FORM PLANNING 20 - February 1, 1979 A STANDARD ODITIONS ( CITY OF .ARLSBAD SPECIFIC PLAN/CONDITIONAL USE PERMIT,' VARIANCE/PLArNED UNIT DEVELOPMENT! SITE DEVELOPMENT PLAN/SPECIAL USE PERMIT CONDOMINIUM PERMIT/PRECISE DEVELCN.ENT PLAN Development shall meet all requirements of the subdivision, zoning. and building codes, laws,-ordinances or regulations of the City of Carlsbad, and other governmental agencies. Some of the -more pertinent requirements and procedures of the City are listed below for your in- formation and concurrence. Please read this list carefully and feel free to ask for further information or explanation. 1) All conditions for Conditional Use Permit, Variance, Planned Unit Development and Special Use Permit shall be completed and the project commenced within 18 months from final City action, unless otherwise stated as part of the approval. There is no time limitations for Specific Plans unless required as part of the approval. . 2) Development shall substantially conform to the approved plan. 3) All public improvements shall be made in conformity with City Standards, to the satisfaction of the City Engineer, without cost to the City of Carlsbad and free of all liens and encumbrances. 4) Prior to any construction, the applicant shall submit plans to the appropriate entity providing domestic water to the proposed development, for its approval of the location, type and adequacy of water lines. 5) Prior to any construction, the applicant shall obtain approval from the City Fire Department of the location and size of fire hydrants. 6) The applicant shall install all required fire hydrants and dry-stand pipes prior to framing construction, and said fire appurtenances shall be functional prior to commencing such work. 7) Street trees, as required by the C.ity, shall be installed by the applicant at applicant's expense. Trees shall be of a type approved by the Parks Department and shall be installed to their specifications. If removal of any existing trees is required by the City, said removal shall be at the applicant's expense. It shall be the responsibility of the applicant to make all arrangements with the Parks Department concerning the require- ments of this condition. 8) A detailed grading plan which includes proposed drainage and erosion control landscaping or other measures such as desilting basins shall be approved by the City Engineer. 9) Immediately after grading, erosion control landscaping and/or other measures such as desilting basins shall be installed. This control may be the final landscaping if so approved. 10) A detailed landscape and sprinkler plan shall be submitted for Planning Director's approval for all graded slopes 5' or greater in height and any other areas required by law. 11) Prior to final building inspection clearance, all landscap- ing and irrigation systems shall be installed or adequate bonding accepted. Said landscaping shall be maintained in a manner acceptable to the Planning Director. 12) No signs or advertising of any type whatsoever shall be erected, or installed until plans thereof have been approved by the City of Carlsbad. As part of the approval process, the City may modify these conditions or add others, especially those of a more specific nature. The parcel is rectangularly shaped and has an area of 11,280 square feet. The parcel has been pre- viously graded and is devoid of any significant flora or fauna. A major portion of the site is level, with a slight drop at its eastern edge. As proposed, the project would result in an equivalent density of 7.7 du/ac, which would thus be consistent with the land use plan. In addition, the project would be consistent with all other elements of the General Plan, except the public facilities element. Public Facilities Sewer Service: The subject property is located within the Leucadia County Water District. The applicant has been placed on the district's allocation list, and has been allo- cated two sewer hookups. Schools: The project site is located within the San Dieguito Unifie6 High School District and the Encinitas Union School District. It is not clear whether or not the applicant has paid school fees. However, school fees are required due to conditions of overcrowding. Water Service: The Olivenhain Water District is responsible for servicing the subject property. Onsite and Adjacent Public Facilities: All necessary onsite and immediately adjacent public facilities will be required per the City's Public Improvement Ordinance or as conditions of approval. Gas and Electric: Gas and electric services will be provided by SDG&E. Separate gas and electric meters are required and will be provided by the developer. Other Public Facilities: The City Council has determined that they are not prepared to find that all other public facilities necessary to serve this project will be available concurrent with need. The Planning Director may, by inclusion of an appropriate condition, require that the project contribute to the costs of such facilities. Since the development would pay its appropriate share of the public facility it would require, the Planning Commission could be assured that the requirements of the public facilities element of the general plan would be satisfied. In addition, parking-in- lieu fees would be required as a condition of approval. History and Related Cases CP-5: Lefferdink (Approved on June 1, 1979) This four unit condominium conversion located in Bristol Cove was approved by the Planning Director. Conditions of approval included screening of the trash areas, covering of electric meters, provision of individual storage space, and provision of a landscaped visual barrier. CP-7: Roberts (Approved on July 2, 1979) The Planning Director conditionally approved a similar two- unit condominium project at the western terminus of Urubu Street, in La Costa. It was found that the project was consistent with the requirements of the City's condominium ordinance and with the City's land use plan. The project was conditioned that it be developed in conformance with the plan on file, that final permits not be issued unless sewer was found to be available, and that school fees be acquired at the time of building permit issuance. Major Planning Considerations 1) Does the proposed project meet all requirements and conform to the guidelines of the City's condominium regulations (Chapter 21.47)? 2) Should conditions be imposed on the proposed project in order to assure proper development? Discussion The proposed project involves a two-unit condominium development located on Levante Street in La Costa. Each unit will be two bedrooms (1280 and 1515 square feet respectively), and each with attached two-car garages. The units will be at slightly different elevations due to the topography of the site, creating a drop at the southern end of the property. The height of the units will be 26 feet. The proposed units are similar in character to other duplexes in the immediate area. The proposed project meets all Section 21.47.130 of the requirements of the City's condominium regulations. Specifically, adequate on-site parking for each unit will be provided. Also, one on-street visitor parking space will be available to serve the project. In addition adequate storage, conveniently accessible to the outdoors, will be provided for each unit. The applicant has indicated on the plans that all utilities will be separately metered. Also, each unit will have its own refuse storage area and laundry facilities. In excess of 200 square feet of open recreation area will be provided for each unit. The unit closest to Levante Street will have an 18' x 16.5' patio area along the western edge of the residence. The other unit will have a 24' x 16' deck off the rear of the residence. .3 . . The applicant has not yet submitted a detailed landscape and irrigation plan. However, based on the site plan, it appears as though the area fronting along Levante which is not paved will be planted with grass, while the rear portion of the property will be planted with fruit trees. A condition of approval requires a detailed landscape and irrigation plan. Since the project appears to meet all of the requirements, both specified and implied, of the City's condominium ordinance, a recommendation of approval is being forwarded to the Planning Director. Redcmmfldation It is recommended that the Planning Director APPROVE CP-12 based on the following findings and subject to the following conditions: Findings 1) The condominium conversion conforms to all requirements and provisions of the City's condominium regulations, Chapter 21.47, and all applicable plans. 2) The site is physically suitable for this density of development since it is properly zoned and surrounding properties are developing in a similar manner. 3) The condominium project is consistent with existing and future land use in the area, since the site is designated for medium density (4-10 du/ac) residential development. 4) At this time, the Planning Director is not prepared to find that all public facilities necessary to serve this project will be available concurrent with need.
