Mayor Bud Lewis City of Carlsbad City Clerks Office June 11,2001 Dear Mayor, Thank you for your immediate response to my inquiry on the coastal property, comprised of 3 lots in the 5300 block of Carlsbad Blvd. However, the response does not speak to my concern, nor that of the neighbors impacted by this construction, and signed below. I was shocked to hear of a "9000" sq. ft. house being planited: that mus't be an error. I cannot believe it could be built on any one of the three lots in question! The Jenson house, at 5139 (APN 210-120-32) was verbally given to me as approximately 6000 sq. ft. That is extremely large as well. I believe, and never doubted, that permits were pulled. The problem is with the extreme grading, and the reason for that grading, as given this week by the planning and engineering departments. I would appreciate your reading the following and would hope you could respond. This project is greatly impacting the neighbors immediately to the east. Thank you: Nina Eaton RE: Extreme Raised Grading of 3 ocean front lots at furthest southern end of Carlsbad Blvd. (5139 Carlsbad Blvd. And 2 lots south) We, as neighbors are facing an issue that (1) impacts the visual entrance to Carlsbad via Carlsbad Blvd., (2) changes the entire neighborhood appearance, and (3) impacts homes on the opposite (east) side of the street, (4) was decided City Engineering, based on the future possibility of the widening /raising construction of Coast Hwy., and on the possibility that it would be done just at this location. This stretch of ocean front property begins at the extreme south end of Carlsbad with these 3 bare lots and continues north, where there are 19 existing homes and 2 lots. The existing homes appear to have been built with the natural grade, which is in all cases higher at the street, sloping down to the west, resulting in low profile coastal development along the entire strip. (1) Driving north on Coast Hwy. (Carlsbad Blvd.), one enters Carlsbad driving up a slight incline to a straightaway. Until now, this entrance to Carlsbad has been low profile. Beyond the 3 empty lots, the first visible ocean front home was built on the natural slope, with only 1/2 story visible. This lot is unusually deep, so that landscaping is all that is seen from the highway. The next home and all those remaining north, are down slope to the west, creating a low profile. Even those that are 2 story right at the street, are a low profile due to the slope on which they are built. One was just completed this year, and the city engineers did not require that to be built with a raised grade. (2) These 3 lots are drastically out of conformance with the entire stretch of homes that continues north, sweeping to the slopes of Carlsbad Beach. These are high profile, and "right in your face". Fill has been added to raise the grading by more than 3 feet where the lots meet the highway. Then they were graded higher yet to the west, to allow drainage of the front portions to go to the street. The back portions, which are the largest portions the buildings, will drain south to the public stairway, then down to the beach. One might guess that fill grading as it goes west toward the ocean, where it originally sloped down, will raise that portion of the building pad 8 to 12 ft.! In 1998, the planning dept. responded to one neighbor (Eaton) with a topographic map of the lots in question. This was in response to Eaton's inquiry as to what we might expect now that the 1^' lot appeared sold. Eaton was told that the builders would be required to lower the grade at lease 3 ft. This may have been due to the steepness of the existing slope, as well as the grading of the existing lots north. NOW engineering has required the RAISING of grade by 3 ft. plus, so final grade is 6-7 ft. higher at street level than we had been led to believe by the planning department. (3) The current high grading on these 3 lots will impact the homes immediately across the street by creating a tunnel affect from the hight of hard construction, the loss of light, and the increased hwy. noise. The entrance to Carlsbad will be a short tunnel of these 1 to 3 story structures: three of them jetting up there, all by themselves, while the rest of the stretch of homes are a completely different profile. The noise level of the hwy. has increased greatly with the current heavy use and congestion. That noise will be more of an impact when there are high, hard structures off which it can bounce. When we bought homes here, we realized that homes would one day be built across the street on the ocean front. The sale of these lots suffered due to slope instability, public usage, and lack of depth. Interestingly, the property was allowed to subdivide a year or so ago. What we question is the extreme height now that grade has been extremely increased. (4) Finally, it is amazing that the city engineering department made this decision based solely on the POSSIBILITY that Carlsbad would raise and widen Coast Hwy. at this location, at some time in the FUTURE. Engineering reasoned that this would be cost effective for the city, to have these 3 homes already raised to meet the new raised hwy. grade. .. .Even though all the homes north will not meet the new grade. What sense does this make? Can the city afford to mitigate all the homes on the east and west side of the street to make this raised, widened hwy. a reality? Where are these hwy. plans and why didn't we know of them before we invested in our homes. Most of us have been here a while. Some of the neighbors have been to meetings on these properties. Some have spoken, and feel unheard. Eaton received no notice on these properties since 1998. The reason seems to be an incorrect mailing address, even though all notices previous to that date were addressed correctly. The files on these properties show the address label to have "become" incorrect. So far, one of these properties has been permitted. We ask for some assistance and imput before the other 2 complete the process. We understand one is an owner build, one will be built for speculation. We could have 30 ft. structures, on a 3 ft. raised grade, for a hight of 33 ft. on the highway! The city cannotallow this harsh an impact on us and our properties. !^ •^.^^^^^ ^^y^ y^ (2(^^r,cfu^A.' Mnnanno ArcitJIacono (760) 4'J4-2R19 X5124 4- fAt-^A^*^^ City of Carlsbad Public Works - Engineering June 25, 2001 Nina Eaton 300 Carlsbad Village Drive, #108A-347 Carlsbad, CA 92008 LETTER TO THE MAYOR - DATED JUNE 11, 2001 Your letter to the Mayor has been forwarded to me for a response to the issues that you have brought up. 1 will address those issues in roughly the same order that you have written them in your letter. In your first paragraph you state that you were shocked to hear that the house was 9,000 square feet. You state that you were verbally told that the house would be approximately 6,000 square feet. The reason for the difference is in the terminologies used for the habitable square footage of the house versus the total square footage of house, garage, and basement. The original building permit for 5319 Carlsbad Boulevard shows 7,053 square feet of habitable space. Along with that was 1,737 square feet of unfinished basement, which is not considered habitable, plus 738 square feet of garage, also not considered to be habitable living space. Once all of those numbers are added together, it does come approximately to the 9,000 square feet that you have been told about. Your second issue appears to be your concern about what you have labeled extreme raised grading. You mention this, or items very similar to it in several places in the letter, regarding building heights and pad elevation along with a guess about grading to raise a pad 8 to 12 feet. The grading done on the subject lot totaled 690 cubic yards. We do not consider that amount to be extreme in that all City ordinances pertaining to grading would allow that amount of grading as being acceptable. The reason the Engineering Department required the fill and drainage of that front portion of the lot to go to the street is based on one of your other concerns having to do with the future design of Carlsbad Boulevard. In 1992, the City Council gave direction to enter into a contract for the design of the boulevard. That study was completed and the chosen design was signed by the City Engineer in 1993. That approved design shows that the future street elevation at the subject property will be approximately five feet higher at the curb line than the existing property currently is. One of the goals of the design was to ensure that reasonable driveway access would be maintained to serve the properties fronting along Carlsbad Boulevard. In order for the subject property to comply with this goal, they had to do the grading to place their driveway at the proposed elevation of the boulevard. This caused approximately five feet of fill to be placed on the front portion of their lot. The fill area goes from the existing pavement area of the boulevard to, and including, the garage of the property. None of the house is on fill. Those regulations state that a maximum height of 30 feet of the building is allowed. That 30 feet is measured from anywhere within the house straight up. This assures that none of the building is greater than 30 feet above what the pre-existing elevation of the property was at. This was approved by the Planning Commission at a public hearing for the Coastal Development Permit for the home. A cross-sectional detail drawing was on the exhibit that went to the Planning Commission showing this fill. From the future elevation of the curb line on Carlsbad Boulevard to the garage door is only a rise of 1/2 foot to comply with the Engineering Departments requirement for that portion of the property to drain towards the street and not back towards the cliff. The home was also conditioned to install roof gutters with the roof gutters directing the drainage for the structure to the driveway and out onto the boulevard. This was done in order to reduce the amount of drainage that would flow back towards the cliff. You had made mention that a home further north on Carlsbad Boulevard was recently constructed and was not required to raise their grade. That home was required to raise their grade at the future curb line approximately one foot. That one foot would bring their property up to the proposed grade, unlike the subject property that was five feet off of the proposed grade. In your letter you also mentioned that in 1998 the Planning Department gave indication that the area would be lowered in grade, not raised. Since the design for future roads is done by the Engineering Department, it is easily understandable that the Planning staff working at the front counter were unaware of these future design elevations approved in 1993. To summarize, the exhibits for the Coastal Development Permit approved by the Planning Commission on March 15, 2000, do match with the building as it exists. Those plans from March of 2000 do show both the existing and the proposed elevations showing that fill material was planned. There is an exhibit on those plans that show cross-sectional detail of the proposed grade changes. At the public hearing, Mr. Sides was the only person who spoke with any concerns at the Planning Commission hearing. From the minutes of that meeting, his main question was what was the elevation of the residence and the future boulevard. He was given those answers at the meeting and no one else raised any concerns at that public hearing. Since the home does comply with the approved permit and the approved permit complies with all City standards, there is nothing inappropriate or illegal that was done with the design, public hearing process, or construction ofthe home. I can understand your concern about the change taking place in your neighborhood. Change of any kind is difficult to adapt to. I can see where the impact to your view will be significant. However, you must realize that the subject property does have property rights. As long as the proposed building complies with all City ordinances and codes, it can be constructed as designed. That is the case with this property.
