This approval is expressly conditioned on the payment by the applicant of a public facilities fee as required by City Council Policy No. 17, dated February 24, 1982, and effective April 2, 1982, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee. If said fee is not paid as promised, this application will not be consistent with the General Plan and the project cannot proceed and this approval shall be void. 2. The tentative parcel map approval shall expire one year from the date of the letter containing the final decision for tentative map approval. 3. All required fees and deposits shall be paid prior to final parcel map recordation (see attached list). Access to Parcels 2 and 3 shall be from Alder Avenue. 4 shall be used as a common driveway.) Drainage shall be controlled as to not increase runoff to the southwest. All roof drains must drain towards Alder Avenue, via an approved system. This system shall be approved by the City Engineer prior to approval of the Final Map. 7. Offsite improvements along Sunnyhill Drive will also be required prior to occupancy of Parcel or 3 of this subdivision. The driveway use by Parcel 1 must be crowned up approximately 1 foot to reduce the potential of excess runoff from Sunnyhill Drive. The design of this "crown" must be approved by the City Engineer prior to recordation of the Fianl Map. 8. A non-erosive drainage ditch must be installed along the southerly boundary of Parcel 2 prior to the occumpancy of said parcel. This condition may be modified to an alternative moisture barrier, with the approval of the Ctiy Engineer. 9. The applicant may request a review of the conditions in writing within ten days of the date of this approval. Staff has investigated your concems and, in regards to drainage and access, have found some viable solutions. The subdivision will be given a conditional approval, which must be met before Final Map Approval, or in some cases before occupancy. These conditions will establish fees, maintenance, and more particularly, access and drainage pattems. Some typical conditions for this subdivision will be as follows: Access to Parcels 2 and 3 shall be from Alder Avenue. (Parcel 4 shall be used as a common driveway.) A block wall shall be constructed along the southerly property line of Parcel 1. This block wall shall physically prevent access northerly to Sunnyhill Drive of Parcel 2 and Parcel 3. The Code further provides that payment of said fee may be made at the time that building permits for construction of units in the subdivision or upon the sale of the first lot on the subdivision whichever occurs first, provided that subdivider enters into an agreement secured by an approved security to insure payment of said fee. D. Subdivider, in consideration of the approval and recordation of the final or parcel map by the City, desires to enter into this agreement wherein it is provided that Subdivider will pay the fee stated on Line 5 of Page 1 hereof and will deliver to City an improvement security as approved by the City Attorney. NOW, THEREFORE, in consideration of the approval and recordation by the City of the final map, or parcel map, of this subdivision, and other valuable considerations, Subdivider and Ciy agree as follows: 1, Subdivider shall pay the fee stated on Line 5 of Page 1 hereof at the time subdivider obtains, or causes to be obtained, building permits for structures, other than public improvements, in the subdivision; or sells or causes to be sold lots in the subdivision, whichever occurs first; provided, however that if building permits are obtained for a portion of the subdivision or a portion of the lots in the subdivision are sold the fee may be paid in increments corresponding to the portion of the permits obtained or lots sold. If the fees are paid in increments the subdivider shall remain obligated to pay the fees for the remainder of the subdivision. 2. Subdivider shall furnish to City good and sufficient security on forms approved by City, in the amount of 100 percent of the fee stated on Line 5 of Page 1, hereof, to assure performance of this agreement. 3. The securities required by this agreement shall be released upon the payment in full by subdivider of the fee described herein. If a portion of the fee, described herein is paid as provided in paragraph 1 of this agreement the security shall be released in a corresponding amount. 4. In the event that Subdivider fails to perform any obligation hereunder, Subdivider agrees to pay all costs and expenses incurred by City in securing performance of such obligations, including costs of suit and reasonable attorney's fees. 5. Failure of Subdivider to comply with the terms of this agreement shall constitute consent to the filing by City of a Notice of Violation against all the lots in the Subdivision. Further, the project has been found to be categorically exempt from environmental review according to Section 19.04.070 of the Carlsbad Environmental Ordinance and a Notice of Exemption was filed on January 11, 1983. "A" Cardiff, CA 92007 Dear Von, 1 am in receipt of your letter dated September 5, 1990 in which you are proposing a boundary adjustment and or a minor subdivision to ultimately create an additional buildable lot. The existing project, (MS 597/PD 50) is a Planned Development with Parcels 1, 2 and 3 being buildable lots and Parcel 4 being a non-buildable access parcel serving Parcels 2 and 3. Your proposal implies the eradication of the existing Planned Development and the partioning off of Parcel 4 (access lot) with portions going to existing Parcels 2 and 3 in an attempt to meet the required 15,000 square foot minimum lot requirement. In order to eradicate or dissolve the existing Planned Development all of your lots (both existing and proposed) would have to meet all of the zoning requirements (per Section 21.10 CMC) for standard subdivisions. This would include standard access frontage on a publicly dedicated street or easement (75 feet for R-l5,000), panhandle width (30 feet for 2 adjacent panhandles -15 feet each), panhandle length (150 feet for one and 200 feet for the second) and the fact that panhandle square footage does not count towards the minimtmi lot square footage, (15,000 square foot minimum lot size). Per your proposal (proposed adjustment plat, copy included). Parcel A is including the panhandle square footage in the 31,212 square feet, when the panhandle is subtracted out approximately 25,385 square feet would remain, which does not meet the minimtmi 15,000 square feet for 2 lots. Also the proposed panhandle for Parcel A (about 285 feet in length) exceeds the approvable length for a single panhandle (150 feet) and would only be 17 feet in width (20 feet is required for a single panhandle and 15 feet each would be required for two adjacent panhandles 30 feet total). Your proposed Parcel B shows it to be a panhandle lot the panhandle being only 8 feet in width and I assume you would want to provide some sort of reciprocal access for Parcel B to use the proposed panhandle for Parcel A. This won't work because Parcel B does not meet the City codes for panhandles (Section 21.10.080) Parcel B would need a 15 foot wide panhandle, as would Parcel A (30 foot total), along with a reciprocal access easement. In which event, the City would require that the access parcel (Parcel 4) be expanded to 30 feet in width to meet current PD ordinance standards, and all of your existing and proposed lots would need to be a minimum of 15,000 square feet. If you are able to meet all of the requirements to create an additional lot, this wo\ald then become a 5 lot subdivision which would require subnuttal of a major subdivision/Plarmed Development Amendment submittal. (I) The home occupation shall not cause the elimination of required off-street parking. (J) The home occupation may not utilize as area greater than twenty percent of the combined total floor area of all on-site structures. (K) A dty business license is required for the condua of a home occupation; (8) Packing or sorting sheds of a total floor area of six hundred square feet or less. Packing and sorting sheds greater than six hundred square feet are permitted by approved condi- tional use permit only; (9) Mobile homes certified under the National Mobilehome Construction and Safety Standards Aa of 1974 (42 U.S.C. The appiicant shall keep all state licenses or pertnits valid and current, (V) The facility meets all applicable building standards and will not have a significant adverse affea on the environment which cannot be miti- gated or for which a finding of overriding consid- eration cannot be made, (vi) The facility meets all zoning standards otherwise applicable to other single-family resi- dences; (B) The owner of the subjea property shall make written application to the land use plan- ning manager. In the R-l zone every lot shall have side yards as follows: (a) Interior lots shall have the following side yards: (1) A side yard shall be provided on each side ofthe lot. which side yard has a width equal to ten percent of the lot width: provided, that such side yard shall not be less than five fea in width and need not exceed ten feet. (2) The land use planning manager may approve a reduction in width of one side yard provided that the opposite side yard is increased in width by an amount equal to the reduction. The minimum requiied area of a lot in the R-1 zone shall be not less than seven thousand five hundred square feet, unless otherwise shown on the zoning nup. (a) In the R-1 zone every lot shall have a mini- mum lot width as follows: (U Lots required to have an area up to ten thousand square feet, sixty feet; (2) Lots required to have an area ofat least ten thousand square fea and up to twenty thousand square feet, sevenry-five feet; (3) Lots required to have an area of twenty thousand square fea or more, dghty feet (b) The dty counciL for major subdivisions, and the land use planning ooanager, for minor subdivisions, may approve panhandle or fiag- shaped lots where the lot width and yards shall be measured in accord with this section if the fol- lowing drcumsunces are found to e.xist: (1) The property cannot be served adequately with a pubiic strea without panhandle lots due to unfavorable conditions resulting from unusual topography, surrounding land development, or lot configuration; (2) Subdivision with panhandle lots will not predude or adversely affea the ability to provide full public strea access to other properdes within the same block of the subjea property. (c) In approving a panhandle lot. a determin- ation shall be made as to what portion of such lot shall be the buildable lot; for purposes of this chapter, the buildable portion shall be the entire lot exclusive of any portion of the lot less than thirty-five fea in width that is used for access to the lot. The minimum overhead clearance shall be ten feet. The driveway shall be constructed to accommodate public service vehicles with a min- imum of two-inch thick asphalt concrete paving on proper base with rolled edges. (6) Drainage from the lot shall be channeled down the private access to a public strea or spedal drainage means must be provided to the satisfaction of the dty engineer. (7) Each lot shall have three nontandem park- ing spaces with an approach not less than twenty- four feet in length with proper turnaround space to permit complete tumaround for forward access to the street. The parking and access arrangement shall be designed to the satisfaction of the dty engineei; (8) Structures permined in the access portion of the lot shall be limited to mailboxes, fences, trash enclosures, landscape conuiners and nameplates. Except for mailboxes, the struaures shall not be greater than forty-two inches in height if located within twenty feet of the street property line or greater than six feet in height beyond this point (9) The property owner of such a lot shall agree to hold che city or any other public service agency harmless fi'om liability for any damage co the driveway when being used to perform a pub- lic service. The proposed Plat will need to be adjusted by adding an 8 foot addition to Parcel B from the "Access" Parcel as reflected on the 2nd Adjustment Plat I have enclosed. As a result of this action. Parcel "B" would ultimately have approximately 15,962 square feet of area. The balance of the "Access" Parcel would be allocated to the new Parcel "A", increasing Parcel "A" to approximately 31,212 square feet of area. Finally, Dr. Floyd wants to the lot split the new Parcel "A" into 2 lots, each greater than the minimum 15,000 s.f. requirement. I would like direction from you as to the acceptability of simply doing a new minor subdivision invloving Parcels 2, 3 and 4, and making all of the proposed adjustments and lot split within the perameters of the minor subdivision. Additionally, I seek your direction as to the acceptability of delaying the paving of the entire 24' access area to its 24' width until the need is triggered by the pulling of a building permit for the new third building lot to be created. This time limit can only be extended by the mutual concurrence of the applicant and the City. By accepting appli- cations for Tentative Parcel Maps concurrently with applications for other approvals which are prerequisites to the map; i.e.. Environmental Assessment, Environmental Impact Report, Condominium Plan, Planned Unit Development, etc., the fifty (50) day time limits are often exceeded. If you wish to have your application processed concurrently, this agreement must be signed by the applicant or his agent. If you choose not to sign the statement, the City will not accept your application for the Tentative Parcel Map until all prior necessary entitlements have been processed and approved. DEFINITION OF TERMS The following terms when used in this Guarantee mean: (a) "land": the land described, specifically or by reference, in this Guarantee and improvements affixed thereto which by law constitute real property; (b) "public records": those records which impart constructive notice of matters relating to said land; (c) "date": the effective date; (d) "the Assured": the party or parties named as the Assured in this Guarantee, or in a supplemental writing executed by the Company; * (e) "mortgage": mortgage, deed of trust, trust deed, or other security instrument. 2. EXCLUSIONS FROM COVERAGE OF THIS GUARANTEE The Company assumes no liability for loss or damage by reason of the following: (a) Taxes orassessments which are not shown as existing liens by the records of any taxing authority that levies taxes or assessments on real property or by the public records. (b) Unpatented mining claims; reservations or exceptions in patents or in Acts authorizing the issuance thereof; water rights, claims or title lo water. (c) Title to any property beyond the lines of the land expressly described in the descriptton set forth in this Guarantee, or title to streets, roads, avenues, lanes, ways or waterways on which such land abuts, or the right to maintain therein vaults, tunnels, ramps or any other structure or improve- ment; or any rights or easements therein unless such prop- erty, rights or easements are expressly and specifically set forth in said description. (d) Defects, liens, encumbrances, adverse claims against the title as guaranteed or other matters (1) created, suffered, assumed or agreed to by one or more of the Assured; or (2) resulting in no loss to the Assured. 3. PROSECUTION OF ACTIONS (a) The Company shall have the right at its own cost to institute and prosecute any action or proceeding or do any other act which in its opinion may be necessary or desirable to establish or confirm the matters herein guaranteed; and the Company may take any appropriate action under the terms of this Guarantee whether or not it shall be liable there- under and shall not thereby concede liability or waive any provision hereof. (b) In all cases where the Company does so institute and prosecute any action or proceeding, the Assured shall permit the Company to use, at its option, the name of the Assured for such purpose. Whenever requested by the Company, the Assured shall give the Company all reason- able aid in prosecuting such action or proceeding, and the Company shall reimburse the Assured for any expense so incurred. 4. NOTICE OF LOSS—LIMITATION OF ACTION A statement in writing of any loss or damage for which it is claimed the Company is liable under this Guarantee shall be furnished to the Company within sixty days after such loss or damage shall have been determined, and no right of action shall accrue to the Assured under this Guarantee until thirty days after such statement shall have been furnished, and no recovery shall be had by the Assured under this Guarantee unless action shall be commenced thereon within two years after expiration of said thirty day period. Failure to furnish such statement of loss or damage or to commence such action within the time hereinbefore specified, shall be a conclusive bar against maintenance by the Assured of any action under this Guarantee. ^. OPTION TO PAY, SETTLE OR COMPROMISE CLAIMS The Company shall have the option to pay or settle or com- promise for or in the name of the Assured any claim which could result in loss to the Assured within the coverage of this Guarantee, or to pay the full amount of this Guarantee or, if this Guarantee is issued for the benefit of a holder of a mort- gage, the Company shall have the option to purchase the indebtedness secured by said mortgage. Such purchase, pay- ment or tender of payment of the full amount of the Guarantee shall terminate all liability of the Company hereunder. In the event after notice of claim has been given to the Company by the Assured the Company offers to purchase said indebtedness, the owner of such indebtedness shall transfer and assign said indebtedness and the mortgage securing the same to the Company upon payment of the purchase price. 6. LIMITATION OF LIABILITY—PAYMENT OF LOSS (a) The liability of the Company under this Guarantee shall be limited to the amount of actual loss sustained by the As- sured because of reliance upon the assurances herein set forth, but in no event shall such liability exceed the amount of the liability stated on the face page hereof. (b) The Company will pay all costs imposed upon the Assured in litigation carried on by the Company for the Assured, and all costs and attorneys' fees in litigation carried on by the Assured with the written authorization of the Company (c) No claim for damages shall arise or be maintainable under this Guarantee (1) if the Company after having received notice of an aiieged defecL lien or encumbrance not shown as an Exception or excluded herein removes such defect, lien or encumbrance within a reasonable time after receipt of such notice, or (2) for liability voluntarily assumed by the Assured in settling any claim or suit without written con- sent of the Company. (d) All payments under this Guarantee, except for attorneys' fees as provided for in paragraph 6(b) hereof, shall reduce the amount of the liability hereunder pro tanto, and no payment shall be made without-producing this Guarantee for indorsement of such payment unless the Guarantee be lost or destroyed. In which case proof of such loss or . . destruction shall be furnished to the satisfaction of the Company. (e) When liability has been definitely fixed in accordance with this conditions of this Guarantee, the loss or damage shall be payable within thirty days thereafter. 7. SUBROGATION UPON PAYMENT OR SETTLEMENT Whenever the Company shall have settled a claim under this Guarantee, all right of subrogation shall vest in the Company unaffected by any act of the Assured, and it shall be subro- gated to and be entitled to all rights and remedies which the Assured would have had against any person or property in respect to such claim had this Guarantee not been issued. If the payment does not cover the loss of the Assured, the Company shall be subrogated to such rights and remedies in the proportion which said payment bears to the amount of said loss. The Assured if requested by the Company, shall transfer to the Company all rights and remedies against any person or property necessary in order to perfect such right of subrogation, and shall permit the Company to use the name of the Assured in any transaction or litigation involving such rights or remedies. 8. GUARANTEE ENTIRE CONTRACT Any action or actions or rights of action that the Assured may have or may bring against the Company arising out of the subject matter hereof must be based on the provisions of this Guarantee. No provision or condition of this Guarantee can be waived or changed except by a writing endorsed or attached hereto signed by the President, a Vice President, the Secretary, an Assistant Secretary or other validating officer of the Company. 9.
