Now we're faced w/ the issue of the need for secondary emergency access and how.far we're willing to go to obtain it. I understand the commitment that Karen feels was made on this project that secondary access is not required. However, whatever we do now could be precedent setting in terms of future development. At a minimum, I think we need to approach the Marbella group to see how they respond to a request for emergency secondary access off of their driveway. We could explain the situation and offer that the secondary access could also benefit their community in the event of necessary emergency response or evacuation of their development if their primary access is blocked. The access would, of course, be gated to prevent unauthorized use. In the event that they also decline to participate in this scenario we could at least show that signifcant efforts were made to secure the secondary access, short of pursuing condemnation which has been discouraged by Julia. Politically, we have to be sensitive to the issue of restricting a property owner's right to develop their property, particularly in light of the way the fire code is worded.
