HomeMy WebLinkAboutCP 94-01A; Poinsettia Shores PA B-1; Condo Permit (CP) (10)City of Carlsbad Planning Department September 11,1997 Stan Weiler Hofman Planning and Associates 2386 Faraday Avenue, Suite 120 Carlsbad CA 92008 SUBJECT: CT 94-08 - "B-1" FINAL MAP PROCESSING AND CONDO PERMIT AMENDMENT Staff has reviewed your request to consider the ability to process a condominium permit amendment for B-1 while the existing tentative map approval proceeds on to final map and improvement plan approval. It is staffs understanding that the project applicants wish to process a substantial conformance request with the Engineering and Planning Departments for the existing tentative map approval of CT 94-08. Therefore, the comments made below about processing final map approvals while a condo permit amendment is underway are only valid if the Engineering and Planning Departments approve the upcoming substantial conformance request. Be advised that the substantial conformance request will be rejected by staff if it fails to meet the standard substantial conformance review, including but not limited to: phasing will not be allowed; finalized grading must meet Engineering's substantial conformance criteria/review, and; the full scope of required improvements must be delivered. CT 94-08 can go on to receive final map approval while a condominium permit amendment is in process subject to the following provisions: 1. The upcoming substantial conformance request for the existing, approved tentative map is approved by the Engineering and Planning Departments. 2. No phasing is proposed to the satisfaction of the Engineering Department. 3. No changes to streets, grading or other infrastructure elements except those changes approved as part of a substantial conformance request. 4. While the proposed amendment to B-1 initially appears to be minor in nature, this review effort will not function to make the determination that the proposed B-1 condo permit amendment is major or minor in nature. Nevertheless, the ability to process final map approval while a condo permit amendment is in process per the criteria outlined in this correspondence is not dependent on the condominium permit amendment being major or minor in nature. 5. B-1 was approved as, and shall remain, a single planning area unless a major amendment is submitted to alter planning area boundaries. Therefore, only one Homeowners Association will be allowed with only one set of CC&Rs to be associated with B-1's final map. Also, there will not be a doubling of allowances for B-1 with respect to model homes/complexes. The final map process must treat Area B-1 as the single phase planning area that it is (one set of improvement plans, landscape plans, one HOA, one set of CC&Rs, one actualization of the model home allowance). This should clearly outline the manner in which the City would be able to proceed with the final map approval of CT 94-08 while an amendment to CP 94-01 (CP 94-01 (A)) is concurrently under amendment.
