Approval is granted. for CP-25, CP-26, CP-27, CP-28, CP-29, CP-30 as shown in Exhibits A. B,C, D, dated October 2, 1979. All improvements shall be substantially as shown except as otherwise noted herein. 2. A reproducible mylar of the final condominium plan shall be submitted prior to approval of the final map. This plan shall contain a note indicating that separate utilities and laundry facilities have been provided. 3. School fees to mitigate conditions of overcrowding shall be paid prior to approval of the final map as per Section 21.55. 4. The guest parking space shall be clearly marked in a manner acceptable to the City Engineer. 5. A tentative parcel map must be approved before this approval takes effect. 6. The applicant shall pay a public facility fee as required in City Council Policy No. 17 prior to approval of the final map. This approval is expressly conditioned upon the appli- cant entering into a secured, agreement to secure payment of this fee within 10 days of this approval. HAGAMAN Planning Director JCH/KL/nlo STAFF REPORT DATE: November 19, 1979 TO: Jim Hagaman, Planning Director FROM: Planning Department APPLICANT: Best REQUEST: CONDOMINIUM PERMITS FOR 6 DUPLEXES IN LA COSTA BACKGROUND Location and Description of Property The six duplexes are quite similar; all are under construction. The basic difference is in the size and shape of the lots. All the lots are basically rectangular, except for CP-25 which is pie-shaped since it fronts on a cul-de-sac. All six are in the R-2 zone and are sur- rounded by R-2 property. L'he uses adjacent to the proposed condos are primarily duplexes, with a few single family homes and vacant lots. Environmental Impact Information These projects are exempt from environmtal review according to Section 19.04.090 (a)"(8) which exempts the division of existing multiple dwellings into condominiums. General Plan Information A. Land Use Element The Land Use Element designates this property as 4-10 du/acre. The densities on these projects range from a low of S du/acre to a high of 9.5 du/acre. All of these are within the allowed density. B. Public Facilities 1. Sewer service is being provided by Leucadia County Water District. 2. Gas and electric service is being provided by SDG&E. 3. Water service is being provided by: San Marcos County Water District: CP-28, CP-29 Carlsbad Municipal Water District: CP-25, CP-26, CP-27, CP-30 4. School facilities are provided by San Marcos Unified School District. School fees will be paid if the condo permit is approved. 5. On-Site and Adjacent Public Improvements. All necessary on-site and adjacent public improvements can be required as per the City's public improvement ordinance, or as conditions of approval. I . .. 6. Other Public Facilities ATI pii5TTTciities necessary to serve this project will not be available concurrent with need. The Planning Commission may, by inclusion of an appropriate condition, require that the project contribute to the costs of such facilities according to City Council Policy No. 17. Since the development would pay its appropriate share of the public facility it would require, the Planning Commission could be assured that the requirements of the Public Facilities Element of the General Plan would be satisfied. C. Other General Plan Elements These projects are consistent will all other elements of the City's current General Plan. DISCUSSION All of the requirements of Section 21.47 have been met. The development standards have been met and the design criteria fulfilled. The.guest parking space has been provided on street for 5 of the projects. CP-25 is on a cul-de-sac and has therefore provided the space on-site between the two garages. None of the units are occupied. Storage area has been provided. Laundry facilities and utility meters are provided separately for each unit. Refuse pick-up will be individual. The recreation area includes a patio (10'X10 1 ) and a balcony (6 1 X18") for each unit; providing a total of 268 square feet per unit. RECOMMENDATION Staff recommends approval of CP-25,CP-26, CP-27, CP-28, CP-29 and CP-30 based on the following findings and subject to the following conditions. FINDINGS 1. These projects are in conformance with the General Plan since the densities are within the allowed density of 4-10 du/acre. 2. The proposed condominiums are consistent with all requirements of Title 21 since all condominium requirements have been fulfilled. 3. A tentative parcel map has been filed as required in Title 20. 4. The projects are consistent with the Environmental Protection Ordinance since the conversion of existing multiple family residential units to condominiums is exempt from environmental' review as per Section 19.04.090 (a) (8). 5. This project is consistent with all Public Facilities Policies and Ordinances because: . . 1. Gas, electric and water service have been provided through separate meters. .2. School fees will be required prior to final map approval. 3. Sewer service from Leucadia County Water District is available to serve all units. 4. All on-site and adjacent public facilities have been provided or 'will be required as conditions on the tentative parcel map. 5. At this time all other public facilities necessary to serve the project will not be available concurrent with need. By inclusion of an appropriate condition, the applicant will be required to contribute to the cost of such facilities. Since the development will pay its proportionate share of the public facilities which it will require, the requirements of the public facilities element of the General Plan have been satisfied.
