Our records indicate the unit was built as a duplex in 1 989 and has not been subdivided into a condominium. A subdivision is defined in both the Subdivision Map Act and the Carlsbad Municipal Code (Section 20.04.020(1 9)) as any means of division which creates units. This definition includes condominium units. The Carlsbad Municipal Code requires the approval of a Tentative Minor Subdivision, Condominium Permit and compliance with all the conditions of approval associated with those permits to legally subdivide a duplex into condominium units. Our records do not indicate these were accomplished. The Carlsbad Municipal Code requires a Notice of Intention to Record a Notice of Violation be recorded against the property. A copy of the notice is included. The original has been sent to the County for recordation. This letter serves as notice of our intention. The Code allows you sixty (60) days to submit any evidence you may have that a legal subdivision has been done. A time has been reserved on Tuesday, February 9, 1 993 for you to come in to meet with me. The meeting will be from 1 1 :00 am to 12:00 fun at the Community Development Office at 2075 Las Palmas. If you are unable to come in at that time, please contact me to arrange another time more convenient for you. Our office hours are Monday through Thursday - 7:30 am until 5:30 pm and Friday - 8:00 am to 5:00 pm. During this time you may present evidence the subdivision is legal or review your options. Your name was taken off the Assessors Tax Rolls as the legal owner of the property. Our tax rolls are updated every three to six months. If you are no longer the owner, please let me know. Please contact me to coordinate the submittal of evidence the subdivision is legal or to obtain the applications necessary to legalize the subdivision at (61 9) 438-1 1 61 extension 4427. The City Engineer has determined that the real property described below may have been illegally divided in violation of Carlsbad Municipal Code Title 20. Prior to the recordation of a notice of violation, the property owner listed below will be given an opportunity to present evidence to the City Engineer why such notice should not be filed. If after reviewing the evidence the City Engineer determines there is no violation, a release of this notice of intention to record a notice of violation shall be recorded. If, however, the City Engineer determines that the property has in fact been illegally divided, or within sixty days of receipt of a copy of this notice the property owner fails to inform the City Engineer of his/her objection to the recording of the notice of violation, the City Engineer will record a notice of violation against the property described below.
