HomeMy WebLinkAboutCT 04-08; Moonstone Levatino; Tentative Map (CT)OF VCARLSBAD Planning Division www.carlsbadca.gov February 23, 2011 City Ventures c/o Tony Pauker 2850 Redhill, Suite 200 Santa Ana, CA 92703 SUBJECT: CD 11-01 - MOONSTONE LEVATINO The Planning Director has completed a review of your application for modifications to La Costa Village Center Townhomes, (APN: 215-050-73) which is a modification to adjust sidewalk and private patio locations on the site plan as well as the elimination of the entry waterfall feature and the modification of approved structures to reconfigure the interior floorplans for a preferred flow and to include a third bedroom. The proposed modifications include: a. Removing some sections of onsite sidewalk. b. Onsite vehicular circulation and pedestrian access to adjacent public sidewalks are not proposed to be modified and shall remain as approved by the Planning Commission and City Council. c. Increasing the size of selected private groundfloor patios. d. Elimination of the waterfall entry feature and replacing it with a terraced and landscaped feature. The replacement of the waterfall entry feature with a terraced and landscaped feature is within the parameters of a consistency determination, however, the final design of the landscape, and types and quantities of materials will need to be reviewed and approved through the formal landscape plan submittal process. e. Increase the footprint of each of the buildings between 1.1% and 2.8% while still complying with building coverage and separation standards. f. Re-organize the interior floorplans for a preferred flow. g. Add a third bedroom to each unit within the existing building volume, h. Modify elements of the exterior architecture including: 1. Upperfloor patios over living space are covered 2. Larger wooden shutter and awning details are added 3. Wrought iron window planters are added 4. Some symmetrical building features are redesigned to provide asymmetry. 5. Planted trellises are proposed above and around garage doors. 6. Upper floor wrought iron balconies are added. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1. No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function. 2. The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood. 3. The proposed revision does not involve the addition of a new land use not shown on the original permit. 5. The proposed revision does not rearrange the major land uses within the development. 6. The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code. 7. The proposed change will not result in any significant environmental impact, and/or require additional mitigation. 8. The proposed change would not result in any health, safety or welfare impacts. 9. There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10. The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved. After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the application qualifies for a consistency determination with the approved permit and therefore, approves .the changes to the project based on Planning Division Administrative Policy No. 35 subject to the satisfaction of the following conditions: 1. The applicant shall revise the .design of the proposed landscaped entry feature to incorporate plants, materials and hardscape subject to the review and approval of the Planning Director through the formal landscape plan submittal process. 2. This consistency determination does not address potential future design changes addressing the requirements of the city's current Standard Urban Management Plan (SUSMP) and hydromodification plan. Application for a subsequent consistency determination and/or substantial conformance exhibit may or may not be necessary depending on the type and magnitude of any design change proposed to address these requirements Please submit two (2) blueline copies (24" X 36") of all applicable exhibits for the project file and a reproducible 24" X 36" mylar copy of the amended site plan. The mylar must be submitted, stamped "Consistency Determination," and signed by the Planning Director prior to issuance of any building permits for the project. The Consistency Determination Title Block stamp, and other Title Block stamps, can be downloaded from the City's website at http://www.carlsbadca.gov/services/departments/planning/Pages/applications.aspx.
