MS 99-01: MONTEREY CONDOMINIUM & MINOR SUBDIVISION
SECOND SUBMITTAL & ISSUES REVIEW
Engineering Department staff has reviewed the tentative parcel map, application No. MS 99-01, as to its
completeness for processing. The application is still incomplete, as submitted. I have not received the
two items listed below as of today. Please forward the "incomplete items" listed below to my attention so
that I may deem your application complete. Also, the items listed under "Engineering Issues" need to be
resolved before the tentative parcel map can be approved.
1. School District letter indicating that school facilities will be available to the project.
2. Statement of Agreement to waive tentative subdivision map time limits since project's minor
subdivision is being processed concurrent with a condominium permit and environmental review. The
agreement is enclosed for your convenience.

1. Both driveway approaches have been relocated to close to the neighbor's properties. City
Standards require a three foot distance from the transition between curb and driveway approach
to an extension of the side property line.
2. The sub-terrain drain located in the rear yard of the most western unit does not connect between
the brow ditch and drain inlet according to the parcel map. The map shows water flowing out of
the drain inlet and flowing across the surface of the lawn to the brow ditch. A sub-terrain drain
should connect the inlet to the brow ditch.
3. Based on the quantities of soil to be graded and the remedial grading proposed on the rear yard
slope, a grading permit will be required for this project. More specifically, a grading permit is
required per the following sections of the Carlsbad Municipal Code:
Section 15.16.060(6)(b) - Fill material placed on an existing slope steeper than 5 units
horizontal to one vertical requires a grading permit. The proposed fill will be placed on an
existing 1:1.5 slope.

Section 15.16.060(6Xe) - The amount of soil being moved exceeds 100 cubic yards of
material per each 8,000 square feet of disturbed lot area. The 300 cys of fill plus 260 cys of
remedial equates to a total grading of 560 cys. On a .44 acre lot, the amount of grading
proposed equates to 240 cys of soil per 8,000 square feet. However, this section of the code
does state that excavation and fill material within the building envelope shall not apply to the
volume of soil. Therefore, if any of the 300 cys of cut is to be removed from the building
envelope, then remove such quantities from the plan.
Also, show locations of cut and fill. If all 260 cys of remedial fill is to be placed on the rear slope
then where will the remaining 40 cys of fill be placed.
4. Please add the following note on the tentative parcel map: "This is a tentative parcel map of a
condominium project as defined in Section 1350 of the Civil Code of the State of California. The
project contains a maximum of 4 units".
Attached is a red-lined check print of the project for your use in making the requested revisions.
Please be advised, this check print must be returned with the revised plans to facilitate
continued staff review. In addition, please resubmit the red-lined check print that I gave you
for the first plan check so that I may verify that all of my issues have been resolved.
