Dear Anne,
The "DRAFT" C.C.& R's which were submitted to you last week needs to be
corrected. The City required verbiage is our C.C.& R's as follows:
Section 2.01. No Unit shall tandem park in front of the existing garages
within the 10 foot front yard setback except on those particular grounds
purposely set forth and designated as guest parking.
Yet after much thought, I believe what the City really meant was verbiage as
follows:
Section 2.01. "Public Sidewalk Clearance" No Unit shall tandem park in
front of the existing garages so as to allow a vehicle to overhang or
penetrate any portion of the public sidewalks.
Simply, not even a motorcycle could park hi the driveway without being In breach
of the C.C.& R's. Moreover, such would be overly restrictive beyond other properties use
of a driveway. I don't believe this was the City's intent. The verbiage merely needs to
be corrected to accommodate the City's actual purpose. With your permission, I'll rectify
paragraph 2.01 in accordance with the above. Please let me know if this is acceptable.
