We have been advised that the City of Carlsbad needs to prepare and process a Local
Coastal Permit for the referenced project. As the owner of the railroad right-of-way,
through which a portion of the sewer and storm drain pipes traverse, North County
Transit District hereby consents to the City of Carlsbad preparing, processing and
subsequently approving a local Coastal Permit for that portion of the subject project lying
within our property.
North County Transit District reserves the right to review and approve of any conditions
that may be associated with the issuance of the Local Coastal Permit prior to the permit
being approved.

South Carlsbad Village Storm Drain/Sewer Line

Please accept with this letter, application and supporting plans and
documents for authorization to place fill material into identified "waters of
the United States", pursuant to Section 404 of the Clean Water Act. These
"waters" have been identified along a linear stretch of largely unvegetated
drainage channel, which parallels the SDNR railroad tracks within the
railroad right-of-way, in the urbanized section of the city of Carlsbad.
The proposed project by the City of Carlsbad involves the installation of a
storm drain and sewer trunk line within the area in which the "waters"
drainage channel presently exists. This utility infrastructure is needed due to
the fact that the existing drainage and sewer facilities are undersized, and in
disrepair.
A Wetland Delineation Report for the South Carlsbad Village Storm Drain
Project, by Dudek & Associates, for the subject project is included in this
application package. This report concludes that a total of 0.63 acres of "waters"
will be impacted by construction of the project. Such level of impact
necessitates notification of the ACOE of the proposed discharge. Mitigation
for the impact is proposed through wetland revegetation of a proposed
designed swale, as recommended by Dudek & Associates. Inasmuch as the
proposed project is located within a highly urbanized area, we are not aware
and do not anticipate any direct or indirect effect on endangered species or
cultural resources.

The proposed project involves the installation of a backbone storm drain and
sewer line to replace existing undersized, or nonexistent lines, within the
urban area of the City of Carlsbad. The project is located wholely within the
San Diego Northern Railroad right-of-way (ROW). Proposed storm drain
sizes will range from 54-inch RCP at the northern end of the line, to 84-inch
RCP southerly of Chestnut Avenue. Sewer line sizes range from 42-inch to
48-inch RCP, with the smaller size located at the northern end of the project.
Approximately 2,750 feet (the northern segment) of the utility installation
area will replace an existing unlined, open dirt channel. This channel is
presently vegetated primarily ruderal, weedy plants, but includes two small
wetland communities totalling 0.08 acres. The entire length of this northern
segment of the project has been determined to constitute "waters of the
United States", as defined by the ordinary high water mark of the drainage. __
(Please refer to the Wetland Delineation Report by Dudek & Associates, April
19, 1999, included with this application.
The proposed storm drain/sewer line project continues southerly for another
2,750 linear feet in which it does not affect Corps jurisdictional lands to the
outfall at Agua Hedionda Lagoon. This outfall will involve placement of a
new headwall structure (not within jurisdiction). This new headwall will
replace an existing concrete channel which routes storm runoff directly into
the lagoon, onto existing riprap, which recently sunk into the substratum,
and necessitates replacement. This maintenance of the riprap will affect 0.007
of waters within the OHWM, designated as jurisdictional pursuant to the
Wetland Delineation Manual (1987). Since this riprap replacement is
considered maintenance however, no Corps permit for this portion of the
operation is requested.
Dudek & Associates conclude in the Wetland Delineation Report that
impacts to Corps Jurisdictional lands total 0.63 acres as follows:
Freshwater marsh 0.08 ac.
Waters of the US 0.55 ac.
TOTAL 0.63 ac.
Dudek & Associates recommend that mitigation for the 0.63 acres of
jurisdictional impacts be conducted via creation of 0.63 acres (1:1 ratio due to
poor quality of existing habitat) in a swale which could be constructed over
the top of the proposed utility lines. The swale could be constructed at 10 to
11 feet in width, with an average mean high water mark width at 8 feet.
Dudek recommends planting this swale with salt grass (Disichlis spicatn),
which would actually result in 0.67 acres of total mitigation area. The
applicant has agreed to concur with this recommended mitigation program.
