approval of CP 99-07 and CDP 99-16. MS
99-02 is subject to all conditions of approval contained in CP 99-07 and CDP 99-16.
3. The developer shall provide the City with the approved tentative parcel map. The map shall be
to scale on a reproducible 24" x 36" xerox mylar or photo mylar. It shall reflect the conditions of
approval by the City. The reproducible shall be submitted to the City Engineer, reviewed and
signed by the City's project engineer and project planner prior to submittal of the building plans,
final map, improvement or grading plans, whichever occurs first
4. The developer shall defend, indemnify and hold harmless the City and its agents, officers, and
employees from any claim, action or proceeding against the City or its agents, officers, or
employees to attack, set aside, void or null an approval of the City, the Planning Commission or
City Engineer which has been brought against the City within the time period provided for by
Section 66499.37 of the Subdivision Map Act.
5. The net developable acres shall be shown for each parcel.
6. The developer shall pay all current fees and deposits required.
7. The owner of the subject property shall execute an agreement holding the City harmless
regarding drainage across the adjacent property.
8. Prior to approval of any grading or building permits for this project, the owner shall give written

consent to the annexation of the area shown within the boundaries of the subdivision into the
existing City of Carlsbad Street Lighting and Landscaping District No. 1 on a form provided by
the City.
9. The owner shall make an offer of dedication to the City for all public streets and easements
required by these conditions or shown on the tentative parcel map. The offer shall be made by
a certificate on the final map for this project. All land so offered shall be granted to the City free
and clear of all liens and encumbrances and without cost to the City. Streets that are already
public are not required to be rededicated.
10. Additional drainage easements may be required. Drainage structures shall be provided or
installed prior to or concurrent with any grading or building permit as may be required by the
City Engineer.
11. The developer shall provide an acceptable means for maintaining the private easements within
the subdivision and all the private: streets, sidewalks, street lights, storm drain facilities and
sewer facilities located therein and to distribute the costs of such maintenance in an equitable
manner among the owners of the properties within the subdivision. Adequate provision for such
maintenance shall be included in a recorded document subject to the approval of the City
Engineer.
12. Rain gutters must be provided to convey roof drainage to an approved drainage course or street
to the satisfaction of the City Engineer.
13. Prior to hauling dirt or construction materials to or from any proposed construction site within
this project, the developer shall submit to and receive approval from the City Engineer for the
proposed haul route. The developer shall comply with all conditions and requirements the City
Engineer may impose with regards to the hauling operation.
14. No grading for private improvements shall occur outside the limits of the subdivision unless a
grading or slope easement or agreement is obtained from the owners of the affected properties
and recorded. If the developer is unable to obtain the grading or slope easement, or agreement,
no grading permit will be issued. In that case the developer must either amend the tentative map
or modify the plans so grading will not occur outside the project site in a manner which
substantially conforms to the approved tentative map as determined by the City Engineer and
Planning Director.
15. No driveway gates shall be installed without the approval of the City Engineer.
16. The developer shall provide for sight distance corridors at all street intersections in accordance
with Engineering Standards and shall record the following statement on the Final Map (and in
the CC&R's).
"No structure, fence, wall, tree, shrub, sign, or other object over 30 inches above the
street level may be placed or permitted to encroach within the area identified as a sight
distance corridor in accordance with City Standard Public Street-Design Criteria, Section
8.B.3. The underlying property owner shall maintain this condition."
17. The developer shall comply with the City's requirements of the National Pollutant Discharge
Elimination System (NPDES) permit. The developer shall provide best management practices as
referenced in the "California Storm Water Best Management Practices Handbook" to reduce
surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans for such
improvements shall be approved by the City Engineer. Said plans shall include but not be
limited to notifying prospective owners and tenants of the following:
A. All owners and tenants shall coordinate efforts to establish or work with
established disposal programs to remove and properly dispose of toxic and
hazardous waste products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil,
antifreeze, solvents, paints, paint thinners, wood preservatives, and other such
fluids shall not be discharged into any street, public or private, or into storm
drain or storm water conveyance systems. Use and disposal of pesticides,
fungicides, herbicides, insecticides, fertilizers and other such chemical
treatments shall meet Federal, State, County and City requirements as prescribed
in their respective containers.
C. Best Management Practices shall be used to eliminate or reduce surface
pollutants when planning any changes to the landscaping and surface
improvements.
Parcel Map Notes
18. Note(s) to the following effect(s) shall be placed on the parcel map as non-mapping data:
18a. Building permits will not be issued for development of the subject property unless the
District Engineer determines that sewer facilities are available.
Code Reminder
19. The tentative parcel map approval shall expire twenty-four (24) months from the date of the
letter containing the final decision for tentative parcel map approval.
20. The project is approved under the express condition the developer pay the additional public
facilities fee in accordance with City Council Resolution No. 9169 adopted July 28, 1987 and as
amended from time to time. The developer further agrees to pay any development fees
established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code. The
developer's written agreement to pay said fees is on file with the office of the City Clerk and is
incorporated herein by this reference. If the fees are not paid, this application will not be
consistent with the General Plan and approval for this project shall be void.
Water District
21. The Developer will be expected to provide detailed information to the District Engineer
regarding water demand, irrigation demand, fire flow demand in gallons per minute, and
projected sewer flow in million gallons per day.
22. The entire potable water system, recycled water system and sewer system shall be evaluated in
detail by Developer and District Engineer to insure that adequate capacity, pressure and flow
demands can be met.
23. All District pipelines, pump stations, pressure reducing stations and appurtenances required for
this project by the District shall be within public right-of-way or within easements granted to the
District or the City of Carlsbad.
24. Sequentially, the Developer's Engineer shall do the following:
A. Meet with the City Fire Marshal and establish the fire protection requirements.
B. Prepare and submit a colored recycled water use area map and submit this map to the
Planning Department for processing and approval by the District Engineer.
C. Prior to the preparation of sewer, water and recycled water improvement plans, the
Developer shall submit preliminary system layouts to the District Engineer for review,
comment and approval.
25. All potable water and recycled water meters shall be placed within public right of way.
26. No more than 19 homes (dwelling units) shall be served on a single potable water distribution
pipeline. For those locations with more than 19 homes (dwelling units), a looped potable water
pipeline system shall be designed. The Developer should verify with the District Engineer that a
looped system will not be required for this project.
27. If fire hydrant(s) are required by the Fire Marshal, a looped fire line system may be required for
any fire line run greater than 150 feet. The Developer shall verify with the District that a looped
fire line system will not be required for this project.
The developer may request a review of the preliminary decision with the City Engineer in writing within
ten (10) days of the date of this letter. Upon such written request the City Engineer shall arrange a time
and place with the developer for such review.
The City Engineer has reviewed each of the exactions imposed on the developer contained in these
conditions of approval, and hereby finds, in this case, that the exactions are imposed to mitigate impacts
caused by or reasonably related to the project, and the extent and degree of the exaction is in rough
proportionality to the impact caused by the project.

SECOND CHECK - ISSUES REVIEW
Thank you for responding to my issues letter dated April 26, 1999. Most of the issues listed in
the letter have been addressed. In addition, we have determined that the proposed driveway
grade is acceptable at the grades proposed: A few minor issues, however, still remain and
need to be addressed. They are as follows:
1. The response letter that I received from Wayne Davis indicated that the "Basement Level
Floor Plan" (Sheet A2) indicated with note #8 that overhead roll-up section garage doors
would be used. Sheet A2 does have a leader with note #8 but sheet A1, which describes
note 8, still states "concrete steps on grade". No description for note #8 exits on Sheet A2.
Please correctly describe note 8.
2. The enhanced pavement needs to be removed from the walkways as well as the driveways
unless it is your intention to enter into an encroachment agreement with the City via
separate application and processing fee. Please either revise the plans or let me know if
you intend to enter into such an agreement and I will add a condition to your project
requiring completion of such agreement prior the issuance of building permits.
3. How will surface drainage flow westward between the building and fence once it reaches
the steps which extend upward to the patio. It appears that the steps will interfere with
drainage flow or are there openings beneath the steps to allow passage of surface water?
4. Several palms are located within the site distance line extending from the motorist's vision
eastward. These plants need to be removed from the landscaping plan. Only ground cover
can be placed here. Please revise landscape plan accordingly.
5. Please add the following note on the tentative parcel map: "This is a tentative parcel
map of a condominium project as defined in Section 1350 of the Civil Code of the State
of California. The project contains a maximum of 2 units".
6. It appears that an explanation for notes 03 and 07 are missing from Sheet A2. I suspect
that these notes explain where the water will exit from the sump and drain?
Please submit two sets of revised plans. One set will be used for the approved exhibit for
the minor subdivision, the other for the Condominium Permit. I have already asked Greg
Fisher in the Planning Department if he had any remaining plan revisions. He indicated that
the following clarification needed to be made:
1. There is a discrepancy in area between the common areas. The Project Summary
indicates that the BBQ area is 204 square feet. Yet, the area shown on the A1 plan is
150 s.f. Please clarify. Also, the 140 s.f. of common "sitting area" at the corner of

Chestnut and Carlsbad B\vd needs to be added to the "Project Summary" table under
"Common Areas".
Because the outstanding issues are minor, Greg and I will continue to process your
application. However, I will not be able to finalize the approval for the minor subdivision nor
will Greg schedule the application for Planning Commission until we receive the corrected
sets.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Condominium Permit, Coastal Development Permit and Site
Development Plan, application no. CP 99-07, AV 99-16 & SDP 99-08, as to its
completeness for processing.
The items requested from you earlier to make your Condominium Permit, Coastal
Development Permit & Site Development Plan, application no. CP 99-07, CDP 99-16 & SDP
99-08 complete have been received and reviewed by the Planning Department. It has been
determined that the application is now complete for processing. Although the initial

In response to your above referenced letter, we have revised the drawings accordingly. The following is an
itemized description of the respective issues addressed in your letter and that from David Rick of the

The District is providing comments on the subject project dated March 31. 1999. Based
on our review of the documents submitted, we have the following comments regarding
potable water, recycled water and sewer systems:
1. The Developer will be expected to provide detailed information to the District
Engineer regarding water demand, irrigation demand, fire flow demand in gallons
per minute, and projected sewer flow in million gallons per day.
2. The entire potable water system, recycled water system and sewer system shall
be evaluated in detail by Developer and District Engineer to insure that adequate
capacity, pressure and flow demands can be met.
3. All District pipelines, pump stations, pressure reducing stations and
appurtenances required for this project by the District shall be within public right-
of-way or within easements granted to the District or the City of Carlsbad.

4. Sequentially, the Developer's Engineer shall do the following:
A. Meet with the City Fire Marshal and establish the fire protection
requirements.
B. Prepare and submit a colored recycled water use area map and submit
this map to the Planning Department for processing and approval by the
District Engineer.
C. Prior to the preparation of sewer, water and recycled water improvement
plans, the Developer shall submit preliminary system layouts to the District
Engineer for review, comment and approval.
5. All potable water and recycled water meters shall be placed within public right of
way.
6. No more than 19 homes (dwelling units) shall be served on a single potable
water distribution pipeline. For those locations with more than 19 homes
(dwelling units), a looped potable water pipeline system shall be designed. The
Developer should verify with the District Engineer that a looped system will not
be required for this project.
7. If fire hydrant(s) are required by the Fire Marshal, a looped fire line system may
be required for any fire line run greater than 150 feet. The Developer shall verify
with the District that a looped fire line system will not be required for this project.

COMPLETE APPLICATION & INITIAL ISSUES REVIEW
Thank you for applying for Land Use Permits within the City of Carlsbad.
Engineering Department staff has reviewed the tentative parcel map, application No.
MS 99-02, as to its completeness for processing. The application is complete, as
submitted. Although the initial processing of the application may have already
begun, the official acceptance date of the application is the date of this letter. Staff
may, in the course of processing the application, request that you clarify, amplify,
correct, or otherwise supplement the basic information required for the application.
In addition, design issues exist which must be resolved or adequately addressed
prior to staff making a determination to approve or deny the project. These issues
are addressed in the "incomplete application and initial issues review" letter sent to
you earlier.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Condominium Permit and Coastal Development Permit,
application no. CP 99-07 & AV 99-16, as to its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is
information which must be submitted to complete your application. This list of items must
be submitted directly to your staff planner by appointment. All list items must be
submitted simultaneously and a copy of this list must be included with your submittals. No
processing of your application can occur until the application is determined to be complete.
The second list is issues of concern to staff. When all required materials are submitted the
City has 30 days to make a determination of completeness. If the application is
determined to be complete, processing for a decision on the application will be initiated. In
addition, please note that you have six months from the date the application was initially
filed, April 5, 1999, to either resubmit the application or submit the required information.
Failure to resubmit the application or to submit the materials necessary to determine your
application complete shall be deemed to constitute withdrawal of the application. If an
application is withdrawn or deemed withdrawn, a new application must be submitted.

1. The subject site is located within the Beach Area Overlay Zone. The proposed two unit
condominium project requires the processing and approval of a Site Development Plan
(SDP). The fee for the SDP is $2,670.00 and was omitted from the original application
submittal on April 5, 1999. The Planning Department will deem your application
complete as soon as the check for the SDP is received. For your convenience, you may
either bring the check in person or mail the check to the City of Carlsbad. Be sure to
reference the project by name or application number when mailing the check. NOTE:
There is no other information required for the SDP other then the fee.

ISSUES OF CONCERN

1. The common ("BBQ") area must meet the required 200 square feet minimum per the
