SUBJECT: FIRST REVIEW OF LA COSTA CONDOMINIUMS
(CT 02-28/CP 02-1 3/HDP 02-14, APN 21 6-160-27)
Engineering Department staff has completed a review of the application submittal
documents for application completeness. The application and plans submitted for this
project are incomplete and unsuitable for further review due to the following missing or
incomplete items:

1. Depict and callout the record information of all easements encumbering this
property. Please callout the disposition of each easement.
2. Depict sidewalks along each driveway to ensure pedestrian circulation along
within the project. Refer to the redlines for clarification on this issue.
3. Revise the design to eliminate conflicts in the turning movements for
emergency vehicles, trash trucks and moving vans. Provide a separate
exhibit to demonstrate how a truck will enter the site and turn around each of
the dead ends. Show inside and outside tire tracks per 407E turning
templates. Refer the redline set attached which depicts conflicts with the
turning movements. A fire truck should only make a three point turn. More
than three points is unacceptable. Engineering does not support using
“private” driveways for the trucks, since these driveways may have cars
parked there.
Revise the tentative map to include the quantities (cubic yards) of remedial
grading that is anticipated (e.g.: key buttresses for slope stability per soils
report)
Revise the Tentative Map so that is includes finished topographic lines at 5-
foot intervals.
Provide a letter from the soils engineer addressing the detention basin. It
appears the basin is located within the limits of the proposed key buttress
used to stabilize the ancient landslide. Are there any soils issues with the
location of the detention basin at this location? Revise the design to

eliminate any discrepancies.
Revise the Tentative Map to depict the location of existing sidewalk along the
entire project frontage of La Costa Avenue. If none exists, then include
proposed sidewalk with the design.
Revise the Tentative Map to clarify if the streetlights along the project
frontage are proposed or existing. Demonstrate that street light spacing
meets City standards.
Revise the Storm Water Management Plan to clarify the incorporation of the
detention basin (the beneficial purposes it serves) and which measures will
be incorporated to treat storm water from private drives before discharge to
public right-of-way (e.g.: inlet filters, etc.)

Below I have also listed engineering concerns that should be addressed prior to
final determination or conditioning:

Revise the Tentative Map so the private “streets” are called out as private
“drives”.
Revise the Tentative Map so the private drives are constructed with rolled
curb on both sides and at least a 4.5-foot wide sidewalk on one side of the
driveway. This will enable vehicles to move off to the side in the event
emergency vehicles enter the site.
Contact the Fire Marshal to confirm whether this project will require additional
fire protection measures. They will review the revised exhibits on the next
review to confirm vehicular turn-arounds are adequate for the fire engines.
Revise the Tentative Map to depict individual water meters for each
condominium unit.
Callout and depict the sight distance triangles per City Standards.
Add CT 02-28, HDP 02-14 and CP 02-13 at the upper right hand corner of
the tentative map exhibits.
Revise the preliminary Storm Water Management Plan and the tentative map
to address how pollutants (e.g.: asphalt emulsion, heavy metals, oils, etc.) will
be filtered from the storm drain inlets along the private drive before being
discharged from the site.
Revise the tentative map to add a note to the plans stating that no parking signs
will be posted along all interior driveways.
Revise the tentative map so the 244 driveway at the entrance includes rolled
curb and gutter. This will allow vehicles to move off to the side in the event
emergency vehicles are entering the site.

Revise the tentative map to depict the location of the potable water meters and
irrigation meters for the project. Each unit must be fitted with it own individual
potable water meter. Master meters are not permitted.
Add a symbol to the tentative map to clarify that portion of the driveway that will
be Portland Cement Concrete due to the steep grades.
Revise the Tentative Map so that the driveway ramps do not exceed the
standard 9.67% (per G14A). The Tentative Map depicts what appear to be
driveway ramp grades in excess of 13%. This will result in vehicles scraping their
front ends.
Revise the Tentative Map to clarify if the areas behind the structures will be
individually fenced off. If so, there may be concerns in conveying drainage
through the rear-yard swales with through fences obstructing the flow. Please
address this issue.
Revise the Tentative Map to depict drainage arrows and spot elevations to
demonstrate drainage between the structures (typical).
Revise the Tentative Map to clarifying the relocation of the existing fire hydrant at
the project entrance.
Revise the Tentative Map to clarify how pollutants in the storm water along
private streets will be removed prior to discharge from the site.
Callout the size, type and HGL of the existing waterline being connected to in La
Costa Avenue.
Provide a typical detail on the shared driveway pods.
Revise the Tentative Map to clarify if a stop sign is required going down driveway
A, since adequate sign distance may not exist for vehicles on driveway B to
make a safe turn. Steep downhill grades may contribute to potential collisions.
Revise the Tentative Map to clarify the size of trees and those that will be
removed to facilitate development of the project.
Revise the Tentative Map so that the water mains are 8-inch minimum diameter
per CMWD standards. 6-inch is the size of a single fire hydrant lateral. This
main will be providing potable, fire sprinkler, fire hydrant, and irrigation demands.
Revise the Tentative Map to clarify where storm water near the northwest portion
of the site discharges. Depict the drainage structures required.
Revise the tentative map to callout the size and hydraulic grade line of the
existing water line in La Costa Avenue.
Add callouts to demonstrate the onsite storm drain will be “private”.
Provide an emergency (secondary) overflow from the detention basin in the
event the storm drain is plugged.
Address why the detention basin is located in such a place that is intercepts and
detains offsite run-off versus run-off from the development In general, storm run-

off from the developed portion of the site is treated and detained before
discharge.
28. Revise the tentative map to depict and callout a proposed general access and
public utility easement over the private drives.

Hi Bill,
I discusssed your project with Chris and Don and here is the feedback on issues raised at the last
meeting:
1. Motor courts vs. Driveways - The ordinance does not distinguish between the two. Setbacks, as
required from private driveways are also applicable to motor courts. For this project it means 5' for garage
and 8' for residences.
2. Applicability of 8' setback for residences located on second level -Residences, even when they are on
the second level w/ garage at ground level, shall have a setback of 8' from the driveway/ motorcourt. The
intent of the PUD ordinance is to provide seperation between the driveway and living spaces by observing
a minimum of 8' setback. Some architectural features including balconies may intrude upto 2 feet into the
required setbacks.
3. 30' setback as required in the PUD ordinance applies to dwelling units and accessory structures and
since retaining walls are not considered an accessory, they are not required to be outside the 30' setback.
However wall height and location shall comply with the RDM standards.

FIRE - as previously mentioned, all buildings are to be protected by an Automatic Fire Sprinkler system
designed to NFPA 13-R, standards.
The proposed drive entrance indicates an approach angle in excess of 12 degrees. This angle of
approach or departure shall create significant difficulties for CFD equipment to transition or traverse the
steep drive. This fact may also relate to significant delays in our response or ability to access to the site.
Please revise or provide adequate transition.
All structures or aspects of those structures within 100 linear feet of undisturbed natural vegetation shall
be required to design and build into those areas, l-hour fire rated elements.
The Turning Radius exhibit does not demonstrate the Right-in I Right-out turns off of or onto La Costa Av.
Fire concern is our ability to turn off of or onto La Costa without encroachment into the inside lane or
median separation.
Question - is it to late or inconceivable to !oop the proposed water main by connecting the two lines at end
of run?

Thanks Bob. Now we're faced w/ the issue of the need for secondary emergency access and how far
we're willing to go to obtain it. I understand the commitment that Karen feels was made on this project
that secondary access is not required. However, whatever we do now could be precedent setting in terms
of future development. At a minimum, I think we need to approach the Marbella group to see how they
respond to a request for emergency secondary access off of their driveway. We could explain the
situation and offer that the secondary access could also benefit their community in the event of necessary
emergency response or evacuation of their development if their primary access is blocked. The access
would, of course, be gated to prevent unauthorized use. In the event that they also decline to participate
in this scenario we could at least show that signifcant efforts were made to secure the secondary access,
short of pursuing condemnation which has been discouraged by Julia. Politically, we have to be sensitive
to the issue of restricting a property owner's right to develop their property, particularly in light of the way
the fire code is worded. Secondary access to any other location seems very difficult for this property.

COMPLETENESS REVIEW AND INITIAL ISSUES STATEMENT
The Engineering Department has completed its review of the resubmitted project
application for completeness and/or engineering issues. The project application is now
complete for the purpose of continued engineering review. The project application does
contain some engineering issues or concerns that remain to be resolved by the
applicant. All engineering issues should be fully resolved or addressed prior to
resubmitting the project for our review. The outstanding engineering issues or concerns
are as follows:

Since the first preliminary review of the development of this site in 1999,
the single-entrance feature of the project has been an issue. Staff
requested that you look into the possibility of combining the access to this
project with the adjacent Marbella Condominiums and signalizing the
access. In your correspondence regarding this issue, you have referred to
the futile negotiations with the Marbella homeowners and the opposition of
the homeowners' association. Due to traffic safety concerns along La
Costa Avenue, the access to this project is again becoming an issue.
Please provide documentation regarding your negotiations with the
Marbella Condominium Development. Specifically, state what was
presented to them and what their response was to the proposal. Please
also provide the name and telephone number of the contact person at
Marbella. The City Engineer will make a recommendation to the Planning
Commission and City Council regarding this issue.
Submit a copy of deed for SDG&E easement (document 74-07071 5). Also
submit a letter from SDG&E agreeing to the vacation of the easement.
General access and utility easement needs to include the turn-around
areas.
The "No Parking" signs need to be located within the general utility and
access easement.
Show the sight distance corridors at the intersection of Drives 'A and 'B'
Provide a separate exhibit that demonstrates the vertical profiles for sight
lines per Caltrans corner sight distance (looking east and west onto La
Costa Avenue). The Tentative map demonstrates that horizontal sight
lines are maintained, which is one feature of visibility. However, staff must
be assured that the curvature of the road does not prohibit a vehicle, at
the project entrance, exiting onto La Costa Avenue from seeing vehicles
approaching from both directions. Adequate decision time must be verified
for the residents of this project.

Specify which trees in the La Costa Avenue right-of-way will be removed.
There are special approvals (e.g., Street Tree Removal Policy) required
for the removal of trees in the right-of-way that should be addressed at
project approval.
The issue of the individual units/cluster ramps is still not resolved. SDRSD
G-14A addresses the ramp grades when a sidewalk is present; Carlsbad’s
GS-15 addresses the ramp grades beyond the “right-of-way” line. The use
of a rolled curb or a depressed curb does not affect the overall ramp
grades. Submit your graphical analysis that shows no vehicular scraping
problems.
There are several inconsistencies in the hydrology report. Please call me
to set up an appointment to go over the report. This item includes the
detention basin.
The Storm Water Management Plan addresses most of the requirements.
However, a portion of the project drives drain directly to La Costa Avenue
without pollutants being filtered. Revise the exhibits and SWMP to
address how grease and oils will be removed from storm water prior to
discharge to public right-of-way. Weekly sweeping does not take care of
these pollutants.
Since this project serves more than 32 units, this project must be served
by a “looped” potable water system. This loop should connect to the
existing waterline in the Marbella development. If a looped system is not
feasible, provide a water system study that demonstrates the single
connection system is adequate to handle the anticipated fire flows from
the hydrants and sprinkler systems.
Provide written documentation from LCWD stating they do not object to
the sewer design on this project. In certain areas the sewer is more than
IO-feet deep, but is only contained within an easement located 5-feet from
the facility. This is not sufficient room to access and repair the sewer
without significant shoring. Is this acceptable with LCWD?
Address other miscellaneous comments in the attached redlines. Please
return the redlines with your resubmittal.

The Engineering Department has completed its review of the subject project. The Engineering
Department is recommending that the project be approved subject to the following conditions:

Prior to hauling dirt or construction materials to or from any proposed construction site
within this project, Developer shall apply for and obtain approval from, the City Engineer
for the proposed haul route.
Prior to issuance of any building permit, Developer shall comply with the requirements of
the City’s anti-graffiti program for wall treatments if and when such a program is
formally established by the City.
Developer shall provide to the City Engineer an acceptable means, CC&Rs or/and other
recorded document, for maintaining the private easements within the subdivision and all
the private improvements: streets/driveways, sidewalks, street lights, storm drain
facilities, water quality devices, and detention basin, all located therein, and to
distribute the costs of such maintenance in an equitable manner among the owners of the
properties within the subdivision.
Prior to occupancy, Developer shall install rain gutters to convey roof drainage to an
approved drainage course or street to the satisfaction of the City Engineer.
There shall be one Final Map recorded for this project.
Developer shall install sight distance corridors at all street intersections in accordance

with this development, and the restriction shown in the Final Map shall be included
in the CC&Rs.
FeeslAgreements
18. Developer shall cause property owner to execute and submit to the City Engineer for
recordation, the City’s standard form Geologic Failure Hold Harmless Agreement.
19. Developer shall cause property owner to execute and submit to the City Engineer for
recordation the City’s standard form Drainage Hold Harmless Agreement regarding
drainage across the adjacent property.
23. Prior to approval of any grading or building permits for this project, Developer shall
cause Owner to give written consent to the City Engineer to the annexation of the area
shown within the boundaries of the subdivision into the existing City of Carlsbad Street
Lighting and Landscaping District No. 1, and/or to the formation or annexation into
an additional Street Lighting and Landscaping District. Said written consent shall
be on a form provided by the City Engineer.
Grading
28. Based upon a review of the proposed grading and the grading quantities shown on the
tentative map, a grading permit for this project is required. Developer shall apply for and
obtain a grading permit from the City Engineer prior to issuance of a building permit for
the project.
25. Prior to the issuance of a grading permit or building permit, whichever occurs first,
Developer shall submit to the City Engineer proof that a Notice of Intention for the start
of work has been submitted to the State Water Resources Control Board.
26. Upon completion of grading, Developer shall file an "as-graded" geologic plan with the
City Engineer. The plan shall clearly show all the geology as exposed by the grading
operation, all geologic corrective measures as actually constructed and must be based on a
contour map which represents both the pre and post site grading. The plan shall be signed
by both the soils engineer and the engineering geologist, and shall be submitted on a 24"
x 36" mylar or similar drafting film format suitable for a permanent record.

Developer shall cause Owner to make an irrevocable offer of dedication to the City andor
other appropriate entities for all public streets and other easements shown on the tentative
map The offer shall be made by a certificate on the final map. AI1 land so offered shall be
offered free and clear of all liens and encumbrances and without cost. Streets that already
public are not required to be rededicated.
Additional drainage easements may be required. Developer shall dedicate and provide or
install drainage structures, as may be required by the City Engineer, prior to or concurrent
with any grading or building permit.
Developer shall provide the design of all private streets and drainage systems to the
satisfaction of the City Engineer. The structural section of all private streets shall conform
to City of Carlsbad Standards based on R-value tests. All private streets and drainage
systems shall be inspected by the City. Developer shall pay the standard improvement
plancheck and inspection fees.
Developer shall execute and record a City standard Subdivision Improvement Agreement
to install and secure with appropriate security as provided by law, public improvements
shown on the tentative map and the following improvements including, but not limited to

paving, base, sidewalks, curbs and gutters, medians, signing and striping, traffic control,
grading, clearing and grubbing, undergrounding or relocation of utilities, sewer, water,
fire hydrants, street lights, retaining walls and reclaimed water, to City Standards to the
satisfaction of the City Engineer.

A list of the above shall be placed on an additional map sheet on the Final Map per the
provisions of Sections 66434.2 of the Subdivision Map Act. Improvements listed above

improvement agreement or such other time as provided in said agreement.
36. Developer shall cause Owner to waive direct access rights on the final map for the
project frontage along La Costa Avenue except at Private Drive “A”.
41. Developer shall comply with the City’s requirements of the National Pollutant Discharge
Elimination System (NPDES) permit, latest version. Developer shall provide
improvements constructed pursuant to best management practices as referenced in the
“California Storm Water Best Management Practices Handbook” to reduce surface
pollutants to an acceptable level prior to discharge to sensitive areas. Plans for such
improvements shall be submitted to and subject to the approval of the City Engineer.
Said plans shall include but not be limited to notifying prospective owners and tenants of
the following:
A. All owners and tenants shall coordinate efforts to establish or work with
established disposal programs to remove and properly dispose of toxic and
hazardous waste products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil,
antifreeze, solvents, paints, paint thinners, wood preservatives, and other such
fluids shall not be discharged into any street, public or private, or into storm drain
or storm water conveyance systems. Use and disposal of pesticides, fungicides,
herbicides, insecticides, fertilizers and other such chemical treatments shall meet
Federal, State, County and City requirements as prescribed in their respective
containers .
C. Best Management Practices shall be used to eliminate or reduce surface pollutants
when planning any changes to the landscaping and surface improvements.
42. Prior to the issuance of grading permit or building permit, whichever occurs first,
Developer shall submit for City approval a “Storm Water Pollution Prevention Plan
(SWPPP).” The SWPPP shall be in compliance with current requirements and provisions
established by the San Diego Region of the California Regional Water Quality Control
Board and the City of Carlsbad. The SWPP shall address measures to reduce to the
maximum extent practicable storm water pollutant runoff during construction of the
project. At a minimum, the SWPPP shall:

installation of traffic signals and ultimate intersection striping per City Standards
and constructed to the satisfaction of the City Engineer. The improvements consist

Design and construct a new fully actuated traffic signal at the
intersection of La Costa Avenue and Private Drive “A” at the
entryway of the project. Developer acknowledges the necessity of this
signal is to serve only this project and Developer will bear all costs
associated with the design and construction of this signal, if warrants
are met. TLie signal shall be interconnected with adjacent signals to
facilitate signal coordination.
Developer shall post security for the design and construction of said improvements.
The Agreement shall be kept in force and security kept valid for a period of 5-years
after the last building permit has been issued within this Development. The traffic
signal shall be installed only when written approval is received by the City
Engineer.

Prior to approval of improvement plans or final map, Developer shall meet with the Fire
Marshal to determine if fire protection measures (fire flows, fire hydrant locations,
building sprinklers) are required to serve the project. Fire hydrants shall be considered

District Engineer.
The Developer shall design and construct public facilities within public right-of-way or
within minimum 20-feet wide easements granted to the District or the City of Carlsbad.
At the discretion of the District Engineer, wider easements may be required for adequate

Prior to issuance of building permits, Developer shall pay all fees, deposits, and charges
for connection to public facilities. Developer shall pay the San Diego County Water

The Developer shall prepare a colored recycled water use map and submit this map to the
Planning Department for processing and approval by the Deputy City Engineer - Utilities.
The Developer shall design landscape and irrigation plans utilizing recycled water as a
source. Said plans shall be submitted to the satisfaction of the District Engineer.

The Developer shall design and construct public water, sewer, and recycled water

This project is approved upon the express condition that building permits will not be
issued for the development of the subject property, unless the District Engineer has
determined that adequate water and sewer facilities are available at the time of
occupancy.
Prior to Final Map approval or issuance of building permits, whichever is first, the entire
potable water, recycled water, and sewer system shall be evaluated in detail to ensure that
adequate capacity, pressure, and flow demands can be met to the satisfaction of the
District Engineer.
A fire flow system shall be required for this development and it shall be constructed as a
looped system. The Developer shall complete the looped water system by tyng into the
existing waterline system of the westerly adjacent development to the satisfaction of the
District Engineer.
The Developer shall coordinate with the District Engineer regarding the looped system
and easements.
The Developer shall meet with and obtain approval fiom the Leucadia County Water
District regarding sewer infrastructure available or required to serve this project.

8. The sight line is depicted on the tentative map. The underlying
property owner shall maintain this condition
Code Reminder
The project is subject to all applicable provisions of local ordinances, including but not limited to
the following:
A. The tentative map shall expire twenty-four (24) months from the date this tentative map
approval becomes final.
B. Developer shall exercise special care during the construction phase of this project to
prevent offsite siltation. Planting and erosion control shall be provided in accordance
with Carlsbad Municipal Code Chapter 15.16 (the Grading Ordinance) to the satisfaction
of the City Engineer.
