The Planning Department has completed a review of the application for a one lot/four airspace
condominium unit minor subdivision, located on the north side of Laguna Drive between Buena
Vista Circle and Kremeyer Circle in the R-3 zone. After careful consideration of the
circumstances surrounding this request, the Planning Director has determined that the findings
required for approving a minor airspace subdivision can be made and, therefore, recommends
approval of this request based on the findings and conditions:
Findings:
1. The adopted findings for SDP 03-15 and CDP 03-30 which are contained in Planning
Commission Resolutions No. 5614 and 5615 apply to this permit and are incorporated
by this reference.
2. The proposed project will not result in adverse environmental impacts, and it has been
found to be exempt from the California Environmental Quality Act per Section 15303,
which specifically exempts construction of no more than six duplex or similar multi-family
residential in urbanized areas.
3. The project is consistent with all City public facility policies and ordinances, and with Title
21 of the City's Municipal Code.
Conditions:
1. Approval is granted for MS 04-03 as shown on Exhibit "A" - "G" dated May 5, 2004,
incorporated by reference and on file in the Planning Department. Development shall
occur substantially as shown unless otherwise noted in these conditions.
2. This approval is granted subject to the approval of SDP 03-15, CDP 03-30 and CP 03-
06 and is subject to all conditions contained.in Planning Commission Resolution No.
5614 and 5615 and correspondence from the Planning Director and City Engineer for
those other approvals incorporated herein by reference.
