SUBJECT: CDP 99-59 - KATHLEEN'S MINOR SUBDIVISION
Your application has been tentatively scheduled for a hearing by the Planning Commission on
February 21, 2001. However, for this to occur, you must submit the additional items listed
below. If the required items are not received by January 31, 2001, your project will be
rescheduled for a later hearing. In the event the scheduled hearing date is the last available date
for the City to comply with the Permit Streamlining Act, and the required items listed below
have not been submitted, the project will be scheduled for denial.
1 . Please submit the following plans:
A) 10 copies of your (site plan) on 24" x 36" sheets of paper, folded into ZVz x 11"
size.
B) One S'/z" x 11" copy of your reduced site plan. This copy must be of a quality
which is photographically reproducible. Only essential data should be
included on plans.
2. As required by Section 65091 of the California Government Code, please submit the
following information needed for noticing and sign the enclosed form:
A) 600' Owners List - a typewritten list of names and addresses of all property
owners within a 600 foot radius of the subject property, including the applicant
and/or owner. The list shall include the San Diego County Assessor's parcel
number from the latest equalized assessment rolls.
B) 100' Occupant List - (Coastal Development Permits Only) a typewritten list of
names and addresses of all occupants within a 100 foot radius of the subject
property, including the applicant and/or owner.

C) Mailing Labels - one (1) separate set of mailing labels of the property owners
within a 600 foot radius and occupants within a 100 foot radius of the subject
property. The list must be typed in all CAPITAL LETTERS, left justified,
void of any punctuation. For any address other than a single family residence,
an apartment or suite number must be included but the Apartment, Suite and/or
Building Number must NOT appear in the street address line. DO NOT type
assessor's parcel number on labels. DO NOT provide addressed envelopes -

C) Radius Map - a map to scale, not less than 1" = 200', showing all lots entirely
and partially within 600 feet of the exterior boundaries of the subject property.
Each of these lots should be consecutively numbered and correspond with the
property owner's list. The scale of the map may be reduced to a scale acceptable
to the Planning Director if the required scale is impractical.
D) Fee - a fee (check payable to the City of Carlsbad) shall be paid for covering the
cost of mailing notices. Such fee shall equal the current postage rate times the
total number of labels. Cash and credit cards are also accepted.

The Planning Department has completed a review of the application for a two lot
minor subdivision, creating two rectangular lots located along the west side of
Adams Street at the intersection of Adams Street and Chinquapin Avenue. After
careful consideration of the circumstances surrounding this request, the Planning
Director has determined that the findings required for approving a lot split, can be
made and, therefore, recommends approval of this request based on the findings
and conditions:
Findings:
1. That the Planning Director has determined that the project belongs to a class
of projects that the State Secretary for Resources has found do not have a
significant impact on the environment, and it is therefore categorically
exempt from the requirement for the preparation of environmental
documents pursuant to Section 15315 (the subdivision of residentially zoned
property in an urbanized area into two conforming residential parcels) of the
state CEQA Guidelines. In making this determination, the Planning Director
has found that the exceptions listed in Section 15300.2 of the state CEQA
Guidelines do not apply to this project.
2. The project is consistent with the City-Wide Facilities and Improvements
Plan, the Local Facilities Management Plan for Zone 1 and all City public
facility policies and ordinances. The project includes elements or has been
conditioned to construct or provide funding to ensure that all facilities and
improvements regarding: sewer collection and treatment; water; drainage;
circulation; fire; schools; parks and other recreational facilities; libraries;
government administrative facilities; and open space, related to the project
will be installed to serve new development prior to or concurrent with need.
Specifically,
A. The project has been conditioned to provide proof from the Carlsbad
Unified School District that the project has satisfied its obligation for
school facilities.
B. Park-in-lieu fees are required by Carlsbad Municipal Code Chapter
20.44, and will be collected prior to issuance of building permit.
C. The Public Facility fee is required to be paid by Council Policy No. 17
and will be collected prior to the issuance of building permit.
3. The Planning Director has reviewed each of the exactions imposed on the
Developer contained in this resolution, and hereby finds, in this case, that
the exactions are imposed to mitigate impacts caused by or reasonably
related to the project, and the extent and the degree of the exaction is in
rough proportionality to the impact caused by the project.
Conditions:
1. If any of the following conditions fail to occur; or if they are, by their terms,
to be implemented and maintained over time, if any of such conditions fail to
be so implemented and maintained according to their terms, the City shall
have the right to revoke or modify all approvals herein granted; deny or
further condition issuance of all future building permits; deny, revoke or
further condition all certificates of occupancy issued under the authority of
approvals herein granted; institute and prosecute litigation to compel their
compliance with said conditions or seek damages for their violation. No
vested rights are gained by Developer or a successor in interest by the City's
approval of this Minor Subdivision.
2. Staff is authorized and directed to make, or require the Developer to make,
all corrections and modifications to the MS 00-17 documents, as necessary
to make them internally consistent and in conformity with the final action on
the project. Development shall occur substantially as shown on the
approved Exhibits. Any proposed development different from this approval,
shall require an amendment to this approval.
3. The Developer shall comply with all applicable provisions of federal, state,
and local laws and regulations in effect at the time of building permit
issuance.
4. If any condition for construction of any public improvements or facilities, or
the payment of any fees in-lieu thereof, imposed by this approval or imposed
by law on this Project are challenged, this approval shall be suspended as
provided in Government Code Section 66020. If any such condition is
determined to be invalid this approval shall be invalid unless the City Council
determines that the project without the condition complies with all
requirements of law.
5. The Developer/Operator shall and does hereby agree to indemnify, protect,
defend and hold harmless the City of Carlsbad, its Council members,
officers, employees, agents, and representatives, from and against any and
all liabilities, losses, damages, demands, claims and costs, including court
costs and attorney's fees incurred by the City arising, directly or indirectly,
from (a) City's approval and issuance of this Minor Subdivision, (b) City's
approval or issuance of any permit or action, whether discretionary or non-
discretionary, in connection with the use contemplated herein, and (c)
Developer/Operator's installation and operation of the facility permitted
hereby, including without limitation, any and all liabilities arising from the
emission by the facility of electromagnetic fields or other energy waves or
emissions. This obligation survives until all legal proceedings have been
concluded and continues even if the City's approval is not validated.
6. Prior to the issuance of a building permit, the Developer shall provide proof
to the Director from the School District that this project has satisfied its
obligation to provide school facilities.
7. This project shall comply with all conditions and mitigation measures which
are required as part of the Zone 1 Local Facilities Management Plan and any
amendments made to that Plan prior to the issuance of building permits,
including, but not limited to the following:
8. Building permits will not be issued for this project unless the local agency
providing water and sewer services to the project provides written
certification to the City that adequate water service and sewer facilities,
respectively, are available to the project at the time of the application for the
building permit, and that water and sewer capacity and facilities will
continue to be available until the time of occupancy. A note to this effect
shall be placed on the Final Map.
9. At issuance of building permits, or prior to the approval of a final map and/or
issuance of certificate of compliance for the conversion of existing
apartments to air-space condominiums, the Developer shall pay to the City
an inclusionary housing in-lieu fee as an individual fee on a per market rate
dwelling unit basis in the amount in effect at the time, as established by City
Council Resolution from time to time.
10. The Developer shall pay park-in-lieu fees to the City, prior to the approval of
the final map as required by Chapter 20.44 of the Carlsbad Municipal Code.
11. Developer shall pay the citywide Public Facilities Fee imposed by City
Council Policy #17, the License Tax on new construction imposed by
Carlsbad Municipal Code Section 5.09.030, and CFD #1 special tax (if
applicable), subject to any credits authorized by Carlsbad Municipal Code
Section 5.09.040. Developer shall also pay any applicable Local Facilities
Management Plan fee for Zone 1, pursuant to Chapter 21.90. All such
taxes/fees shall be paid at issuance of building permit. If the taxes/fees are
not paid, this approval will not be consistent with the General Plan and shall
become void.
12. Approval of this request shall not excuse compliance with all applicable
sections of the Zoning Ordinance and all other applicable City ordinances in
effect at time of building permit issuance, except as otherwise specifically
provided herein.
13. Addresses, approved by the Building Official, shall be placed on all new and
existing buildings so as to be plainly visible from the street or access road;
color of identification and/or addresses shall contrast to their background
color, as required by Carlsbad Municipal Code Section 18.04.320.
NOTICE
Please take NOTICE that approval of your project includes the "imposition" of fees,
dedications, reservations, or other exactions hereafter collectively referred to for
convenience as "fees/exactions."
You have 90 days from date of final approval to protest imposition of these
fees/exactions. If you protest them, you must follow the protest procedure set
forth in Government Code Section 66020(a), and file the protest and any other
required information with the City Manager for processing in accordance with
Carlsbad Municipal Code Section 3.32.030. Failure to timely follow that procedure
will bar any subsequent legal action to attack, review, set aside, void, or annul
their imposition.
You are hereby FURTHER NOTIFIED that your right to protest the specified
fees/exactions DOES NOT APPLY to water and sewer connection fees and capacity
charges, nor planning, zoning, grading or other similar application processing or
service fees in connection with this project; NOR DOES IT APPLY to any
fees/exactions of which you have previously been given a NOTICE similar to this,
or as to .Which the statute of limitations has previously otherwise expired.

PROPOSED MINOR SUBDIVISION NO. 99-17, KATHLEENS MINOR SUB
A preliminary decision has been made, pursuant to Section 20.24.120 of the City of Carlsbad Municipal
Code, to approve the tentative parcel map of the proposed minor subdivision subject to conditions that
follow in this letter.
Unless specifically stated in the condition, all of the following conditions, upon the approval of this
tentative parcel map, must be met prior to approval of a final parcel map.
Engineering Conditions:
1. Approval of MS 99-17 is granted subject to the approval of CDP 99-59. MS 99-17 is subject
to all conditions of approval contained in CDP 99-59.
2. Developer shall submit to the City Engineer, a reproducible 24" x 36", mylar copy of the tentative
map reflecting the conditions approved by the final decision making body. The reproducible shall
be submitted to the City engineer, reviewed and, if acceptable, signed by the City's project
engineer and project planner prior to submittal of the building plans, final map, improvement or
grading plans, whichever occurs first.
3. Developer shall and does hereby agree to indemnify, protect, defend and hold harmless the City of
Carlsbad, its Council members, agents, officers, and representatives, from and against any and all
liabilities, losses, damages, demands, claim and costs, including court costs and attorney's fees
incurred by the City arising, directly or indirectly, from (a) City's approval and issuance of this
tentative parcel map, (b) City's approval or issuance of any permit or action, whether discretionary
or non-discretionary, in connection with the use contemplated herein, including an action filed
within the time period specified in Government Code Section 66499.37 and (c) Developer's
installation and operation of the facility permitted hereby, including without limitation, any and all
liabilities arising from the emission by the facility of electromagnetic fields or other energy waves
or emissions.
4. Developer shall provide to the City Engineer, an acceptable means, CC&Rs or/and other recorded
document, for maintaining the private easements within the subdivision and all the private
improvements: streets, sidewalks, street lights, and storm drain facilities located therein and to
distribute the costs of such maintenance in an equitable manner among the owners of the
properties within the subdivision.
5. Developer shall cause property owner to execute and submit to the City Engineer for recordation
the City's standard form Drainage Hold Harmless Agreement regarding drainage across the
adjacent property.

6. Prior to recording the final parcel map for this project, Developer shall cause Owner to give
written consent to the City Engineer to the annexation of the area shown within the boundaries of
the subdivision into the existing City of Carlsbad Street Lighting and Landscaping District No. 1,
on a form provided by the City Engineer.
7. Developer shall install sight distance corridors at all street intersections in accordance with
Engineering Standards.
8. Note(s) to the following effect(s) shall be placed on the map as non-mapping data
A. Building permits will not be issued for development of the subject property unless the
appropriate agency determines that sewer and water facilities are available.
9. Developer shall execute and record a City standard Subdivision Improvement Agreement to install
and secure with appropriate security as provided by law, public improvements shown on the
tentative parcel map to City Standards to the satisfaction of the City Engineer. These
improvements include, but are not limited to:
a. Installing curb, gutter, and sidewalk on Adams Street and Chinquapin Avenue.
b. Installing street base and pavement on Chinquapin Avenue and Adams Street.
c. Installing a pedestrian ramp at the corner of Chinquapin Avenue and Adams Street.
d. Relocating the existing water meter for Parcel 1.
e. Installing a water meter, service line and sewer lateral for Parcel 2.
f. Installing 6" asphalt concrete curb.
g. Relocating the power pole at the street intersection and relocating the speed limit
sign on Adams Street.
h. Installing "no parking signs" on Chinquapin Avenue.
A list of the above shall be placed on an additional map sheet on the Final Map per the provisions
of Sections 66434.2 of the Subdivision Map Act. Improvements listed above shall be
constructed within 18 months of approval of the subdivision or development improvement
agreement or such other time as provided in said agreement.
Final Parcel Map Notes
10. Developer shall show on Final Parcel Map the net developable acres for each parcel.
11. This project is approved upon the expressed condition that building permits will not be issued for
the development of the subject property, unless the District Engineer has determined that adequate
water and sewer facilities are available at the time of occupancy. A note to this effect shall be
placed on the Final Map, as non-mapping data.
Water/Sewer
12. Prior to issuance of building permits, Developer shall be pay all fees, deposits, and charges for
connection to public facilities. Developer shall pay the San Diego County Water Authority
capacity charge prior to meter installation.
13. The Developer shall install sewer laterals and clean-outs at a location approved by the City
Engineer. The locations of said sewer laterals shall be reflected on public improvement plans.
14. This project is approved upon the expressed condition that building permits will not be issued for
the development of the subject property, unless the District Engineer has determined that adequate
water and sewer facilities are available at the time of occupancy. A note to this effect shall be
placed on the Final Map, as non-mapping data.
Code Reminder
The project is subject to all applicable provisions of local ordinances, including but not limited to the
following:
15. The tentative map shall expire twenty-four (24) months from the date this tentative map approval
becomes final.
The developer may request a review of the preliminary decision with the City Engineer in writing within
ten (10) days of the date of this letter. Upon such written request the City Engineer shall arrange a time
and place with the developer for such review.
The City Engineer has reviewed each of the exactions imposed on the developer contained in these
conditions of approval, and hereby finds, in this case, that the exactions are imposed to mitigate impacts
caused by or reasonably related to the project, and the extent and degree of the exaction is in rough
proportionality to the impact caused by the project.

3RD ISSUES REVIEW
Thank you for making the previous requested corrections. However, there are a few
issues that still need addressing. These issues are as follows:
1. The elevation at the end of the proposed A.C. berm on Adams Street was not
given. Please provide this elevation. If this elevation does not provide the
necessary drop in grade to carry drainage to the street as I suspect is the case,
then an alternative design will be needed. Placing a depression in the asphalt
across the neighbor's driveway in combination with an A.C. berm on each side of
the driveway is an option to consider. Even though these changes would occur
within the public right-of-way, the neighbor should be informed of these proposed
changes across his property frontage.
2. On the tentative parcel map, remove the previous improvement dimensions
fronting Chinquapin Avenue and replace with the correct proposed dimensions.
3. If you know where the driveway approach will be for Parcel 2, you may want to
add it on the plan and construct it with the rest of the proposed improvements.
Adding the driveway approach now is not a requirement, however, and is
completely optional.
4. The City Council has recently lifted the moratorium described in my previous
letters. The City Council has also adopted a new ordinance addressing
procedures and standards for "alternative design streets". Neither Adams Street
nor Chinquapin Avenue is considered an "alternative design street" fronting your
property. Therefore, this ordinance will have very little to no effect on your
project. The improvements as proposed (with the exception of the
aforementioned issues) will be required as a condition of project approval. The
project will be conditioned to require improvement plans be submitted to the City
for plan check and approval and that the applicant enter into an agreement to
secure the construction of said improvements.

COMPLETE APPLICATION & SECOND REVIEW
Thank you for applying for Land Use Permits within the City of Carlsbad. Engineering Department staff
has reviewed the tentative parcel map, application No. MS 99-17, as to its completeness for processing.
The application is complete, as submitted. Although the initial processing of the application may have
already begun, the official acceptance date of the application is the date of this letter. Staff may, in the
course of processing the application, request that you clarify, amplify, correct, or otherwise supplement the
basic information required for the application. In addition, design issues exist which must be resolved or
adequately addressed prior to staff making a determination to approve or deny the project. These issues
of concern are as follows:
ENGINEERING ISSUES:,

Please provide the following information on the site plan:
a. Add bearings of the existing and proposed boundaries of the subdivision.
b. Show existing water service and meter and sewer lateral.
c. Provide spot elevations along the proposed curb line and at the transition between the
existing street conditions and the proposed improvements. Drainage within gutter
shall fall at a minimum of one percent positive flow.
d. Specify that the transitional curbs at each end of the improvements will be
constructed of A.C at 6 inches high. It appears that the transitional curb on Adams
Street will cross the neighbor's driveway to the south. Show the location of this
driveway and how you plan to transition the curb to the driveway.
e. Indicate direction of drainage flow on the opposite side of Adams Street and
Chinquapin Avenue.
f. Add an R 26 "No Parking Anytime" with an R81A "Begin" sign within the parkway
adjacent to the curb terminus on Chinquapin Ave. Add a R 26 "No Parking Anytime"
with an R81B "End" sign within the parkway next to the beginning of curb return at the
street intersection. Parking is permitted on Adams Street.
g. Show that the garden fence will be removed within the public right-of-way.
h. Change "future curb, gutter, and sidewalk" on Chinquapin Ave. to "potential future,
curb, gutter, and sidewalk alignment".
Unless there is a good reason for positioning the non-contiguous sidewalk as shown,
reposition the sidewalk flush with the property line. Placing the sidewalk here will maximize
separation between the tree roots and sidewalk. In addition, relocation of the telco pedestal
would not be necessary.
A moratorium is currently in effect prohibiting the issuance of grading or building permits on
this property. The .moratorium is in effect until the City Council decides the necessity or
appropriateness of street improvements from El Camino Real west to the ocean between
Agua Hedionda and Buena Vista Lagoons. The City Council will also determine the necessity
or appropriateness of tree removal within the City right-of-way in the same area of the City.
The City Council has appointed two citizens committees to study the matter and report to the

City Council. The City Council's decision could possibly alter the sidewalk design from its
current design.
Attached is a redlined check print of the project for your use in making the requested revisions.

RE: ADJ 510 - WHELDON ADJUSTMENT PLAT
The Planning Department has taken another look at the Adjustment Plat. Staff
has decided to not require the applicant to process the Zone Change and Local
Coastal Program Amendment. Therefore, you are able to continue to process
the adjustment plat with staffs recommendation of approval. Staff will process
the amendments at a later date, batched with other amendments.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Coastal Development Permit, application no. CDP 99-59,
as to its completeness for processing.
The application is complete, as submitted. Although the initial processing of your
application may have already begun, the technical acceptance date is acknowledged by
the date of this communication. The City may, in the course of processing the
application, request that you clarify, amplify, correct, or otherwise, supplement the basic
information required for the application. In addition, you should also be aware that various
design issues may exist. These issues must be addressed before this application can be
scheduled for a hearing. The Planning Department will begin processing your application

ISSUES OF CONCERN
Planning:
1. Per Chapter 21.44.010 of the City's Municipal Code, please provide a two car garage
for Parcel 1. The use would be considered non-conforming without the addition of the
garage.
2. Please remove the existing garage from Parcel 2 as an accessory structure (garage) is
not allowed without a main building (dwelling unit). The "accessory structure" is
subordinate to and incidental to that of the main building which is located on the same
lot.
3. The lot split will create a non-conforming interior building setback for the existing
home on Parcel 1. The required interior side yard setback is 8.5 feet. You must receive
approval from the Planning Director for a reduced interior side yard setback per
Chapter 21.10.040(a)(2) of the City's Municipal Code (see attached). Please provide a
letter with an attached site plan requesting the reduced side yard setback.

INCOMPLETE APPLICATION & INITIAL ISSUES REVIEW
Thank you for applying for Land Use Permits within the City of Carlsbad. Engineering Department staff
has reviewed the tentative parcel map, application No. MS 99-17, as to its completeness for processing.
The application is considered incomplete, as submitted. Although the initial processing of the
application may have already begun, the technical acceptance date will be acknowledged the date that the
application is found complete. Staff may, in the course of processing the application, request that you
clarify, amplify, correct, or otherwise supplement the basic information required for the application. In
addition to the incomplete items, the project application' also has some engineering and planning issues of
concern which must be resolved or adequately addressed prior to staff.making a determination on the
project. These issues of concern follow the list of incomplete items below:
1. 8 1/2 X 11" 300 foot radius map on 8 !4 X 11" paper. .
2. Statement of agreement to waive tentative subdivision map time limits.
3. On the tentative parcel map:
a) add the tentative parcel map number (MS 99-17) in the upper right hand corner;
b) add bearings of the existing and proposed boundaries of the subdivision;
c) show setback dimensions for the required front, rear, and side yard building setbacks;
d) indicate the height of the existing fence located along the west end of the property;
e) add total building coverage on each lot;
f) show existing water service (with meter) and sewer lateral;
g) show nearest fire hydrant within 300 feet of the property. If none exists, then indicate so on
the map;
h) any existing traffic signs and/or striping;
i) show the location of the tree trunks for each orchid tree within the public right-of-way;
j) correct the ADT from 30 to 20.

1. Show proposed water service (with meter) and sewer lateral on Parcel 2 even if you do not plan to
install utilities on Parcel 2 at this time. According to street improvement plans on file with the City
(DWG 134-8), an 8" v.c.p. sewer line exists in Adams Street south of Chinquapin. Please show this
line on the map.
2. Street improvements must be installed along the project frontage. Improvements required include, but
are not necessarily limited to, curb, gutter, sidewalk, pavement, a pedestrian ramp at the street

intersection, and relocation or removal of the utility poles. Please show said proposed improvements
on the map. The existing orchid trees within the public right-of-way on Chinquapin Street shall be
preserved in their current location. It appears that installing curb and sidewalk improvements per City
standards would require that the trees be removed. Therefore, the design of the improvements will
need to be modified to preserve these trees. Potential alternative designs include, but are not limited
to, reducing the curb-to-curb street width from 40 feet to 36 feet, dedicating additional property for City
right-of-way, and/or placing the sidewalk non-contiguous with the curb. The improvement design on
Adams Street shall be per City standard.
A moratorium is currently in effect prohibiting the issuance of grading or building permits on this
property. The moratorium is in effect until the City Council decides the necessity or appropriateness
of street improvements from El Camino Real west to the ocean between Agua Hedionda and Buena
Vista Lagoons. The City Council will also determine the necessity or appropriateness of tree removal
within the City right-of-way in the same area of the City. The City Council has appointed two citizens
committees to study the matter and report to the City Council. The City Council's decision could
possibly alter the above requirements.
' Add the County Recorders document number on the note, for the existing easement at the northern
.corner of the property. Easements cannot be recorded via an adjustment plat as the note indicates.
Also, this easement should be listed on the prelimiriary:title report.

4. The existing garage on Parcel 2 must be removed.
5. A two car garage must be constructed on Parcel 1.
6. The house on Parcel 1 must meet the side yard setback requirements. The required setback is 8.5
feet.
7. The property has a split zone of RDM-Q-10000 and R-1-7500. The Planning Department is currently
reviewing this discrepancy and its implications. Once staff determines what actions may need to be
taken, you will be contacted.
Attached is a red-lined check print of the project for your use. in making the requested revisions.
Please be advised, this check print must be returned with the revised plans to facilitate
continued staff review.
