Gillen, Williamson and Schmid 15101 Red Hill Avenue Tustin, CA 92680 MS 93-08, COVE PARK STIPE CONDO CONVERSION Thank you for your application for a tentative parcel map, Minor Subdivision. The application is incomplete and unsuitable for further review. The items needed to make the application complete are as follows: 1. A signed and notarized Agreement to Pay a Public Facilities Fee was not submitted. Two agreements and instructions for completing the agreement are enclosed and these items are also enclosed in the letters to the listed owners. Please note that all owners as shown on a complete title report must sign the agreement. The tentative map shows the ownership to be in two parts: I. "Unit" 1 held by McCain, address 1324 Laurelwood Court Dallas, OR 97338 II. "Unit" 2 held by Mullin, address 4549 Cove Dr. Carlsbad, CA 92008 The tax assessor's roll shows McCain's address to be 6498 Crampton Drive, No., Keizer, Oregon. Please advise us which address is correct. Due to the physical separation of the ownership parties the City will accept two separate agreements, signed and notarized by each separate owner. 2. Postage for the two required notice mailings was not submitted. Our policy is to accept a 500 dollar deposit or the actual postage required. We find that after eliminating duplicates that there are 85 property owners to notify and two notices each are required. At 29 cents each the actual postage required is .29 cents times two times 85 or $49.30 required postage. Your application cannot be found complete until this amount, $49.30, is received. This title report is required in order to process the Agreement to Pay a Public Facilities Fee. 4. The tentative map must show the following data: • the density in dwelling units per acre • the existing General Plan designation (RH) • iot area and unit/lot area for each unit/lot ' '• total building coverage (separately for each unit/lot) • traffic generation, 16 ADT (eight per dwelling unit) • show which of the three gas and water meters and the two electric meters serve which unit. See also issue 4, below. Alternatively you may submit letters from S.D.& G. and the Carlsbad Municipal Water District stating that satisfactory services for two units has been arranged or can be arranged. • correct unit/lot division lines and dimensions (see issue 1, below) • vegetation (plans show an area marked "Landscape", but no details). In addition to the incomplete items, above, there are some issues with the project as presented. These issues must be resolved before any approval the tentative map and condominium permit can be recommended. These issues are as follows: 1. The structure on site appears to have a three-car garage. The condominium plan and tentative map shows a residential building line passing straight through the middle garage, and die condominium plan shows only two garage spaces, each 16 feet wide by 21.75 feet in length. Minimum two-car garage in«fid^ dimensions are 20 feet by 20 feet. See also 2, below. 2. The applicant must provide sufficient information on die plans to demonstrate diat die proposed conversion satisfies die requirements of die Planned Development regulations, Chapter 21.45 of die Carlsbad Municipal Code. The current submittal does not demonstrate such compliance, for example: H:\IJBRAaY\ENO\WPDATA\DA VIS\MS93-»CV.STP James F. Gillen MS 93-08, Cove Park Stipe Condo Conversion July 27, 1993 Page: 3 Section 21.45.090 (c) of the Carlsbad Municipal Code requires all dwelling units to have two covered parking spaces. A total four is required for two units. As per 1, above there appears to be three spaces and insufficient room for four. See the enclosed Chapter 21.45 of the Code for all the requirements. 3. The R-W Zone allows a maximum structure height of 35 feet. The plans submitted do not include elevations,therefore it is not clear whether the existing structure is within this limit. 4. Prior to approving a final map, or a Certificate of Compliance in lieu of a final map, the applicant must provide evidence that the structure to be converted meets present City building regulations per Section 21.45.100 (a) of the Carlsbad Municipal Code. A compliance inspection by the City of Carlsbad Building Department will need to be made and the structure and two dwelling units will need to be found in compliance with all building regulations for two condominium units. Since there are three gas and water meters and three single-car garage doors, the proposal to subdivide into two condominium units may not, at this time, comply with all regulations.
