I have enclosed modified language for the Condition regarding the Poinsettia Lane requirements for the Planning Department's report to the Planning Commission, scheduled for June 17, 1998. The proposed Condition relates the roadway improvements for Poinsettia Lane to the approved Reimbursement Agreement. I would appreciate your review of this language and acknowledgment to Anne Hysong in the Planning Department that the language is acceptable. Please let me know if you have any questions or comments. Nevertheless, as an accommodation to the City, and for the benefit of city-wide planning, the developer has agreed to construct the off-site roadway improvements for that portion of Poinsettia Lane between Aviara Parkway and Black Rail Road (the "Aviara/Black Rail Segment"), and, in consideration therefore, the City has agreed to reimburse the developer for the actual cost of constructing the Aviara/Black Rail Segment (all as more fully described in that certain Agreement for Reimbursement of Costs for Construction of Improvements for Poinsettia Lane from Aviara Parfcway to Black Rail Road, dated , 1998 (the "Road Work Agreement"); provided, however, the developer shall not be obligated to construct the Aviara/Black Rail Segment unless (i) the City acquires all necessary right-of-way and easements related to the construction and use of the Aviara/Black Rail Segment (as more fully described in the Road Work Agreement), and (ii) at the time the map is otherwise scheduled to receive final approval, the City is not in default under the Road Work Agreement."
