Dear Mr. Henthorn:
I have reviewed your letter of February 5, 1998 regarding the above referenced
project. Regarding the proposed improvement plan changes with respect to
Poinsettla Lane and Black Rail Road, because the minor design changes take
place within the approved alignment of both roads, no further permit review
would be required by the Commission. I have made the updated engineering
plans part of the permit file.
The modification to the approved tentative map relating to affordable housing
is consistent with the mapping and exhibits previously approved by the
Commission. The Commission approved an option permitting the affordable
housing site to be divided into four residential lots if the City permitted
the applicant to mitigate affordable housing impacts at an off-site location.
The City has authorized the applicant to purchase credits in the adjacent
Villa Loma project. A copy of the City's action should be included when
condition compliance documents are submitted.
The proposed extension of Poinsettia Lane from "A" Street to Black Rail Road
was not approved by the Commission in the above coastal development permit.
Thus, because the City now has a certified Local Coastal Program, the City
will consider this project in its review as a new coastal development permit.
Similarly, the proposed residential units were not approved by the Commission
and must also be considered by the City in their permit review.
