The Phase I Enviromnental Site Assessment is designed to provide Fremont Investment & Loan with an assessment concerning environmental conditions as they exist at the Property. This assessment was conducted utilizing generally accepted ESA industry standards in accordance with ASTM E 1527-00, Standard Practice for Enviromnental Site Assessments: Phase I Environmental Site Assessment Process and the Fremont Investment & Loan scope of work for Phase I Environmental Site Assessments. This Phase I Environmental Site assessment was conducted under the terms and conditions of NAC's Master Services Agreement with Fremont Investment & Loan. In the event any provisions of this report conflict with the terms and conditions of the Master Services Agreement, the Master Services Agreement will control. The Property is currently developed for multi-family residential use. The Property encompasses approximately three acres and contains four, two-story apartment buildings. TI1e apartment buildings contain a total of 51 units constructed in 1965. The Property also contains a swimming pool, sauna, one laundry room, carport buildings, asphalt-paved driveways, concrete walkways, wooden access stairways and landscaping. According to historical sources, the Property was undeveloped prior to construction of the current improvements in 1965. The Property is situated within an urban area in downtown Carlsbad, California. The apartment buildings are bound to the north by the Buena Vista Lagoon With residences beyond; to the south by Ocean Street with multi-family residences beyond; to the east by a driveway and tennis court; and, to the west by single- family residences. Based upon topographic map interpretation and site observations, groundwater flow beneath the Property is inferred to be in a westerly direction toward the Pacific Ocean. NAC obtained and reviewed a database report from Enviromnental Data Resources (EDR) for the Property and the surrounding area. Based on the database report, no sites were identified as potential concerns to the Property. NAC did identity eight LUST sites located within the prescribed search radii. All of the sites identified were either cross or downgradient of the Property and therefore not considered to be a Recognized Environmental Conditions (REC) which threaten conditions at the Property. Conclusions NAC has performed a Phase I Environmental Site Assessment of the property at 2303 Ocean Street, Carlsbad, California, in conformance with the scope and limitations of ASTM Practice E 1527-00. Any exceptions to or deletions from this practice are described in Section 1.4 of this report. This assessment has revealed no evidence of recognized environmental conditions in com1ection with the Property. ENVIRONMENTAL SITE ASSESSMENT NAC PROJECT No. 03-16509.1 fREMONT INVESTMENT & LOAN NAC While not considered a REC by ASTM criteria, the following issue warrants mention: • Suspect and previously-confirmed asbestos containing materials were observed at the Property. Previously confinned ACM includes exterior stucco, acoustical ceiling material, joint compound and various floor tiles/mastics. These materials were confirmed as asbestos containing during NAC's limited sampling perfonned as part of this assessment. Additional suspect ACM observed by NAC includes roofing materials and penetration mastics. All suspect and confirmed ACM was noted to be in good condition at the time of NAC's reconnaissance, and these materials can be maintained in place under the provisions of an operations and maintenance (O&M) plan. Recommendations Based on the findings of this ESA, NAC recommends the following: • Implementation of an Operations & Maintenance Program for the in-place management of confirmed and suspect ACM identified at the Property. Additionally, comprehensive asbestos sampling should be performed prior to any disturbance or demolition of suspect ACM at the Property. The following table summarizes the findings of the significant elements of this investigation. The protocol used for this assessment is in conformance with ASTM E 1527-00, Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process and the Fremont scope of work for Phase I Environmental Site Assessments. On October 1, 2003, Drew Kerr, a representative ofNAC, conducted a site reconnaissance to assess the possible presence of petroleum products and hazardous materials at the Property. NAC's investigation included review of aerial photos, reconnaissance of adjacent properties, background research, and review of available local, state, and federal regulatory records regarding the presence of petroleum products and/or hazardous materials at the Property. · NAC contracted EDR, Inc., of Southport, Connecticut, to perform a computer database search for local, state, and Federal regulatory records pertaining to environmental concerns for the Property and properties in the vicinity of the Property (see Section 7.0). 1.1 Purpose The purpose of this Phase I Environmental Site Assessment is to identify recognized environmental conditions in c01mection with the Property. The term "recognized environmental conditions" as defined in ASTM Standard Practice E 1527, means the presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release, past release, or a material threat of a release of any hazardous substances or petroleum products into a structure on the property or into the ground, groundwater or surface water of the property. The tem1 includes hazardous substances or petroleum products even under conditions in compliance with environmental laws. This assessment has been performed in a manner which complies with requirements of the most recently revised version of ASTM Standard Practice E 1527. This report has been prepared for the review oflegal counsel. NAC's performance of the Services is specifically intended to develop information which Fremont counsel will use in advising Fremont of its legal rights and/or in advancing its interest in litigation. 1.2 Scope of Services The scope of work for this ESA is in accordance with Fremont Phase I Environmental Site Assessment protocol and is in accordance with the requirements of ASTM Standard E 1527-00. NAC warrants that the findings and conclusions contained herein were accomplished in accordance with the methodologies set forth in the Scope of Work. These methodologies represent good conm1ercial and customary practice for conducting an Environmental Site Assessment of a property for the purpose of identifying recognized environmental conditions. This Phase I Environmental Site assessment was conducted under the terms and conditions of NAC's Master Services Agreement with Fremont Investment & Loan. In the event any provisions of this report conflict with the terms and conditions of the Master Sen•ices Agreement, the Master Sen•ices Agreement will control. ENVIRONM~NTAI. SITE ASSESSMENT NAC PROJECT No. 03-16509 .I 3 FREMONT INVESTMENT & LOAN NAC 1.3 Assumptions There is a possibility that even with the proper application of these methodologies there may exist on the Property conditions that could not be identified within the scope of the assessment or which were not reasonably identifiable from the available information. NAC believes that lhe information obtained from the record review and the interviews concerning the site is reliable. However, NAC cannot and docs not warrant or guarantee that the information provided by these other sources is accurate or complete. The methodologies of this assessment are not intended to produce all inclusive or comprehensive results, but rather to provide Fremont with information relating to the Property. 1.4 Limitations and Exceptions The findings and conclusions contain all of the limitations inherent in these methodologies that are referred to in ASTM 1527-00. Specific limitations and exceptions were not encountered during the preparation of this ESA. 1.5 Special Terms and Conditions The work performed is governed by our project assignment addendum executed by Fremont contact on September 25, 2003. The conclusions and findings set forth in this report are strictly limited in time and scope to the date of the evaluations. The conclusions presented in the report are based solely on the servites described therein, and not on scientific tasks or procedures beyond the scope of agreed-upon services or the time and budgeting restraints imposed by the client. No subsurface explorarory drilling or sampling was done under the scope of this work. Unless specifically stated otbe..-wise in the report, no chemical analyses have been performed during the course of this ESA. Some of the information provided in this report is based upon personal interviews, and resea~ch of available documents, records, and maps held by the appropriate government and private agencies. This is subject to the limitations of historical documentation, availabilitY, and accuracy of pertinent records, and the personal recollections of those persons contacted. 1.6 Use Reliance All repmts, both verbal and written, are for the benefit of Fremont. This report has no olter purpose and may not be relied upon by any other person or entity, except as set forth in the Master Sen•ices Agreement, without the written consent of NAC. ENVIRONMENTAL SITE ASSESSMENT NAC PROJECT NO. 03-16509.1 4 FREMONT INVESTMENT & LOAN NAC 2.0 SITE DESCRIPTION 2.1 User Provided Information NAC was provided with a previous environmental assessment report related to the Property. The previous report was prepared by CTL Environmental Services, Inc. (CTL) and was dated June 2002. CTL identified the prior use of the Property as primarily undeveloped, but small shed-like structures were observed on the Property from 1932 until 1953. CTL conducted asbestos sampling and found the following materials to be positive for asbestos: exterior stucco, acoustical ceiling material, joint compound ar!d various floor tiles/mastics. Lead was not detected on the painted surfaces tested. CTL observed limited visible mold growth in a single area, but the affected area was removed and replaced with new drywall. CTL also inspected the wall cavity and did not observed visible mold growth at that time. CTL recommended a comprehensive asbestos and lead survey prior to conducting renovation or demolition activities at the Property. 2.2 Location and Legal Description The address of the Property is 2303 Ocean Street. The Property is located in an urban area of San Diego County. According to the San Diego County Assessor, the assessor's parcel number of the Property is 203-010-12-00. The abbreviated legal description is reproduced below: 3.07 ACMILJNSTCLSD &IN LOT A TR 2037 According to the San Diego County Tax Assessor's office, the Property is currently owned by 2303 Ocean Apartments, LLC, which has owned the Property since 2002. 2.3 Site and Vicinity General Characteristics The Property is located in an residential area that is characterized by single and multi-family residences. The Property is zoned for multi-family residential use by the City of Carlsbad. · The Property consists of an irregular shaped parcel approximately three acres in size. The Property is designed and used for multi-family purposes. Currently, the Property is developed with four structures that were constructed in 1965. The structures at the Property are two stories in height. The Property offers a total of 51 apartment units. Access to the asphalt-surfaced Property parking lots on the northem westem and eastem portions of the Property is provided from Ocean Street. Manicured landscaping is interspersed throughout the Property. No other structures or significant surface features were noted on the Property at the time of the reconnaissance. 2.4 Current Use of the Property The Property contains four, two-story apartment buildings, carports, one swimming pool, laundry room, sauna, concrete walkways, wooden access stairways and landscaping. The current improvements were constructed in 1965. ENVIRONMENTAL SITE ASSESSMENT NAC PROJECT No. 03-16509.1 5 FREMONT INVESTMENT & LOAN NAC 2.5 Description of Site Improvements All four buildings are of concrete slab-on-grade with wood-frame construction and stucco exterior. The interior finishes are comprised of acoustical ceiling material on the ceilings and gypsum wallboard interior walls. Carpeting covers the majority of interior floors, with vinyl tiles present in bathrooms and kitchens. Tar and gravel covers each ofthe four building roofs. The City of Carlsbad supplies drinking water to the Property from the municipal distribution system. Sanitary discharges on the Property are discharged into the municipal sanitary sewer system. The Property area is serviced by the City of Carlsbad. Electricity and natural gas are provided to the Property by San Diego Gas & Electric. 2.6 Current Use of Adjoining Properties During the vicinity reconnaissance, NAC observed the following land use on properties in the immediate vicinity of the Property. North: The Buena Vista Lagoon is located to the north of the Property with single-family residential uses beyond. This adjacent area may be considered sensitive habitat which may carry development restrictions, but is not part of the Property. South: Ocean Street borders the Property to the south with multi-family residential use beyond. East: The adjoining property to the east contains a driveway and tennis court. West: The adjoining properties to the west contain single-family residences. ENVIRONMENTAL SITE ASSESSMENT NAC PROJECT No. 03-16509.1 6 FREMONT INVESTMENT & LOAN NAC 3.0 RECORDS REVIEW 3.1 Standard Environmental Record Sources 3.1.1 State and Federal Regulatory Review lnfonnation from standard Federal and state environmental record sources was provided through EDR, Inc. Data from governmental agency lists are updated and integrated into one database, which is updated as these data are released. This integrated database also contains postal service data in order to enhance address matching. Records from one government source are compared to records from another to clarifY any address ambiguities. The demographic and geographic information available provides assistance in identifying and managing risk. The accuracy of the geocoded locations is approximately +/-300 feet. In some cases, location infonnation supplied by the regulatory agencies is insufficient to allow the database companies to gcocoded facility locations. These facilities are listed under the unmappables section within the EDR report. A review of the unmappable facilities indicated that none of these facilities are within the ASTM minimum search distance from the Property. Regulatory infonnation from the following database sources regarding possible recognized environmental conditions, within the ASTM minimum search distance from the Property, was reviewed. Specific facilities are discussed below if detennined likely that a potential recognized environmental condition has resulted at the Property from the listed facilities. Please refer to Appendix C-1 for a complete listing. FederaiNPL The National Priorities List (NFL) is the Environmental Protection Agency (EPA) database of uncontrolled or abandoned hazardous waste sites identified for priority remedial actions under the Superfund Program. The Property is not listed as a NPL facility. No NPL sites are located within one mile of the Property. Federal CERCUS List The Comprehensive Environmental Response, Compensation and Liability Information System (CERCUS) list is a compilation of sites that the EPA has investigated or is currently investigating for a release or threatened release of hazardous substances. The Property is not listed as a CERCUS facility. No CERCUS sites are listed within one- half mile of the Property. Federal CERCUS NFRAP Sites List 1l1e CERCUS No Further Remedial Action Plmmed (NFRAP) List is a compilation of sites that the EPA has investigated, and has determined that the facility does not pose a threat to human health or the environment, under the CERCLA framework. ENVIRONMENTAL SITE ASSESSMENT NAC PROJECT NO. 03-16509.1 7 FREMONT INVESTMENT & LOAN NAC The Property is not listed as a CERCLIS-NFRAP facility. No CERCLIS-NFRAP sites arc listed on or adjoining the Property. Federal Resource Conservation and Recovery Act (RCRA) CORRACTS TSD Facilities List The EPA Resource Conservation and Recovery Act (RCRA) Program identifies and tracks hazardous waste from the point of generation to the point of disposal. The RCRA Treatment, Storage and Disposal (TSD) database is a compilation by the EPA of reporting facilities that treat, store or dispose of hazardous waste. The CORRACTS database is the EPA's list of treatment storage or disposal facilities subject to corrective action under RCRA. The Property is not listed as a RCRA CORRACTS TSD facihty. No RCRA CORRACTS TSD facilities are listed within one mile of the Property. Federal Reso11rce Conservation and Recovery Act (RCRA) N01r-CORRACTS TSD Facilities List The RCRA TSD database is a compilation by the EPA of reporting facilities that treat, store or dispose of hazardous waste. The Property is not listed as a RCRA-TSD facility. No RCRA TSD sites are listed within one-half mile of the Property. Federal RCRA Generator List The RCRA program identifies and tracks hazardous waste from the point of generation to the point of disposal. The RCRA Generators database is a compilation by the EPA of reporting facilities that generate hazardous waste. The Property is not listed as a RCRA facility. No RCRA Generator facilities are listed on the Property or on the adjacent properties. Federal Emergency Response Notification System (ERNS) '!be Emergency Response Notification System (ERNS) is a national database used to collect information or reported release of oil or hazardous substances. No ERNS sites were listed on the Property. State Priority List The Department of Toxic Substances Control maintains a State Priority List (SPL) of sites considered to be actually or potentially contaminated and presenting a possible threat to human health and the environment. The Property is not listed as a SPL facility. No SPL sites are listed within one mile of the Property. ENVIRONMENTAL SITE ASSESSMENT NAC PROJECT NO. 03-16509.1 8 FREMONT INVESTMENT & LOAN NAC State CERCLIS-Equivale11t List The Department of Toxic Substances Control maintains a State CERCUS-equivalent list (SCL) of sites under investigation that could be actually or potentially contaminated and presenting a possible threat to human health and the environment. The Property is n~t listed as a State CERCUS facility. No SCL sites are listed within one- half mile of the Property. Solid Waste!La11dfill Facilities (SWLF) A database of SWLF is prepared by the Integrated Waste Management Board. The Property is not listed as a SWLF facility. No SWLF facilities are listed within one- half mile of the Property. State Leaking U11derground Storage Ta11k List (LUST) The Regional Water Quality Control Board compiles lists of all leaks of hazardous sub~tances from underground storage tanks. The Property is not listed as a LUST facility. Eight LUST sites are listed within one-half mile of the Property. Each of the eight LUST sites are listed as being closed to further action by the regulatory agency. Given the distance of these sites from the Property, in conjunction with the closed regulatory status, these sites are not considered evidence of a . recognized environmental condition in connection with the Property. State U11dergrou11d Storage Ta11k List (UST) The Regional Water Quality Control Board compile a list of UST locations. The Property is not listed as an UST facility. No registered UST facilities are listed adjacent to the Property. 3.1.2 Local Regulatory Review 3.1.2.1 County Recorder/ Assessor According the San Diego County Recorder's Office, no environmentally related hens or deed restrictions have been recorded against the Property in 2003. 3.1.2.2 Fire Officials Records from the San Diego County Environmental Health Department were reviewed for evidence indicating the presence of underground storage tanks and for the use of hazardous materials No record was found for the Property address. ENVIRONMENTAL SITE ASSESSMENT NAC PROJECT NO. 03-16509 .l 9 FREMONT INVESTMENT & LOAN NAC 3.1.2.3 Building Department and Planning Departments Records from City of Carlsbad Building Department were reviewed for evidence indicating the developmental history of the Property, and for the presence of documentation relative to underground storage tanks. The records indicate the current site structures were constructed in 1965. Prior land use was not indicated during the building pennit review. Information available from the City of Carlsbad Planning Department indicates that the Property is zoned for multi-family residential use. 3.2 Physical Setting Sources 3.2.1 Topography The United States Geological Survey (USGS), Carlsbad, California Quadrangle 7.5 minute series topographic map was reviewed for this ESA. This map was published by the USGS in 1961 and was photorevised in 1975. According to the contour lines on the topographic map, the Property is located approximately 50 feet above mean sea level (MSL). The contour lines in the area of the Property indicate the area is sloping gently downward to the west. The vicinity of the Property is denoted as urban land in the 1975 photorevision. The Buena Vista Lagoon borders the Property to the north. 3.2.2 Soils/Geology San Diego County is comprised of three distinct areas consisting of beach and adjacent coastal plain; high mountains containing generally narrow valleys; and, desert slopes plunging into a large, low-lying basin. These three sections are components of the two larger provinces: the coastal plain section and the mountain section belonging to the Peninsular Ranges Province, and the desert section being a part of the Salton Trough Province. According to the Geologic Map of California, San Diego-El Centro Sheet, published by the division of Mines and Geology (1962), the bedrock beneath the subject Property is Pleistocene age marine and marine terrace deposits. The marine deposits consist of a mixture of silty sands with interbedded layers of clay. The bedrock consists of light-gray and reddish-tan sandstone, siltstone and conglomerate. Depth to b~drock is estimated to be greater than !50 feet below grade. Based on the soil survey maps published by the USDA Soil Conservation Service (1973), the Property is mapped as the Marina Series. In a representative profile, the surface layer is loamy coarse sand about 10 inches thick. The subsoil is loamy coarse sand about 47 inches thick with the substratum a coarse sand. The soil exhibits rapid subsoil permeability. ENVIRONMENTAL SITE ASSESSMENT NAC PROJECT NO. 03-16509.1 10 FREMONT INVESTMENT & LOAN NAC 3.2.3 Hydrology According to the LUST database maintained by RWQCB, Region 9, groundwater is typically encountered at depths ranging from approximately 20-30 feet bgs during subsurface investigations in the vicinity of the Property. Based upon topography in the vicinity of the Property, the direction of groundwater flow is estimated to be towards the west No on-site water wells or springs were observed during the Property reconnaissance. 3.2.4 Flood Zone Information A review of the Flood Insurance Rate Maps, published by the Federal Emergency Management Agency, was performed. According to Panel Number 060285 0761 F, dated June 19, 1997, the Property is located in Flood Zone X. Flood Zone X regions consist of areas outside the I 00-year and 500-year floodplains. The distance to the nearest 1 00-year flood plain is approximately 400 feet to the north. 3.2.5 Oil and Gas Exploration The on-site reconnaissance addressed oil and gas exploration at the Property. According to the State of California, Department of Conservation, Division of Oil, Gas and Geothermal Resources, Regional Wildcat Map number Wl-4, no operating or abandoned oil or gas wells are on or adjacent to the Property. 3.3 Historical Use Information According to historical sources, the Property was primarily undeveloped prior to construction of the current improvements. However, the eastern portion of the Property contains small shed-like stmctures from 1932 untill953. The current improvements were constructed in 1965. The current Property buildings have not been utilized for envirorunentally sensitive purposes, such as photo developing or dry cleaning; rather, the tenants currently present at the Property have occupied them. 3.3.1 Aerial Photographs Available aerial photographs dated 1928, 1970, 1979, 1982, 1993 and 1996, from the County of San Diego Cartographic Services Department were reviewed for this ESA. Historical use of the Property was researched using other standard historical sources. 3.3.5 Additional Environmental Record Sources NAC was provided with a previous environmental assessment report related to the Property. The previous report was prepared by CTL Environmental Services, Inc. (CTL) and was dated June 2002. CTL identified the prior use of the Property as primarily undeveloped, but small shed-like structures were observed on the Property from 1932 until 1953. CTL conducted asbestos sampling and found the following materials to be positive for asbestos: exterior stucco, acoustical ceiling material, joint compound and various floor tiles/mastics. Lead was not detected on the painted surfaces tested. CTL observed limited visible mold growth in a single location, but the a!Tected area was reportedly removed and replaced with new drywalL CTL also inspected the wall cavity and did not observed visible mold growth at that time. CTL recommended a comprehensive asbestos and lead survey prior to conducting renovation or demolition activities at the Property. ENVIRONMENTAL SITE ASSESSMENT NAC PROJECT No. 03-16509. I 13 FREMONT 1NVESTMbNT & LOAN NAC 3.3.6 Historical Use Information on Adjoining Properties By review of the standard historical sources referenced above, the historical uses of the adjoining properties are summarized below: North: The adjoining property to the north has contained the Buena Vista Lagoon since at least 1928. South: The adjoining properties to the south were undeveloped prior to construction of the current multi-family residences. East: The adjoining properties to the east were undeveloped prior to the current use as a driveway and tennis court. West: The adjoining properties to the west were undeveloped prior to the current use as single-family residences. ENVIRONMENTAL SiTE ASSESSMENT NAC PROJECT NO. 03-16509.1 14 FREMONT INVESTMENT & LoAN NAC 4.0 SITE RECONNAISSANCE The Property was inspected by Drew Kerr, NAC representative, on October, I, 2003. The weather at the time of the site visit was sunny and clear. The on-site Manager, Cathy, provided site access aed accompanied NAC during the recOimaissance. NAC accessed l 0% of the apartment units. 4.1 General Site Characteristics The Property is located in a residential area that is characterized by single and multi-family residences. The Property is zoned for multi-family residential use by the City of Carlsbad. The Property consists of an irregular shaped parcel approximately three acres in size. The Property is designed and used for multi-family purposes. Currently, the Property is developed with four structures that were constructed in 1965. The structures at the Property are two stories in height. The Property offers a total of 51 apartment units. Access to the asphalt-surfaced Property parking lots on the northern western and eastern portions of the Property is provided from Ocean Street. Manicured landscaping is interspersed throughout the Property. No other structures or significant surface features were noted on the Property at the time of the reconnaissance. 4.1.1 Solid Waste Disposal Solid waste on the Property is collected in two 1 0-cubic yard dumpsters situated in fenced enclosures. The solid waste is collected once a week by the City of Carlsbad. The dumpsters were noted to contain miscellaneous cardboard at the time of the Property reconnaissance, and no indication of potentially hazardous material disposal was noted during NAC's reconnaissance. 4.1.2 Surface Water Drainage Surface water drainage from the Property is via sheet flow to the curb and gutter systems located along the surrounding streets and Buena Vista Lagoon. 4.1.3 Wells and Cisterns No aboveground evidence of wells or cisterns was observed during the site reconnaissance. 4.1.4 Wastewater No indications of industrial wastewater disposal or treatment facilities were observed during the onsite reconnaissance. 4.1.5 Additional Site Observations No additional relevant general Site characteristics were observed. ENVIRONMENTAL SITE ASSESSMENT NAC PROJECT NO. 03-16509.1 15 FREMONT INVESTMENT & LOAN NAC 4.2 Potential Environmental Conditions 4.2.1 Hazardous Materials and Petroleum Products Used or Stored at the Site No evidence of the use of hazardous materials or wastes was observed on the Property. 4.2.1.1 Unlabeled Containers and Drums No unlabeled containers or dmms were observed during the Property recormmssance. 4.2.1.2 Disposal Locations of Regulated/ Hazardous Waste No obvious indications of hazardous waste generation, storage or disposal were observed on the Property or were indicated during interviews. 4.2.2 Evidence of Releases No obvious indications of hazardous material or petroleum product releases, such as stained areas or stressed vegetation, was observed during the site reconnaissance or reported during interviews. Asphalt-paved parking areas exhibited de minimis surface staining due to automobile use. 4.2.3 Polychlorinated Biphenyls (PCBs) Older transformers and other electrical equipment could contain polychlorinated biphenyls (PCBs) at a level that subjects them to regulation by the U.S. EPA. PCBs in electrical equipment are controlled by United States Environmental Protection Agency regulations 40 CFR, Part 761. Under the regulations, there are three categories into which electrical equipment can be classified: • Less than 50 parts per million (PPM) ofPCBs-"Non-PCB" transformer • 50 ppm-500 ppm-"PCB-Contaminated" electrical equipment • Greater than 500 ppm -"PCB" transformer NAC observed three pole-mounted electrical transfom1ers on the Property. The units were not labeled as to their PCB status; however, they were labeled as owned by San Diego Gas & Electric Company. No indication of staining, leaks or fire damage was observed on or around the bases of these three units. No other electrical equipment expected to contain PCBs was observed on the Property during NAC's reconnaissance. 4.2.4 Landfills No evidence of on-site Jandfilling was observed or reported during the site reconnaissance. ENVIRONMENTAL SiTE ASSESSMENT NACPROJECTNO. 03-16509.1 16 FREMONT INVESTMENT & LOAN NAC 4.2.5 Pits, Ponds, Lagoons, Sumps, and Catch Basins No evidence of on-site pits, ponds, lagoons was observed or repotted during the site reconnaissance. No evidence of sumps or catch basins, other than used for stormwater removal, was observed or reported during the site reconnaissance. 4.2.6 On-Site ASTs and USTs No evidence of aboveground or underground storage tanks was observed during the Property reconnaissance or reported during interviews. 4.2. 7 Radiological Hazards No radiological substances or equipment was observed or reported stored on the Property. 4.2.8 Drinking Water The Property is connected to the city water supply provided by the City of Carlsbad. According to a water quality report dated 2002, the drinking water supplied to the Property is within state and federal standards, including lead and copper. In accordance with the Fremont ESA scope of work, NAC conducted sampling of the potable (tap) water at three kitchen locations in the buildings for the presence oflead. A total of nine water samples were obtained from three locations in the building (locations shown on the table below). The samples were obtained in a sequence of first draw, 30- second draw, and five-minute draw. Following collection, the samples were transferred via chain of custody to Sci Lab California, Inc. (SciLab) for lead analysis via USEP A Method 200.7. Based on the results shown below, none of the samples revealed the presence of lead .in drinking water in excess of the EPA recommended level of 15 parts per billion (ppb ). While a minor detection of lead was detected in the first draw sample in Unit 40, it was below the EPA drinking recommended level, and was absent in the subsequent samples. Following visual observation, NAC conducted limited sampling of suspect ACM. The objective of this visual survey was to note the presence and condition of suspect ACM observed. Based on the date of constmction (1965) there is a potential that ACM was used in construction materials. In addition, the Occupational Safety and Health Administration (OSHA) regulation 29 CFR 1926.1101, requires certain construction materials to be presumed to contain asbestos, for purposes of this regulation. All thermal system insulation (TSI), surfacing material, and asphalt/vinyl flooring that are present in a building constructed prior to 1981 and have not been appropriately tested are presumed asbestos containing material (PACM). The limited survey consisted of noting observable materials (materials which were readily accessible and visible during the coU<·se of the site reconnaissance) that are commonly known to potentially contain asbestos. This activity was not designed to discover all sources of suspect ACM, P ACM, or asbestos at the Property; or to comply with any regulations and/or laws relative to planned disturbance of building materials such as renovation or demolition, or any other regulatory purpose. Rather, it is intended to give the lender an indication if significant (significant due to quantity, accessibility, or condition) potential sources of ACM or P ACM are present at the Property. Additional sampling, inspection, and evaluation will be warranted for any other use. A previous ESA report prepared by CTL Environmental Services, Inc. (CTL) and dated June 2002 identified asbestos in the following building materials a the Property: exterior stucco, acoustical ceiling material, joint compound and various floor tiles/mastics. No building plans or specifications, which may be useful in determining areas likely to have used ACM, were made available for review. The following table represents a summary of suspect ACM observed/sampled in this facility. All observed and sampled suspect or confirmed ACM were noted to be in good conditions at the time of the reconnaissance. Consistent with cn:s 2002 findings, NAC has confinned the presence of asbestos in acoustical ceiling material, joint compound (trace concentrations detected), and vinyl flooring and associated mastics). Prior to any disturbance of the construction materials within this facility, a comprehensive ACM survey is recommended. 4.2.11 Radon The US EPA has prepared a map to assist National, State, and local organizations to target their resources and to implement radon-resistant building codes. The map divides the country into three Radon Zones, Zone I being those areas with the average predicted indoor radon concentration in residential dwellings exceeding the EPA Action limit of 4.0 picoCuries per Liter (pCi/L). It is important to note that the EPA has found homes with elevated levels of radon in all three zones, and the EPA recommends site specific testing in order to determine radon levels at a specific location. However, the map does give a valuable indication of the propensity of radon gas accumulation in structures. Review of the EPA Map of Radon Zones places the Property in Zone 3, where average predicted mdon levels are less than 2.0 pCi/L As such, radon sampling was not conducted or warranted as part of this assessment. ENVIRONMENTAL SITE ASSESSMENT NAC PROJECT NO. 03-16509.1 19 FREMONT INVESTMENT & LOAN 42 40 NAC 4.2.12 Lead-Based Paint At the request of the Client, limited qualitative lead screening was performed on selected painted surfaces at the Property. The purpose of this screening was to gather qualitative information that may indicate the presence of lead on selected painted surfaces. Quantitative lead analysis should be performed by a qualified firm in order to confirm the results indicated herein. This screening is not designed to meet the requirements of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (Title X), or any other applicable regulatory requirements; rather, it is intended to give the Lender an indication of the likelihood that lead-based paint is present. The property falls under the definition of Target Housing, and is regulated under Title X. Regardless of the findings of this limited screening, the seller or renter of the property is required to make available a federally approved lead hazard information pamphlet and must disclose known lead- based paint and/or lead-based paint hazards to purchasers and renters of the property pursuant to the requirements of24 CFR 35.92 and 40 CFR 745.113. Selected painted surfaces were screened for the presence of lead by applying a colorimetric lead-sensitive chemical (Lead Check) to the painted surface. If the color of the applicator turns pink, the screen is positive, and the presence of lead is indicated. The following table presents the painted surfaces that were screened for the presence of lead. If a definitive investigation is desired, a quantitative lead-based paint inspection in conformance with Title X Guidelines will yield a comprehensive analysis of conditions. 4.2.13 Mold As part of this assessment, NAC performed a limited visual inspection for the significant presence of mold. A class of fungi, molds have been found to cause a variety of health problems in humans, including allergic, toxicological, and infectious responses. Molds are decomposers of organic materials, and thrive in humid environments, and produce tiny spores to reproduce, just as plants produce seeds. When mold spores land on a damp spot indoors, they may begin growing and digesting whatever they are growing on in order to survive. When excessive moisture or water accumulates indoors, mold b'l'Owth will often occur, particularly if the moisture problem remains undiscovered or unaddressed. As such, interior areas of buildings characterized by poor ventilation and high humidity are the most common locations of mold groMh. Building materials including drywall, wallpaper, baseboards, wood framing, insulation and carpeting often play host to such growth. NAC observed interior areas of the Property structures for the presence of significant presence of mold, concentrating on areas of likely water intrusion. NAC did not note obvious visual or olfactory indications of the presence of mold, nor did NAC observe obvious indications of significant water damage. As part of their May 28, 2002 Property reconnaissance, CTL observed limited "surficial" mold in the bathroom of Apt. 29. The affected drywall was reportedly removed on May 30, 2003 and replaced with new drywall. CTL also inspected the wall cavity and did not observe visible mold gro\Vth or water damage at that time. Based on this account and the condition of the Property at the time ofNAC's reconnaissance, there do not appear to be a mold issues warranting further investigation at the Property. As such, no bulk sampling of suspect surfaces was conducted as part of this assessment. This activity was not designed to discover all areas which may be affected by mold grov.1h on the Property. Rather, it is intended to give the client an indication if significant (based on observed areas) mold growth is present at the Property. Additional areas of mold not observed as part of this limited assessment, possibly in pipe chases, HV AC systems and behind enclosed walls and ceilings, may be present on the Property. Findings from these interviews are discussed in the appropriate sections in this report. SITE ASSESSMENT NAC PROJECT NO. 03-!6509.! 23 FREMONT INVESTMENT & LOAN NAC 6.0 FINDINGS AND CONCLUSIONS 6.1 Findings 6.1.1 On-Site Environmental Conditions No on-site recognized environmental conditions were identified during the course of this assessment. While not considered a REC by ASTM criteria, the following issue warrants mention: • Suspect and previously-confirmed asbestos containing materials were observed at the Property. Previously confirmed ACM includes exterior stucco, acoustical ceiling material, joint compound and various lloor tiles/mastics. These materials were confinned as asbestos containing during NAC's limited sampling performed as part of this assessment. Additional suspect ACM observed by NAC includes roofing materials and penetration mastics. A11 suspect and confirmed ACM was noted to be in good condition at the time of NAC's reconnaissance, and these materials can be maintained in place under the provisions of an operations and maintenance (O&M) plan. 6.1.2 Off-Site Environmental Conditions No offsite environmental conditions were identified that were considered likely to impact · the Property. 6.1.3 Previously Resolved Environmental Conditions No historical recognized environmental conditions were identified in connection with the Property during the course of this assessment. 6.1.4 De Minimis Environmental Conditions No de minimis environmental conditions were identified in connection with the Property during the course of this assessment. 6.2 Conclusions NAC has perfonncd a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E 1527-00 of 2303 Ocean Street, Carlsbad, California, the Property. Any exceptions to or deletions from this practice are described in Section I .4 of this report. Additionally, comprehensive asbestos sampling should be performed prior to any disturbance or demolition of suspect ACM at the Property. 6.4 Deviations This Phase I ESA complies with the scope of services and ASTM 1527-00, as amended, except for exceptions and/or limiting conditions as discussed in Section 1.4.
