You have received a correspondence from Van Lynch of the Planning Department which quotes Title 20 of the Subdivision Ordinance. You have requested additional information regarding City Codes and the Subdivision Map Act which relate to the property in question. It is the intention of this correspondence to answer those questions. A building permit was applied and received for a duplex in 1989. A duplex is considered a multiple family dwelling. The subdivision of this dwelling is allowed by the Zoning Ordinance and the General Plan. Both the Subdivision Map Act and the Carlsbad Municipal Code require the application for a Tentative Minor Subdivision to subdivide into condominium units. In addition to the Tentative Minor Subdivision, the Carlsbad Municipal Code requires application for and approval of a condominium permit. In the City of Carlsbad this process is the only method to subdivide a duplex into two attached single family condominium units. By Code, the City is allowed to approve a Certificate of Compliance in lieu of a Parcel Map for conversions of duplexes into condominiums when all the improvements have been completed and all the conditions of approval of the Tentative Minor Subdivision and the Condominium Permit have been met. I have attached a few pages from the Carlsbad Municipal Code and the Subdivision Map Act. The highlighted areas refer to the requirements to subdivide property in the City of Carlsbad. I have also included a copy of the letters sent to the owners regarding the violation and the Notice of Intent to File a Notice of Violation.
