4549 COVE DR. - ILLEGAL SUBDIVISION
The original owner, Steve Stipe, of 4549 Cove Dr. would like to come to the City to
discuss the options he has and what it will take to legally subdivide his property. He will
be bringing the other original owner with him and his title officer from Orange Coast Title
Company.
He would like to explain what he did to subdivide the property in 1989 when he built the
complex. He plans to bring a set of plans with him. The type of information he will be
looking for is:
fees required
conditions of approval to expect
length of time to obtain the approval
what other information will be required to complete the processing
(i.e. are the plans he has sufficient)
I have scheduled the meeting for Tuesday morning, February 9, 1993 at 9 am in the
Engineering Conference Room 1.
I plan to bring relative sections of the Subdivision Map Act and Title 20 of the Code.
Please bring any information you have which could assist Mr. Stipe in understanding all
that will be required to legally subdivide his land.
He has also requested the fees we charge be prorated to the time he originally
constructed the project. He feels he is justified to make this request because he tired to
subdivide the property in 1989 so he could sell off each half of the duplex. He was told
by the Title Officer from Orange Coast Title Company that the title officer could subdivide
the property by a procedure known as "Twinhome". I told him I was unaware of this
procedure and in Carlsbad we have the Subdivision Map Act and our Municipal Code
which dictate how property is subdivided. In my opinion, he made a good faith attempt
to subdivide the property in 1989, he just spoke with the wrong people.
A number of people involved in the project have requested to attend the meeting. Both
previous owners plan to attend. The buyer for one of the units plans to attend with his
Real Estate Agent. One of the other owners may attend. If he doesn't make it he will
send a representative.
I have attached a list of the fees from 1988, 1989 and fees we charge now. I do not
know what fees there would be for Affordable Housing. Please review the list of fees and
let me know if there are any I missed. I have checked the building permit file and the
property did pay the 3.5% PFF fee at the time of issuance.
