(Gradient) for the proposed Carlsbad Promenade residential development at the northwest comer of Aviara Parkway and Poinsettia Lane in Carlsbad, Califomia (Figure 1). The purpose of this ESAU was to identify recognized environmental conditions on the subject site (Site). This report, in conjunction with the previous Phase I ESA, conforms with the ASTM Standard Practice for Environmental Site Assessments: Phase 1 Environmental Process E 1527-00. The scope of work for this assessment included: records review, site reconnaissance, and report. Information from the following previous reports were used during the preparation of this updated report: • Gradient Engineers, Inc., 1998, Phase I Environmental Assessment Report for the Proposed Poinsettia Village Located at the Northeast Comer of Aviara Parkway and Poinsettia Lane, Carlsbad, Califomia, dated January 5, 1998, Project No. 973019-001. • Gradient Engineers, Inc., 1999, Phase 1 Environmental Assessment for the One Acre Northem Parcel of the Proposed Carlsbad Promenade, Aviara Parkway, Carlsbad, Califomia, dated November 22, 1999, ProjectNo. 973019-002. Based upon the information obtained during the course of the above assessments. Gradient presented the following opinion: • Gradient performed a Phase I ESA for the subject site in conformance with the scope and limitations of ASTM Practice E 1527-97. This assessment did indicate evidence of recognized environmental conditions of concem in connection with the property (i.e., cultural debris and chemical fertilizer/pesticides use). On December 22, 1997 four (4) surface soil samples were collected to assess for the possible presence of organochloride pesticides. The laboratory test results indicated that one organochloride pesticide, toxaphene, is present in the four (4) samples. The concentrations range from 197 to 1230 mg/kg. The concentration of toxaphene in three of the soil samples (samples Sl-0.0', S3-0.0' and S4-0.0') is above the USEPA Region XI health risk based Preliminary Remediation Goal (PRG) recommended for residential property use (400 mg/kg) and below that for commercial property use (1,700 mg/kg) (USEPA, 1996). The vertical extent of toxaphene was not assessed as part of this investigation. However, based on our experience with other sites in the area of the subject site, toxaphene is generally limited to the near surface soils (i.e., 1 to 3 feet below grade). Based upon the findings of these Phase I ESAs, Gradient recommended: • Remove and properly dispose of any trash and debris on site prior to grading. • Because the proposed site use is for commercial development, mitigation of the toxaphene impacted soil was not required. • That observations be made during any future site development for areas of possible contamination such as, but not limited to, the presence of underground facilities, buried debris, staining soils, waste drums, tanks, or odorous soils. Should such materials be encountered, further investigation and analysis may be necessary at that time. On Febmary 5 and 6, 2001, Gradient staff visited the Site to assess current site utilization, to identify possible environmental conditions of concem. The Site consists of approximately 15 acres. The southem portion ofthe Site is agriculturally developed and the northem portion of the Site is undeveloped. There are GRADIENT ENGINEERS I E- 1 973019-003 no stmctures on Site. Ground water wells were not observed on the Site. Evidence of sumps, dmms, underground storage tanks, pump tanks, clarifiers or septic tanks/leach fields was not observed on the Site. Several areas of undocumented trash disposal were observed throughout central area of the Site and in the canyon area located east (adjacent) to the Site. Observed trash disposal included agricultural debris (plastic) as well as cultural debris (glass, wood, carpet, etc.). Wetlands were not observed on the Site. Evidence of recognized environmental conditions were noted based on the site reconnaissance (i.e., possible use of chemical fertilizers, and/or pesticides). Adjoining properties are primarily agricultural and residential developments. A search of selected govemment databases was conducted by Gradient using Environmental Data Resources, Inc. (EDR) environmental database report system. Review of the EDR report indicates that no database listings (finds) were reported fbr the Site. Review of aerial photographs from 1953, 1960, 1967, 1978, 1989, and 1993, and interviews with persons knowledgeable about the Site indicated that recognized environmental conditions of concem were identified for the Site, i.e. agricultural usage in the southem portion of the Site. On January 9, 2001, Gradient collected 15 surface soil samples (0.5 feet below grade) and 15 near-surface samples (between 1.5 and 3.0 feet below grade) at 15 locations to ascertain the presence of possible organochlorine pesticides, including toxaphene. The laboratory test results indicated that two organochlorine pesticides, 4,4'-DDE and 4,4'-DDT, were present in surface and near-surface soils at the site at concentrations above their respective laboratory detection limits. Toxaphene was not detected in any of the 30 soil samples. The 4,4'-DDE concentrations ranged from 0.0092 to 0.23 mg/kg, and the 4,4'-DDT concentrations ranged from 0.010 to 0.17 mg/kg. The concentration of 4,4'-DDE and 4,4'- DDT in the soil samples are below the USEPA Region XI health risk based Preliminary Remediation Goals (PRGs) recommended for residential property use (1.7 mg/kg for both compounds) (USEPA, 2000). It appears the toxaphene identified in the near surface soils in December 1997 no longer represent an environmental condition of concem at the Site. Based upon the information obtained during the course of this ESAU, Gradient presents the following conclusions: • Gradient performed a Phase I ESA update for the Site in conformance with the scope and limitations of ASTM Practice E 1527-00. This assessment did not indicate evidence of recognized environmental conditions of concem in connection with the property. Based upon the findings of this Updated ESA, Gradient recommends: • Remove and properly dispose ofany trash and debris on site prior to grading. • No additional environmental assessment is warranted at this time. • That observations be made during any future site development for areas of possible contamination such as, but not limited to, the presence of underground facilities, buried debris, staining soils, waste dmms, tanks, or odorous soils. Should such materials be encountered, fiirther investigation and analysis may be necessary at that time. _ GRADIENT ENGINEERS INC. E-2 ^G 973019-003 1.0 INTRODUCTION 1.1 Authorization In accordance with Carlsbad Promenade Partners, LLC, authorization. Gradient completed a Phase I Environmental Site Assessment Update (ESAU) of the subject site (Site). This work was conducted in accordance with Gradient's proposal dated December 13, 2000 and with Carlsbad Promenade Partners, LLC authorization dated January 3, 2001. 1.2 Purpose The purpose of this ESAU was to identify recognized environmental conditions on the subject site (Site). This report, in conjunction with the previous Phase I ESA, conforms with the ASTM Standard Practice for Environmental Site Assessments: Phase I Environmental Process E 1527-00. The scope of work for this assessment included: records review, site reconnaissance, and report. Information from the following previous reports were used during the preparation of this updated report: • Gradient Engineers, Inc., 1998, Phase I Environmental Assessment Report for the Proposed Poinsettia Village Located at the Northeast Comer of Aviara Parkway and Poinsettia Lane, Carlsbad, CaHfomia, dated Januaiy 5, 1998, Project No. 973019-001. • Gradient Engineers, Inc., 1999, Phase I Environmental Assessment for the One Acre Northem Parcel of the Proposed Carlsbad Promenade, Aviara Parkway, Carlsbad, Califomia, dated November22,1999, ProjectNo. 973019-002. 1.3 Scope of Work The scope of work was performed in accordance with Gradient's proposal and included the following tasks: • Site Reconnaissance; • Records Review; and • Report. This ESAU did not include air, or water sampling, or investigations for radon, asbestos, or lead- based paint. 1.4 Limitations and Exceptions The findings and professional opinions presented in this report are based on the information made available to Gradient (in most cases from previous reports and from public records) and could change if additional information becomes available. In performing our professional services. Gradient applied present engineering and scientific judgment and used a level of effort consistent with the standard of practice measured on the date of this report and in the vicinity of the project GRADIENT ENGINEERS INC. 973019-003 site for projects of similar scope. Gradient makes no warranties, either express or implied, conceming the completeness of the data made available to us for this study. Gradient specifically withholds certification of any type conceming the absence of contamination at the site. 1.5 Limiting Conditions and Methodology The methodology used during this assessment conforms to current standard of care in the performance of Phase I ESAs in southem Califomia. Due to the lack of available resources, historical records were not reviewed prior to 1953. The list of references used for this study is included as Appendix A. Site photographs are presented in Appendix B. The research of selected govemment databases was performed by Gradient using Environmental Data Resources, Inc. (EDR) environmental database program. A copy of the EDR report is included as Appendix C. Govemment records documenting the history of hazardous materials in this area are generally reliable for only the past ten years or less; therefore, undocumented sites or events may exist, and early records ofthe Site may not have been made available by the agencies for review. The Site is located in Section 22, Township 12 South, Range 4 West of the San Bemardino Baseline and Meridian. 2.2 Site Reconnaissance On Febmary 5 and 6, 2001, Gradient staff visited the Site to access current site utilization and to identify recognized environmental conditions of concern. Prior to the site visit. Gradient staff reviewed the previous Phase 1 ESA reports (Gradient, 1998 and 1999). Photographs of the Site are presented in Appendix B and their view directions are noted on Figure 2. Items noted during the site reconnaissance are also noted on Figure 2. The Site currently consists of approximately 15-acres of land. The Site has been agriculturally developed in the southem area of the Site and is undeveloped in the northem area of the Site. 2.2.1 Hazardous Substances Present Use Hazardous substances were not observed on the subject property. No evidence of manufacturing involving the use or storage of hazardous materials was observed at the Site. Past Use No evidence of any previous uses involving the use or storage of hazardous materials was observed at the Site. 2.2.2 Storage Tanks Evidence of underground storage tanks, USTs, (such as vent lines, fill or overfill ports) and aboveground storage tanks (ASTs) were not observed on the Site. 2.2.3 Polychlorinated Biphenyls (PCBs) Evidence of PCBs was not observed. Hir GRADIENT ENGINEERS INC. 973019-003 2.2.4 Waste Disposal Trash is noted at several areas on Site. The locations of the trash are noted on Figure 2. 2.2.5 Wetlands. Floodplain. Coa.stal Zone Wetlands were not observed on the Site. The Site is not located within a coastal zone. 2.2.6 Dmms/Other Chemical Containers Dmms and chemical containers were not observed at the Site. 2.2.7 Dumping Evidence of waste dumping was not observed onsite. 2.2.8 Pits. Ponds. Lagoons. Sepfic Systems. Cistems. Sumps. Drains Pits, ponds, lagoons, cistems, sumps, and drains were not observed at the Site. 2.2.9 Pesficide Use The southem portion ofthe Site is used for agriculturally use. 2.2.10 Staining and Discolored Soils Staining and discolored soils were not observed onsite. 2.2.11 Stressed Vegetation Stressed vegetation was not observed onsite. 2.2.12 Unusual Odors Unusual odors were not detected onsite. "iiir GRADIENT ENGINEERS INC. 973019-003 2.2.13 Onsite Wells Water, oil, and gas production wells were not observed or reported onsite. 2.2.14 Asbestos An asbestos survey was not performed as part of this investigation. There are no stmctures on Site. 2.2.15 Lead-Based Paint A lead-based paint survey was not performed as part of this investigation. There are no stmctures on Site. 2.2.16 Other Concems No environmental concems were observed or reported during the site reconnaissance. 2.3 Current Uses of Adjoining Properties Surrounding properties are summarized in the following table. Properties Land Use Adjacent properties to the north: > Undeveloped and vacant > Residential Adjacent properties to the east: > SDG&E easement > Agricultural Adjacent properties to the south: > Residential Adjacent properties to the west: > Residential -6- Hfr GRADIENT ENGINEERS INC. 973019-003 3.0 RECORDS REVIEW 3.1 Standard Environmental Record Sources A search of selected govemment databases was conducted by Gradient using Environmental Data Resources, Inc. (EDR) environmental database report system. Details of the database search along with descriptions of each database researched are provided in the EDR report (Appendix C). 3.1.1 Site The Site was not identified in the EDR database report. 3.1.2 Offsite Federal NPL List: The EPA's National Priorities List (NPL) of uncontrolled or abandoned hazardous waste sites was reviewed for sites within a 1-mile radius of the Site. To appear on the NPL, sites must have met or surpassed a predetermined hazard ranking system score, been chosen as a State's top priority site, pose a significant health or environmental threat, or be a site where the EPA has determined that remedial action is more cost-effective than removal action. The database search identified im NPL sites within a mile of the Site. Federal CERCLIS List: The EPA's Comprehensive Environmental Response, Compensation, and Liability Information System (CERCLIS) listings were reviewed to determine if sites within '/2-mile of the Site are listed for investigation. The CERCLIS database identifies hazardous waste sites that require investigation and possible remedial action to mitigate potential negative impacts on human health or the environment. The database search identified no State equivalent CERCLIS sites within '/2-miIe of the Site. Federal RCRA List: The current Resource Conservation Recovery Act (RCRA) Notifiers List was reviewed to determine if RCRA treatment, storage, or disposal sites (TSDs) are located within '/2-mile of the Site. The database search did not identify any RCRA TSD facilities within '/2-mile of the Site. The RCRA Corrective Action Sites List is maintained for sites which are undergoing "a corrective action." A corrective action order is issued when there has been a release of hazardous waste constituents into the environment from a RCRA facility. The database search did not idenfify any RCRA Corrective Action sites within 1 mile of the Site. The RCRA-regulated hazardous waste generator notifiers list was reviewed to determine if RCRA generator facilities are located on or adjoining the Site. The database search did not identify and small/large quantity generators within '/4-mile of the Site. GRADIENT ENGINEERS INC. 973019-003 Department of Toxic Substances Control (CALSITES) Sites: The Department of Toxic Substances Control (DTSC) CALSITES database contains potential or confirmed hazardous substance release properties. The database search did not identify any facilities within 1 -mile radius of the Site. Solid Waste Landfill Facilifies: This database, provided by the Department of Consumer and Regulatory Affairs, consists of both open, as well as closed and inactive solid waste disposal facilities and transfer stations (SWLF). The database search did not identify any sites within '/2-mile of the Site. Underground Storage Tank (UST) Sites: The Califomia State Water Resources Control Board (SWRCB) Underground Storage Tank inventory list was reviewed to determine if any USTs are located within a 1/8-mile radius of the Site. The database search did not identify any UST facilities within 1/8-mile radius ofthe Site. Leaking Underground Storage Tank (LUST) Sites: The EPA maintains lists of information pertaining to reported leaking underground storage tanks (LUSTs) in the state. The database search did not identify any LUST facilities within '/i-mile of the Site. Hazardous Waste Information System (HAZNET) Sites: The Hazardous Waste Information System (HAZNET) database identifies manifests that have been issued for a property. The database search did not identify any HAZNET facilities within 1/8-mile radius of the Site. Califomia Hazardous Materials Information Reporting System (CHMIRS) Sites: The Califomia Hazardous Materials Information Reporting System (CHMIRS) database contains information of reported hazardous material incidents (accidental releases or spills). The database search did identify three CHMIRS locations within 1-mile radius of the Site. They are: • 1961 Paloman (Palomar) Oaks Way-hydriodic acid spill on October 6, 1989 was cleaned up. • 1969 Palomar Oaks Way-corrosive liquid spill on May 17, 1988 was cleaned up • 1979 Palomar Oaks Way-oil and solvent spill on October 15, 1990 was cleanup Based on the fact these reported spills were cleaned up, they do not present a condition of concem to the Site. Facility Index System ("FINDS) Sites: The Facility Index System (FINDS) contains both facility information and 'pointers' to other sources that contain more detail. The database search did not identify any facilities within 1-mile radius of the Site. Toxic Chemical Release Inventory (TRIS) Sites: The Toxic Release Inventory System (THIS) identifies facilities which release toxic chemicals to the air, water, and land in reportable quantities under SARA Titie III Section 313. The database search did not identify any TRIS facilities within 1-mile radius of the Site. GRADIENT ENGINEERS INC. 973019-003 Unmapped Sites: Several unmapped listings were reported in the EDR database report. Due to the nature of the listings and distances from the Site, they do not present a condition of concem to the Site. 3.2 Review of Previous Reports The following previous reports were prepared for the Site: • Gradient Engineers, Inc., 1998, Phase I Environmental Assessment Report for the Proposed Poinsettia Village Located at the Northeast Comer of Aviara Parkway and Poinsettia Lane, Carlsbad, Califomia, dated January 5, 1998, ProjectNo. 973019-001. • Gradient Engineers, Inc., 1999, Phase I Environmental Assessment for the One Acre Northem Parcel of the Proposed Carlsbad Promenade, Aviara Parkway, Carlsbad, Califomia, dated November 22, 1999, Project No. 973019-002. Based upon the information obtained during the course of the above assessments. Gradient presented the following opinion: • Gradient performed a Phase I ESA for the subject site in conformance with the scope and limitations of ASTM Practice E 1527-97. Wr GRADIENT ENGINEERS INC. 973019-003 5.0 INTERVIEWS Gradient (1997) conducted interviews with persons having knowledge of current or past site usage. Interviews were conducted either orally or in the form of a written questionnaire. The following persons were interviewed: • Mr. Daljit Sarkari, the previous property owner, completed the Phase 1 Environmental Site Assessment Transaction Screen Questionnaire for the Site. Mr. Sarkari stated he has owned the property for approximately 10 years and the property has been used for farming. Mr. Sarkari stated prior to his purchase of the property, the site was used for agricultural purposes for an uncertain length of time. Based on information gathered from the Background Questionnaire, Mr. Sarkari stated to the best of his knowledge, no environmental conditions exist for the Site. Mr. Sarkari was also contacted regarding chemical use on the Site. Mr. Sarkari stated he leased the property to the growers and was unsure of any chemical use or storage on the Site. GRADIENT ENGINEERS INC. -10- Wr 973019-003 6.0 SOIL SAMPLING Based on historical site usage, surface and near surface (0.5 feet below grade) were collected on December 22, 1997 for chemical analysis to assess for the presence of pesticides. The location of the soil samples are shown on Figure 2. The samples were collected and then stored in laboratory provided container. These containers were placed in an ice-cooled chest and delivered with a properly completed Chain-of-Custody from to Pacific Treatment Analytical Services, Inc. (a Califomia certified laboratory). Each surface samples was chemically analyzed for organochloride pesticides by EPA Method 8080. The laboratory test results indicated that one organochloride pesticide, toxephene, is present in the four (4) samples. The concentrations range from 197 to 1230 mg/kg. The vertical extent of toxephene was not assessed as part of this investigation. On January 9, 2001, Gradient collected 15 surface soil samples (0.5 feet below grade) and 15 near-surface samples (between 1.5 and 3.0 feet below grade) at 15 locations to ascertain the presence of possible organochlorine pesticides. The 15 locations are shown on Figure 2. A hand auger was used to collect the soil samples, and was advanced to a maximum depth of 3.0 feet below grade. Near-surface samples were collected at depths shallower than 3.0 feet when auger refusal was met at top of bedrock. The hand auger was decontaminated after the collection of each sample by rinsing with a non-phosphate detergent and distilled water solution, a bleach and distilled water solution, and then by double-rinsing with distilled water. The samples were placed in clean, 4-ounce glass containers provided by the laboratory. Sierra Analytical, of Laguna Hills, Califomia. The filled containers were stored in an ice-cooled chest and delivered with a properly completed chain-of-custody form to the laboratory. -11- Wr GRADIENT ENGINEERS INC. 973019-003 The laboratory test results indicated that two organochlorine pesticides, 4,4'-DDE and 4,4'-DDT, were present in surface and near-surface soils at the site at concentrations above their respective laboratory detection limits. The 4,4'-DDE concentrations ranged from 0.0092 to 0.23 mg/kg, and the 4,4'-DDT concentrations ranged from 0.010 to 0.17 mg/kg. Toxaphene was not detected in any of the 30 samples. The laboratory data is summarized in the following table, and the laboratory report is presented in Appendix D.
