Box 5201 San Clemente, CA SUBJECT: MS 93-08/CP 93-05 - COVE CONDOS "STIPE CONVERSION" Dear Mr. Stipe: The Planning Department has completed a review of your application for a two-unit condominium conversion on units located at 4549 Cove Drive. After careful consideration of the request, the Planning Director has determined that the findings required for granting a Condominium Permit CANNOT be made and, therefore, DENIES this request based on the following findings and conditions. Findings: « 1. The granting of this permit WILL NOT BE consistent with this Code. The Code (Section 21.45.072) directs that a Planned Development Permit (Condominium Permit) may be approved only if all of the facts in Section 21.45.072 exist. All of the facts do NOT exist, as discussed in Finding No. 2 below. 2. The proposed Condominium Permit (Planned Development) DOES NOT meet all of the minimum development standards set forth in Section 21.45.090. Specifically, the project does not provide resident or guest parking as required. Chapter 21.45.090 requires provision of two covered parking spaces for residents of each unit and one guest parking space for use by both units for a total of four covered spaces and one open space. Appeals must be submitted in writing to the Planning Commission at 2075 Las Palmas Drive in Carlsbad, along with a payment of $110.00. The filing of such appeal within such time limit shall stay the effective date of the order of the Land Use Planning Manager until such time as a final decision on the appeal is reached.
