The proposed modification includes: • Converting a 1,750 square foot Recreational Vehicle Storage Area to a 1,160 square foot landscaped pocket park/landscape area and modifying the location of a guest parking space. The proposed change is consistent with the Planned Development (C.M.C. Chapter 21.45) regulations, which no longer requires RV Storage for projects located within the RMH General Plan Land Use designation. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood. 3) The proposed revision does not change the density or boundary of the subject property. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit. 5) The proposed revision does not rearrange the major land uses within the development. 6) The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation. 8) The proposed change would not result in any health, safety or welfare impacts. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10) The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved. 1635 Faraday Avenue, Carlsbad, CA 92008-7314 T 760-602-4600 F 760-602-8559 © After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the application qualifies for a consistency determination with the approved permit and therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35. Please submit two (2) blueline copies (24" X 36") of all applicable exhibits for the project file and a reproducible 24" X 36" mylar copy of the amended site plan. We believe this change will provide a more functional amenity that can be used by all residents, and that the change is consistent with all applicable City ordinances and standards, including the RD-M Zone and Planned Development regulations in the Carlsbad Municipal Code. The existing approved La Costa Condominium development includes a small pocket park of approximately 530 square feet fronting Sitio Del Mar (originally known as Private Drive A) and an approximately 1,750 square foot recreation vehicle storage yard at the terminus of Sitio Del Mar. The vehicle storage yard is no longer required under applicable Planned Development regulations. Thus, we propose to convert the vehicle storage yard which, would likely serve only a small percentage of residents, to an approximately 1,160 square foot landscaped pocket park, available for use by all residents at all times. In addition, we propose to add one additional guest parking space adjacent to the pocket park. The proposed changes would result in total pocket park area within the development of approximately 1,690 square feet, or slightly more than three times the existing pocket park area divided amongst two locations. The landscaping proposed for the pocket park is designed to provide a level turf area with small hardsurface area featuring two sitting benches, and will be largely screened from the view of uphill neighbors by appropriately placed trees and shrubs. The pocket park will be elevated from the original grade level of the vehicle storage yard and linked to an extension of the Mr. Jason^roff August 12, 2010 Page two common walkway serving the four-plex residential buildings. Lighting bollards will provide nighttime illumination for the pocket park. This application includes two exhibits of the existing recreational vehicle storage yard, two colored 8-1/2 x 11 exhibits of the proposed change, and two reproducible black and white 8-1/2 x 11 exhibits of the proposed change. Also enclosed is a completed and signed application form, and a check for the application fee. We look forward to our review and request your approval of this application.
