Specifically, this condition requires that, prior to the issuance of a grading permit for Poinsettia Lane Reach Two, mitigation is required for impacts to .35 acres of Coastal Sage Scrub and .45 acres of Southern Maritime Chaparral. The attached Acknowledgment of Sale of Conservation Credits documents this required mitigation. Therefore, the grading restriction on the grading plans issued for the Oceanbluff and Poinsettia Lane Projects should be removed. Inasmuch as we are currently grading the Oceanbluff site and Poinsettia Lane Reach One, we would appreciate your immediate acknowledgment that this condition has been satisfied to Mike Shirey in the Engineering Department so that we may continue our grading operation for Poinsettia Lane Reach Two. All terms of this conveyance shall be governed by the provision of the Conservation Credit Purchase Agreement and Acknowledgment between Purchaser and the undersigned dated September 15, 1998.
