STATEMENT OF AGREEMENT
TENTATIVE SUBDIVISION MAP
CITY OF CARLSBAD
The Subdivision Map Act sets a fifty (50) day time restriction on
Planning Commission processing of Tentative Maps. This time limit
can only be extended by the mutual concurrance of the applicant and
the City. By accepting applications for tentative maps concurrently
with other applications, in an attempt to speed up the overall pro-
cess, the fifty (50) day time limit is often exceeded. If you wish
to have your application processed concurrently, this agreement must
be signed by the applicant or his agent. If you choose not to sign
the statement, the City will not accept your application for the
tentative map until all prior necessary entitlements have been pro-
cessed and approved.
In either circumstance, the City will process your request within
the earliest time period, however, in no circumstance shall this
delay be greater than 150 days from the day of submittal of appli-
cation.
The undersigned understands that the processing time required by
the City may exceed fifty (50) days, therefore the undersigned
agrees to extend the fifty (50) day processing limitation and fully
concurs with any extensions of time up to one hundred and -Fifty
(150) days that may be required to properly review all of my appli-
cations in order that the environmental impact report and any other
prerequisites to this application may be processed concurrently-

TENTATIVE SUBDIVISION MAP
Subdivision and development shall meet all requirements of the
subdivision, zoning, building codes, and General Plan and other
laws, ordinances or regulations of the City of Carlsbad, and other
governmental agencies. Some of the more pertinent requirements
and procedures of the City are listed below for your information
and concurrence. Please read this list carefully and feel free
to ask for further, information or explanation.
Final Map shall be completed within 18 months from the
date of final City C irtion on the Tentative
Subdivision Map. -Two extensions of one year each may
be approved by City Council upon staff review of the
original decision.

Tentative Subdivision Map. If otherwise, the Final Map
will b.c rejected and new Tentative Subdivision Map
- hearings will be required for the revised plan.
/3. All public improvements shall be made in conformity with the
Subdivision Ordinance and other City Standards, to the satis-
faction of the City Engineer, without cost to the City of
Carlsbad and free of all liens and encumbrances.
4. Prior to any construction, the applicant shall submit plans
to the appropriate entity providing domestic water to the
proposed development, for its approval of the location,
type and adequacy of water lines.
5. Prior to any construction, the applicant shall obtain approval
from the City Fire Department of the location and size of
fire hydrants.
6.. The applicant shall install all required fire hydrants and
dry-stand pipes prior to framing construction, and said
fire appurtenances shall be functional prior to commencing
such work.
7. Street trees, as required by the City, shall be installed
by the applicant at his expense. Trees shall be of a
type approved by the Parks Department and shall be installed
to their specifications. If removal of any existing trees
is required by the City, said removal shall be at the
applicant's expense. It shall be the responsibility of
the applicant to make all arrangements with the Parks
Department concerning the requirements of this condition.
A detailed grading plan which includes proposed drainage
and erosion control landscaping and for other measures
such as desilting basins shall be approved by the City
Engineer prior to Final Map.
->/9. Immediately after grading, erosion control landscaping
and/or other measures such as desilting basins shall
be installed. This control may be the final landscaping,
if so approved.
A detailed landscape and sprinkler plan shall be Sub-
mitted for Planning Director's approval for all graded
slopes 5' or greater in height and any other areas re-
quired by the City.
11. Prior to final building inspection clearance, all land-
scaping shall be installed or adequate bonding accepted.
Said landscaping shall be maintained in a manner accept-
able to the Planning Director.

Development shall meet all requirements of the subdivision, zoning,
and building codes, laws, ordinances or regulations of the City of
Carlsbad, and other governmental agencies. Some of the more pertinent

of a typewritten list on self-adhesive (Avery) mailing labels of
the name and address of all property owners within 300' as noted
on the property owners map. This list must be accurate and taken
from the latest equalized assessment roll on file in the Office
of the Assessor of San Diego County, 1600 Pacific Highway, Room
103, 236-3771.
9) Disclosure Statement.
*10) A written statement by the City Engineer that he finds there is
adequate sewer capacity available for the proposed use at the
site or that he finds that the proposed use and site can be
adequately served by alternative City approved onsite sewer
system. Applicant, please note, this determination must be done
prior to submitting application and it may require preparation
on your part: to provide sufficient evidence to the City Engineer.

play areas, etc.
Landscape and Irrigation Plan

NOTICE IS HEREBY GIVEN that the Planning Commission of
the City of Carlsbad will hold a public hearing at the City
Council Chambers, 1200 Elm Avenue, Carlsbad, California, at
7:00 P.M. on Wednesday, June 13, 1979, to consider approval

SUBJECT: FINDINGS RE CP-6 O'GRADY
Except in unusual circumstances it is the practice of my
office in preparing documents approving a development to
incorporate the findings made by the Planning Commission.
In order to support an approval of the subject project,
it is necessary to depart from the Planning Commission's
findings in this case in two respects.
In paragraph 3(b) of Planning Commission Resolution No. 1527,
recommending approval of this project, the Planning Commission
expressly finds that sewer service is not available for the
project. Municipal Code Section 21.49.020(1) provides that
this project may not be approved unless the Council finds
that sewer service is available and will continue to remain
available for the project. We have advised the City Manager
in connection with his determination to process the develop-
ment in the San Marcos area based on a sewer plant to be
constructed in the future, that the appropriate way to
proceed is by way of amendment to Chapter 21.49. Such an
amendment would provide that the City Council could approve
a project if they were reasonably satisfied that sewer would
be available concurrent with need. Assuming the City Council
is not prepared to delay approval of this project until that
amendment could become effective, it is necessary to depart
from the Planning Commission findings and conclude that
sewer is available. Assuming further that the City Council
is satisfied that they have been presented with facts which
allow them to make that finding, the resolution as prepared
reflects that sewer is available.
Paragraph 3(e) of Planning Commission Resolution No. 1527
provides that the Planning Commission finds that all other
public facilities are available. The City Council in
directing the addition of a condition requiring that the
developer of this project pay a public facilities fee has
in effect found that public facilities are not available and
can not be made available unless the development contributes
to their construction. The resolution as prepared contains
a condition requiring this development to pay such fee as
the Council may establish. It also contains a finding which

would support the imposition of that fee. Again, your body
should be satisfied that you have been presented with sufficient
facts to allow you to make that finding.
The City Council at your July 3, 1979 meeting directed the
City Manager to prepare a report on the City's ability to
collect a public facilities fee as a condition of all future
discretionary developmental approvals. By separate memorandum
my office has advised the City Manager on the applicable law
as an aid in his preparation of that report. In general, we
advised that there was some question as to the City's ability
to collect the fee as a condition of development. Assuming
the policy judgment has been made to attempt to do it, it
was our advice that we use an approach similar to the one
we used for school fees, which is based upon the general plan
public facilities element and an implementing Council policy.
The resolution as prepared assumes that the Manager and the
City Council will elect to use that approach.

PERTAINING TO SEWER AVAILABILITY
Attached are the findings and conditions regarding sewer avail-
ability that the City Attorney requests we include in all tenta-
tive map staff reports. As I understand it, these conditions
and findings were drawn up some time ago. It seems to me, they
do not properly reflect the situation for tract applications
within the Leucadia County Water District. As you know, we are
processing tentative maps in the Leucadia Sewer District if the
applicant is on their allocation list. This situation would seem
to differ from earlier projects that were "caught in the mill"
when the sewer moratorium was instituted, and the City needed
protection against vesting an interest in development.
Would you please present the question before the Cj..ty Attorney
and inform me of his response.
Also, in a related matter, I would like to have the City Attorey
give me the proper wording of. findings •an - ins pertaining
to sewer availability for the O'Grady c se (CP-6 As you recall,

The proposed proposed tentative tract map is consistent with applicable
City Public Facilities Policies and Ordinances because:
a. The Planning Commission finds that sewer service is not
available for this development as of the date of this
approval. However, sewer service may be available in the
future. The Planning Commission will by inclusion of an
appropriate condition to this Tentative Subdivision Map
approval, insure that the final map will not be approved unless
the City Council finds that sewer service is available to
serve the project. In addition, the Planning Commission
will add a condition that a note be placed on the final map
providing that building permit may not be issued for lots
in the subdivision unless the City Engineer determines that
sewer service is available. Since the final map cannot be

the condominium permit (CP-6).
We would like clarification on the matter of park-in-lieu fees
as they apply to this project. Can the fees be required under

Gentlemen:
Responding to your request of April 27, 1979, the Carlsbad Municipal
Water District has the following comments and recommendations regard-
ing the proposed subdivision project:
1. The proposed project is a part of an original subdivision known
as La Costa Village of which Lots 1 and 2 have been completely
built out. Water service is available to Lot 3 from the exterior
street as well as the pipeline extension from Lot 2. Public
water service would be made available to the entire subdivision
subject to all of the regulations and requirements of the Water
District.
2. More specifically, this condominium-type development having
single family dwelling units will be required to adhere to the
District's special condominium water service regulations. Essen-
tially the development will be 'required to construct a complete
public water system to handle the domestic, landscaping and fire
flow requirements of the entire unit. In addition, each condo-
minium unit must have a separate water service and meter.
3. The District will require the granting of all necessary rights-
of-way and at the time of actual construction of dwelling units
all applicable connection fees and charges will be payable.
4. In summary, the District has no objections to the approval of
the subject proposed subdivision, with the understanding that
all of the recommendations and requirements of our District
are followed without exception.

Location and Description of Property
The subject property is a 2.85 acre parcel located adjacent to
the west of Zamora Way, between Alicante Road and Almaden Lane.
The pad has been previously graded and is at a height of approxi-
mately 10-20 feet above Almaden Lane. The site is currently
covered by native vegetation, with no significant flora or fauna
present. 3000 cubic yards of balanced cut and fill is proposed
in order to prepare the site for development.

An Environmental Impact Assessment has been prepared and a Negative
Declaration issued for the proposal based on the following justifi-
cation:

2) The project would constitute appropriate urban infilling
since the area has been committed to similar development.
General Plan Information
The purpose of the RD-M Zone is to enable development to utilize
the residential densities specified in the City's General Plan.
The Land Use Plan designates the subject property for medium-high
(RMH; 10-20 du/ac) residential development. As proposed, the pro-
ject would result in a gross density of 8.07 du/ac. Therefore, the
project is consistent with the General Plan.
Public Facilities
Schools
The project site is located within the San Marcos Unified School
District. A letter from the school district states that although
this development will have a negative impact, the impact will be
mitigated by school fees pai d by the developer.
Sewer
The applicant is on the Leucadia County Water District's sewer
allocation list, and has been allocated 36 sewer hookups. There-
fore, the total project can be processed at this time. However, a
sewer permit for all of the units must be presented before building
permits can be issued.
Water
The Carlsbad Municipal Water District has no objection to the
project, provided that the developer constructs a complete public
water system which handles the domestic, landscaping and fire flow
requirements of the entire development.
History and Related Cases
Condominium Ordinance, City Council Resolution No. 9516, approved
September 19, 1978.
The City Council has adopted a Condominium Development and Conver-
sion Ordinance (Chapter 21.47) which establishes development
standards for condominium projects. Specifically, this ordinance
addresses the following developmental standards: setbacks, parking,
refuse areas, storage space, laundry facilities, open recreation
areas, landscaping, signs, utilities and private streets. Further,
the ordinance states that "The overall plan shall be comprehensive,

embracing land, buildings, landscaping and their interrelation-
ships...."
Tentative Map No. 6621, approved by the County Board of Super-
visors approximately April, 1970.
The subject parcel was processed as a condominium lot in the first
quarter of 1970. As a result, the applicant need only apply for
a condominium permit, since tentative and final maps have previously
been recorded.
Major Planning Considerations
1) Does the proposed project conform to the requirements of
Chapter 21.47 (Condominiums)?
2) Does the proposed circulation system adequately serve
project? That is, is adequate access provided to all
units, and is there sufficient room for public safety
equipment?
3) Are adequate refuse areas and visitor parking provided?
4) Is the condominium plan comprehensive in its design, embrac-
ing land, buildings, landscaping and their interrelationships?
DISCUSSION
The proposed project involves the construction of 23 detached air
space condominium units on a 2.85 acre site. All units will be
two story, with three bedrooms and an attached two-car garage.
Although the site has been previously graded, additional grading
will be necessary to provide appropriate pad and street elevations.
The maximum height of any dwelling will be 25.5 feet above pad level.
Finish floor elevations will range from 48.5 feet along the south-
eastern property line, to 59 feet at the northwest corner of the
site.
A major consideration of the proposed project relates to the fact
that all of the units will be detached. While this may be desir-
able in terms of selling the units, it tends to reduce the amount
of common (and sometimes usable) open recreation areas. Also, the
establishment of detached condominium units eliminates some of the
more stringent requirements of the PUD ordinance (e.g. Recreational
vehicle storage, open space per unit, parking standards).
However, in spite of the fact that all units will be detached, the
project has been well designed with a density below the maximum
allowed by the General Plan. In addition, the applicant will be
providing a sufficient amount of area devoted to recreational
uses. Specifically, a pool, jacuzzi and patio area will be pro-
vided in a centralized location (approximately 7200 sq. ft.),

along with small patios and'deck5 at the rear of each unit. Also,
a green belt is proposed through the center of the development.
.The applicant has therefore met the open recreation area require-
ment (in this case, 9,200 sq. ft.) specified by the Condominium
Ordinance. In order to prevent the reduction of the common open
areas, a condition regulating fencing around each unit has been
included;'
The applicant has submitted a detailed landscape and irrigation
plan. Except for minor modifications in plant size and species
selection, this plan will adequately buffer the development and
enhance its aesthetics. Therefore, the overall plan is comprehen-
sive, embracing land, buildings, landscaping and their relation-
ships.
The Condominium Ordinance requires two parking spaces for each
dwelling and, in this case, nine visitor parking spaces. The ordin-
ance does make an allowance for on-street parking. Specifically,
the Ordinance states that "credit may be given for. on-street park-
ing for parking spaces available on the public street directly in
front and on the same side of the street as the project" (emphasis 7
added). Originally, the applicant was proposing the provision of
all visitor parking on-street. Staff found this situation undesir-
able, and the applicant has since modified the site plan to the one
currently before the Commission. This plan provides five visitor
spaces on-site, with the remaining four visitor spaces on-street.
Since the four on-street spaces will be adequately served by path-
ways into the development, staff has found the proposed parking
layout acceptable. In addition, each unit will have an attached
two-car garage.
With regard to refuse disposal, the applicant is proposing a refuse
area along the northern edge of the development with access off of
Alicante Road. Staff is somewhat concerned about the capacity of
these containers, and their location relative to the southernmost
units. The applicant has indicated that he does not want sanita-
tion trucks driving on-site, and th yg the location off Alicante
Road is proposed. However, in response to staff's concerns, condi-
tions are being recommended which require trash compactors for each
unit and a homeowners' association agreement which stipulates that
the refuse will be collected from each unit and transported to the
refuse area on weekly basis by maintenance workers.
Storage space and laundry facilities will be provided in each unit,
meeting the requirements of the condominium ordinance. In addition,
water, gas and electric utilities will be separately metered.
RECOMMENDATION
Staff recommends that the Planning Commission forward a recommenda-
tion of APPROVAL of CP-6 to the City Council based on the following

findings and subject to the following conditions.
Findings
1) The proposed project is consistent with the General Plan
since it is within the density range allowable under the
current General Plan land use designation.
2) The site is physically suitable for the type and density of
the development since the site is adequate in size and shape
to accommodate residential development at the proposed
density.
3) The project is consistent with all City public facility policies
and ordinances since:
a) The applicant is on the Leucadia County Water District's
sewer allocation list, and sufficient sewer hookups have
been reserved for the project.
b) The Planning Commission finds that sewer service is not
available for this development as of the date of this
approval. However, sewer service may be available in
the future. The Planning Commission has, by inclusion of
an appropriate condition to this condominium permit,
insured that the Planning Director will not approve the
final condominium plan unless the City Engineer finds
that sewer service is available to serve the project.
In addition, the Planning Commission has added a condi-
tion that a note shall be placed on the final condominium
plan that building permits may not be issued for the
condominium project unless the City Engineer determines
that sewer service is available. Since the final condo-
minium plan cannot be approved unless sewer service is
available, and building cannot occur within the project
unless sewer service remains available, the Planning
Commission is satisfied that the requirements of the
public facilities element of the General Plan have been
met insofar as they apply to this condominium permit
approval.
c) School fees to mitigate conditions of overcrowding are
required at the time of building permits pursuant to
Chapter 21.55 of the Carlsbad Municipal Code.
d) Water service will be provided by the Carlsbad Municipal
Water District, and the applicant is required to comply
with their rules and regulations.
e) All other public facilities are available or will be
required as conditions of approval.
4) The design of the development and required improvements will

not cause any substantial environmental impacts and a Declara-
tion of Negative Environmental Impact has been made since:
a) The property has been previously disturbed by grading
activities, and no significant flora or fauna exists on
the site.
b) The project would constitute appropriate urban infilling
since the area has been committed to similar development.
5) The proposed condominium project meets the criteria of the
Condominium Ordinance since:
a) Storage space, laundry facilities, open recreation areas,
parking facilities, refuse areas, separate utilities
and other requirements of the Condominium Ordinance have
been met or will be made conditions of approval.
b) The condominiums meet the design criteria of the Condo-
minium Ordinance since the overall plan is comprehensive,
embracing land, buildings, landscaping and their relation-
ships.
Conditions
1) Approval is granted for the portion of land described in the
application, CP-6, and all attachments thereto; and develop-
ment shall be performed substantially as shown on CP-6, Exhibit
A, dated 6/5/79, Exhibit B, dated 5/31/79, and Exhibits C, D,
and E dated 4/24/79, on file in the Planning Department office,
except for modifications required herein.
2) The applicant shall comply with all rules and regulations of
the Carlsbad Municipal Watr District regarding water service
to the condominium project. Should extensions to the exist-
ing public water system be deemed appropriate by the Carlsbad
Municipal Water District, the developer will be required to
provide the complete system.
In addition, the applicant shall submit to the City Engineer
a letter from the Carlsbad Municipal Water District which
approves in concept the proposed water system prior to final
condominium plan approval.
3) The applicant shall prepare a reproducible copy of the final
condominium site plan incorporating all requirements of the
condominium permit approval, and shall be subject to the
approval of the Planning Director.
4) The applicant will provide school fees to mitigate conditions
of overcrowding as part of building permit applications.
These fees shall be based on the fee schedule in effect at the
time of building permit.
5) This condominium permit is approved upon the express condition

that the final condominium plan shall not be approved by
the Planning Director unless the City Engineer finds as of
the time of such approval that sewer service is available to
serve the subdivision.
6) This condominium permit is approved upon the express condition
that building or grading permits will not be issued for develop-
ment of the subject property unless the City Engineer deter-
mines that such sewer facilities are available at the time of
application for such permits and will continue to be available
until time of occupancy. If the City Engineer determines that
sewer facilities are not available, building permits will not
be issued until arrangements satisfactory to the City Council
can be made to guarantee that all necessary sewer facilities
will be available prior to occupancy. This condition shall
be noted on the final condominium plan.
7) The applicant shall submit to the City Engineer a letter from
the Leucadia County Water District which approves in concept
the proposed sewer system layout prior to final condominium
plan approval.
8) A looped water system and fire hydrants shall be provided by
the applicant subject to the approval of the Fire Marshal.
9) In order to provide for fire protection during the construc-
tion period, the applicant shall maintain passable vehicular
access to all buildings, and adequare fire hydrants with
required fire flows shall be installed as recommended by the
Fire Department.
10) All private driveways shall be kept clear of parked vehicles
at all times, and shall have posted "No Parking/Fire Access
Lane."
11) The proposed landscape plan shall be modified as follows:
at least 50% of the Eucalyptus Cladocalyx trees shall be
installed 15 gallon size or greater; the Hedera Helix ground-
cover shall be replaced with a more drought tolerant plant
species.
12) Street trees of a variety approved by the Parks and Recrea-
tion Department shall be installed to City specifications at
40 foot intervals along all public street frontages.
13) All condominium units shall be equipped with automatic
garage door openers and trash compactors.
14) Prior to occupancy of any units, the applicant shall establish
covenants, conditions and restrictions for the condominium
development which prohibits the erection or construction of
any fence or barrier within the development between and/or
around the individual dwelling units, except that a fence may
be allowed which encloses only the patio area adjacent to each
unit. Said CC and Rs shall be subject to the review and approval
of the Planning Director.

15) Prior to occupancy of any units, the applicant shall establish
a homeowners' agreement which stipulates that refuse will be
collected from each unit and transported to the refuse area
on at least a weekly basis by maintenance workers of the

16) The developer shall install a 5' sidewalk contiguous with the
existing curb along the Alicante Road and Zamora Way frontage
to the satisfaction of the City Engineer prior to the occupancy
of any units.

WHEREAS, a verified application for certain property, to
wit:
Lot 3-of La Costa Village in the County of
San Diego, State of California, according
to map thereof, number 6621 filed in the
office of the County Recorder of San Diego
County, April 14, 1970
has been filed with the City of Carlsbad and referred to the
Planning Commission; and
WHEREAS, said verified application constituted a request as
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 13th day of
June, 1979, hold a duly noticed public hearing as prescribed by
law to consider said request; and
WHEREAS, an Environmental Impact Assessment has been pre-

WHEREAS, on June 27, 1979 the Carlsbad City Planning
Commission adopted Resolution No. 1527 recommending to the

the requirements of the City of Carlsbad Environmental
Protection Ordinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That the findings of the Planning Commission constitute
the findings of the City Council except for findings 3(b) and
3(e), which are disapproved and replaced by the following:
Based on a letter from the responsible sewer agency, the
City Council accepts the agency's representations that
sewer service is available for this project and so finds. Since

1 the conditions of approval provide that the final condominium
2 plan cannot be approved unless sewer service is available and
3 building can not occur within the project unless sewer service
4 is available and sewer connection-permits are issued, the
5 City Council is satisfied that the requirements of the Public
61 Facilities Element of the General Plan have been met as they
71 apply to this condominium permit approval for sewer service.
At this time the City Council is not prepared to find that
all other public facilities necessary to serve this project
will be available concurrent with need. The City Council .has,
by inclusion of an appropriate condition to this condominium
permit, required that the project contribute to the costs of
such facilities. Since the development will pay its proportionate
share of the public facilities which it will require, the City
Council is satisfied that the requirements of the Public Facilities
Element of the General Plan have been satisfied.
C. That said Condominium Permit, together with the
provisions for its design and improvement, and subject to the
Iconditions of this resolution, is consistent with all applicable
general and specific plans of the City of Carlsbad.
D. That Condominium Permit (cP-6) is hereby approved
I subject to all applicable requirements of the Carlsbad Municipal
!Code and to the satisfaction of the following conditions:
1) Approval is granted for the .portion of land described in the
application, CP-6, and all attachments thereto; and develop-
ment shall be performed substantially as shown on CP-6, Exhibil
A, dated 6/5/79, Exhibit B, dated 5/31/79, and Exhibits C, D,
and E dated 4/24/79, on file in the Planning Department office
except for modifications, required herein.
2) The applicant shall comply with all rules and regulations of
the Carlsbad Municipal Water District regarding water service

to the condominium project. Should extensions to the exist-
ing public water system be deemed appropriate by the Carlsbad
Municipal Water District, the developer will be required to
provide the complete system.
In addition, the applicant shall submit to the City Engineer
a letter from the Carlsbad Municipal Water District which
approves in concept the proposed water sstem prior to final
condominium plan approval.
3) The applicant shall prepare a reproducible copy of the final
condominium site plan incorporating all requirements of the
condominium permit approval, and shall be subject to the
approval of the Planning Director.
4) The applicant will provide school fees to mitigate conditions
of overcrowding as part of building permit applications.
These fees shall be based on the fee schedule in effect at the
time of building permit.
5) This condominium permit is approved upon the express condition
that the final condominium plan shall not be approved by
the Planning Director unless the City Engineer finds as of
the time of such approval that sewer service is available to
serve the subdivision.
6) This condominium permit is approved upon the express condition
that building or grading permits will not be issued for develo
ment of the subject property unless the City Engineer deter-
mines that such sewer facilities are available at the time of
application for such permits and will continue to be available
until time of occupancy and that sewer connection permits
have been issued by the responsible sewer agency. If the City
Engineer determines that sewer facilities are not available,
or connection permits are not issued, building permits will
not be issued.
7) The applicant shall submit to the City Engineer a letter from
the Leucadia County Water District which approves in concept
the proposed sewer system layout prior to final condominium
plan approval.
8) A looped water system and fire hydrants shall be provided by
the applicant subject to the approval of the Fire Marshal.
9) In order to provide for fire protection 'during the construc-
tion period, the applicant shall maintain passable vehicular
access to all buildings, and adequare fire hydrants with
required fire flows shall be installed as recommended by the
Fire Department.

10) All private driveways shall be kept clear of parked vehicles

at all times, and shall have posted "No Parking/Fire Access
Lane."

• 1. 11) The proposed landscape plan shall be modified as follows:
at least 50% of the Eucalyptus Cladocalyx trees shall be
2 installed 15 gallon size or greater; the Hedera Helix ground-
cover shall be replaced with a more drought tolerant plant
3 species.
4 12) Street trees of a variety approved by the Parks and Recrea-
tion Department shall be installed to City specifications at
5 40 foot intervals along all public street frontages.
6 13) All condominium units shall be equipped with automatic
garage door openers and trash compactors.

14) Prior to occupancy of any units, the applicant shall establish

covenants, conditions and restrictions for the condominium
development which prohibits the erection or construction of
9
any fence or barrier within the development between and/or
around the individual dwelling units, except that a fence may

be allowed which encloses only the patio area adjacent to each
unit. Said CC and Rs shall be subject to the review and appro
11 of the Planning Director.
12 15) Prior to occupancy of any units, the applicant shall establish
a homeowners agreement which stipulates that refuse will be

collected from each unit and transported to the refuse area
on at least a weekly basis by maintenance workers of the
14 development.
15 16) The developer shall install a 5 sidewalk contiguous with the
existing curb along the Alicante Road and Zamora Way frontage
16
to the satisfaction of the City Engineer prior to the occupanc
of any units.

17) The developer shall install standard city street lights along
18
all public street frontages to the satisfaction of the City
Engineer prior to occupancy of any units.

18) The developer must receive the approval of the City Engineer
20 for the improvement plans, enter into the appropriate improve-
ment agreement, post the required security for the constructior
21
of public improvements and pay the appurtenant fees prior to
the issuance of building permits.

19) The developer- shall receive the. approval of the City Engineer
23
for a site grading plan prior to any construction being per-
formed within the project site.

20) The developer must obtain the necessary documents for the
25
abandonment of the on-site drainage easement just off Zamora
Way from the County of San Diego prior to issuance of building
26 permits. •
27 21) The electrici driveway gates shall be set back 15' from
the property line.

be approved by the Fire Marshal prior to installation.
23) Prior th issuance of building permits, the developer
shall pay a public facilities fee as it may be adopted
by the City Council. Prior to approval of the final
condominium plan arrangements satisfactory to the City
Manager shall be made guaranteeing such payment.

Statement of 'the Matter
The City Council at your July 3, 1979 meeting directed
the City Attorney to prepare documents approving the
subject condominium project. The Council also directed
inclusion of a condition imposing a public facilities
fee. In order to comply with the Council's direction
it was necessary to depart from the Planning Commission's
recommendation in regards to findings and a memorandum
discussing the changes is attached.
The City Council should satisfy itself that the attached
resolution accurately reflects your judgment in this case.

STATEMENT OF THE MATTER:
The site is approximately 3 acres located on Zamora Way
between Alicante Road and Almaden Lane. The site was previously
approved for a condominium by the County Board of Supervisors
prior to annexation. Therefore the only requirement with the
City at this point is a condominium permit.
The site layout is similar to a Planned Unit Development in
that the units are detached and interconnected with common
walkways and open areas. There is a centralized common recreation
area and the parking is designed within close proximity to the
units.
The development in some regards will resemble single family
development, however, the access to the units will clearly be
from a private drive not resembling a private street. Therefore
even though the site will be relatively dense for detached
development, it is well designed, will be of .high quality and
a suitable development for this high density residential area.

Both the Planning staff and Planning Commission have recommended
approval of CP-6. If the City Council concurs you should direct
