Construct/Install AS to on-site or off-site, water or sewer. Off-site is subject to several contingencies which may never occur, or at least not occur within a normal or the expected life of this TM. To what standards does Developer Construct/Install? Only addressed in Eng Cond #20 (=City Standards), nowhere mentioned in any water condition?? 3. Does the city and/or water district already have the easement, or is a condition of approval that this developer acquire and construct? NO, because one of the contingencies is that City acquire all necessary ROW/easements-see Condition #32, applicable only to the water, not sewer, off-site J improvements. 4. What is the source of $ for District to make reimbursements? So staff report will advise PC that $' has already been budgeted to reimburse this Developer, and/or Council AB will address in Fiscal J Impact discussion? But budget hasn't been approved yet. 5. What happened to sewer line portion of old #33? Only addresses off-site, without some of contingencies applicable to off-site water facilities. Maybe Engineering Condition #20 b) vii) and d) through f) cover on-site sewer (and water)? 6. These are off-site, non-nexus facilities. Where is the condition making Developer construct/install non-reimbursable nexus on-site facilities? See my #1 notes, above. #27 doesn't say what to constuct, only where to construct whatever is required to be constructed. So then you go looking in the other conditions for imposition of a duty to constuct on-site facilities, and dont seem to find it (unless include within #20; or shown on an Exhibit being approved)? >» Bill Plummer 06/10/98 01:55PM >» Rich, I have read your comments and discussed them with Ann Hysong on June 10, 1998. Following is my response: 1. Offsite pipelines are to be installed when the new Poinsettia Road is being constructed. We changed the condition to "District" and removed the "City" for reimbursement. 2. Facilities shall be constructed in accordance with District Standards and Specifications. 3. The District will not be acquiring any easements. The pipelines will be within the public right of way of Poinsettia lane. If the City is unable to obtain the right of way needed for the road then the pipelines will not be constructed until RM/ is obtained. 4. We budgeted in the 98ra9 CIP for these pipelines. 5. The sewer line is in #32 and #33. 6. We are using our standard conditions to cover the tract facilities, which states that adequate facilities determined by District Engineer must be in place prior to building permit issuance.
