Development shall meet all requirements of the subdivision, zoning
and building.codes, laws, ordinances or regulations of the City of
Carlsbad, and other governmental agencies. Some of the more pertinent
requirements and procedures of the City are listed below for your in-
formation and concurrence. Please read this list carefully and feel
free to ask for further information orexplanation.
l) All conditions for Conditional Use Permit', Variance, Planned
Unit Development and Special Use Permit shall be completed and
the project commenced within 18 months from final City action,
unless otherwise stated as part of the approval. There is no
time limitations for Specific Plans unless required as part
• of the approval.
2) Development shall substantially conform to the approved plan.
3) All public improvements shall be made in conformity with City
• Standards, to the satisfaction of the City Engineer, without
cost to the City of Carlsbad and free of all liens and
encumbrances.
4) Prior to any construction, the applicant shall submit plans
to the appropriate entity providing domestic water to the
proposed development, for its approval of the location, type
and adequacy of water lines.
5) Prior to any construction, the applicant shall obtain approval
from the City Fire Department of the location and size of
fire hydrants.
6) The applicant shall install all required fire hydrants and
dry-stand pipes prior to framing construction, and said fire
appurtenances shall be functional prior to commencing such work.
-7) Street trees, as required by the City, shall be installed by the
- applicant at applicant's expense. Trees shall be of a type
approved by the Parks Department and shall be installed to their
specifications. If removal of any existing trees is required
by the City, said removal shall be at the applicant's expense.
It shall be the responsibility of the applicant to make all
arrangements with the Parks Department concerning the require-
ments of this condition.
k8) A detailed grading plan which includes proposed drainage
and erosion control landscaping or other measures such as
• desilting basins shall be approved by the City Engineer.
,-9) Immediately after grading, erosion control landscaping and/or
other measures such as desilting basins shall be installed.
This control may be the final landscaping if so approved.
jO) A detailed landscape and sprinkler pla .n shall be submitted
for Planning Director's approval for all graded slopes 5'
or greater in height and any other areas required by law.
1l) Prior to final building inspectioh clearance, all landscap-
ing and -irrigation systems shall be installed or adequate
bonding accepted. Said landscaping shall be maintained in
a manner acceptable to the Planni.ng Director. -
V12) No signs or advertising of any type whatsoever shall be erected
or installed until plans thereof have been approved, by the City
of Carlsbad. -
As part of the approval process, the City may modify these conditions or
add others, especially those of a more specific nature. The applicant
will be notified of these modifications or additions by Resolution.

300 Foot Radius Map * (Not needed for Site Development Plan,

exterior boundaries of the subject property. Each of these lots
• hall be consecutively numbered and correspond with the property
owner's list. The scale of the map may be reduced to a scale
acceptable to the Planning Director. if the required scale is
mpractical.
• Property Ownerts List - (Not needed for Site Development Plan,
Special Use Permit and Minor Condominium Permit). Two copies
of a typewritten list on self-adhesive (Avery) mailing labels of
the name and address of all property owners within 300' as noted
on the property owners map.. This list must be accurate and taken
from the latest equalized assessment roll on file in the Office
of the Assessor of San Diego County, 1600 Pacific Highway,
Room 103, Ph. # 236-3771.
Conversion to Condominiums: In addition to the above property
'owners list, the application shall include a list (prepared as
above) of names and addresses of all tenants of the units to
be converted to condominiums.

10) A written statement by the City Engineer that he finds there
is adequate sewer capacity available for the proposed use at
the site or that he finds that the proposed use and site can
be adequately served by alternative City approved onsite sewer
system.. Applicant, please note, this determination must be
done prior to submitting application and it may require
preparation on your part to provide sufficient evidence to the
City Engineer. It is suggested you make early contact with.
the Engineering Department for such determination.
11) For residential projects within Vista, San Marcos, Encinitas or
San Dieguito School Districts, the applicant shall indicate
whether be prefers to dedicate land for school facilities, to
pay a fee in lieu thereof, or do a combination of these. If
the applicant prefers to dedicate land, he shall suggest the
specific land.
For residential projects within the Carlsbad Unified School
District, the applicant shall submit written confirmation that
school facilities will be available and .serve the project at
time of need.
B. Drafting of Plan:
1) Sheets to be 24"x36" with 1" border (standard "D" size).
2) Scale to Indicate: 1" = 10' is generally sufficient; however,
the scale is to be appropriate for sheet size.

standards listed in Section 21.45.120 shall be included.

PROCEDURES
(Minor Condominium Permit - Four or less units)
1) Application to Planning Director: In an effort to aid the applicant,
the Planning Department requests that it be given an opportunity
to evaluate and discuss the application in its various stages of
development prior to submittal. It is more effective if applicant
meets directly with staff; however, written or telephone commuxiication
.is acceptable. It is the responsibility of the applicant to make
the initial contact for such meeting.
2) Submittal: Application will be accepted only if the application,
plans and other pertinent materials are included.
3) A2plication Review: After accepting the application staff will
review to ascertain if further information is necessary. Staff will
attempt to conclude this review within one week, but in no case shall
the review period be longer than 30 days from receipt of application.
4) Notice: Upon completion of the application review, the applicant
will be informed by letter if further information is required if any.
5) Staff Review: Staff prepares a report for the Planning Director
for approval, denial or approval with conditions.
6) Appeals: Action by the Planning Director may be appealed to the
City Council, provided such appeal is filed within ten (10) days
after the Planning Director's action.
7) Final Decision: The City will notify the applicant and property
owner of the final decision.

The required plans may be submitted as one plan or as two or
more plans. If the landscape and irrigation plans are submitted
as a separate plan (one or two pages), only two copies are
required. Please see the Condo Ordinance (Section 21.47) for
specific requirements. The plans must show the following.

Dear Mr. Leonard:
We have reviewed your application for two, tvO-uflit oondo
minima develOpments on adjacent parcels located on the east
side of Badajoz Place in La Costa.—It is the Planning
Director's determination that, based on the attached conditions,
the projects are consistent with the City's Condominium
Regulations (Chapter 21.47) and all other City PôliOiés
Ordinances. Further, both projects have received decltiofls
of negative environmental impact as per the City's Environmental
Protectioii Ordinance.
FindiDjs
1) The projects are both consistent with the CityS eneral
Plan Land Use designation and with all other elements
of the general plan.
2) The projects will not result in any significant envirOn-
mental impacts since a declaration of negative envirOn
mental impact has been issued for both developments.
3) Adequate public facilities necessary to servethe projects
will be provided as required by the City Engineer in
conjunction with the approval of the parcel maps required
for both projects.
4) The projects, as conditioned, are consistent with the
design criteria and development stafldards of Chapter
21.47 of the City's Zone Code.
Conditions
1) Approval is granted for CP-34 as shown on Exhibits
2, B-i, B-2, C-i, C-2, and D dated 11/5/79 to CP-34
and CP-35 as shown on Exhibits A, B-1,B-2, C-i, C-2,
and D dated 11/5/79 to CP-35, all on file in the
Planning Department and incorporated by reference.
Development shall occur substantially as shown on this
exhibit unless otherwise noted in these conditions.
Since both projects involve almost identical developments
on adjacent lots, the following conditions apply to both
projects:
2) The balconies on all elevations shall be enlarged to
a minimum dimension of at least six feet in all
directions.
3) The applicant shall provide the required 480 cubic
feet of storage space either in the garage or in a
combination of places directly accessible to the
outdoors.
4) The applicant shall submit a reproducible copy of the
approved condominium site plan to the Planning Director
for his signature
Said final plan shall incorporate the chaflges required
herein.
5) The applicant shall comply with all required conditions
of approval placed on the approved parcel map.

EAST SIDE OF BADAJOZ PLACE, LA COSTA

I. BACKGROUND
Location and Description of Property
The subject property is a 19,016 square foot pie shaped lot,
located on the east side of Badajoz Place, La Costa. Approximately
half of the site is relatively level, with the remaining
property dropping sharply to the east. The applicant has
indicated that only very minor land form alteration is
proposed in order to prepare the site for development.

General Plan Information
A. Land Use: The Land Use Element of the City's General
iidèsignates the subject property for medium density
(4-10 du/ac) residential development. The proposed 2
unit project would result in a net density of 4.6
du/ac.
B. Public Facilities
Sewer Service: The applicant has been allocated
a7-e-quate sewer by the Leucadia County Water District to
serve the proposed project.

Schools: The project is located within the San Dieguito
and Encinitas School Districts. Since those districts
are currently experiencing conditions of overcrowding,
school fees would be assessed. In addition, the applicant
is required to provide a letter of school availability
from the San Dieguito Unified High School District.
Gas and Electric Service: Gas and electric service
will be provided by San Diego Gas and Electric.
Water Service: Water service will be provided by the
IivenhainWáter District.
On-site and Adjacent Public Improvements: All necessary
on-site and adjacent public improvements can be required
as per the City's Public Improvement Ordinance or as
conditions of approval.
Other Public Facilities: All other public facilities
necessary to serve this project will not be available
concurrent with need. The Planning Director may, by
inclusion of an appropriate condition, require that the
project contribute to the costs of such facilities
according to City Council Policy No. 17. Since the
development would pay for its appropriate share of the
public facilities it would require, the Planning Director
could be assured that the requirements of the Public
Facilities Element of the General Plan would be satisfied.
C. Other Elements of the General Plan
The project is consistent with all other elements of the
City's current General Plan.
Environmental Impact Assessment: A declaration of negative
ài€1 impact ha bin ñiade for the project based on
the justification that:
1) The proposed projects will involve minimal land form
alteration.
2) No significant flora, fauna or any unique environmental
resources would be significantly affected since only
low-lying native vegetation has been noted on the site.
3) The project is consistent with other similarly scaled
developments which have been established without any
apparent adverse environmental impacts.

History and Related Cases
CP-12, (Fitzgerald)
On October 4, 1979, the Planning Director approved a two-
unit condominium development on the south side of Levante
Street, several blocks east of the current proposal.
Conditions of approval for this project included the payment
of school and park-in-lieu fees and public improvements as
required by the Parks and Recreation Director.
CP25-30, (Best/Gottleib)
On November 20, 1979, the Planning Director approved six
two-unit condominium conversion proposals in the La Costa
area. Conditions of approval applied to all six projects
and included the payment of school and public facilities
fees and the delineation of guest parking to the satisfaction
of the City Engineer.
Major Planning Considerations
1) Has adequate open recreation area been provided?
2) Are the storage areas adequate in area and conveniently
accessible to the outdoors?
Discussion
The project includes the construction of a two-unit condominium
development on Badajoz Place in La Costa. Each unit will be
two-stories (approximately 24 feet), with three bedrooms and
attached two-car garages. As previously mentioned, much of
the site will be left undisturbed, with the development and
improvements limited to the relatively level portions of the
site.
With regard to the development standards of Chapter 21.47
(Condominiums), the applicant appears to have met some of
these standards, while falling short of others. More
specifically, the applicant has provided adequate on-site
parking for both the residents and guests of the project.
However, with regard to the open recreation area, the project
falls short of the required 200 square feet per unit. In
order to meet this requirement, the applicant must enlarge
the rear decks by widening them a foot.
Another place where the applicant falls short of the condo-
minium regulations is in the provison of storage space. The
regulations require 480 cubic feet of storage space per
unit. While the applicant has provided the required 480
cubic feet of storage, much of this ar ea is not accessible

to the outdoors. Therefore, staff has required, by condition,
that the storage space be redesigned.
Laundry facilities will be individually provided for each
unit. In addition, utility meters will be separately metered
and trash pickup will separate for each unit.
