used by the State,local agencies and developers to comply with the California
Environmental Quality Act requirements in providing information about the location of
hazardous materials release sites.Government Code section 65962.5 requires the

RESPONSES TO ITEMS NUMBERED 26, 32,&33.
26.Hillside project, however the site has been developed for more that 60 years.
32.a.The site lies between Adams Street and the shoreline of Agua Hedionda Lagoon.
b.The lot slopes from Adams St. at an elevation of approx. +56' to the water, and has various
trees and bushes scattered about the lot.
c.The existing driveway enters from Adams St. and runs down the west side of the property all
the way to the boat ramp leading into the water.The new driveway will follow approx. the
same path down to the Boat Ramp.
d.The site is presently occupied by a 3-story frame structure, which will be demolished.
e.The main level, (approx. 3000 sq.ft.),has been used as a restaurant for more that 40 years.
f.The upper level has been used as rental apartments for more than 40 years.
g.The lower level has the bathrooms and storage area for the existing Boat Club which has been
in operation for approximately 20 years.

33. a.All land located to the West and to the East of this subject property that is on the south side of
Adams Street, extends from the street to the waters of Agua Hedionda Lagoon.
b.The 3 lots adjacent to the West side of this lot are undeveloped raw land.
c.The 2 lots to the North (across the street) have large one & two story single family
residences.
d.The lot adjacent to the East side of this lot was down-zoned from RT and contains a very, very
large, (approx. 8,500 sq.ft.) single family residence, with 10' setback on each side.
e.The two lots, (approx. 5'A acres)just east of the above lot, were down-zoned from Med./High
Density Residential, and combined into a Planned Unit Development containing three very
large estate lots with large single family residences,a tennis court and private boat ramp.
f.The property to the East of the above mentioned property is Bristol Cove.Bristol Cove is a
large development of multi-story, high density, condominiums, surrounding a narrow water
inlet on the north shore of the lagoon.

We are currently amending the building plans for the Carlsbad Boat Club and have
eliminated the need for the variance to address the portion of the structure exceeding the
height of the adjacent roadway.On September 19,2007 I had submitted to you for the
owners a check in the amount of $5,720.That check covered two costs.The variance
portion of that check was $2,560.We also included a special use permit for scenic corridor
at $3,160.
As indicated, because we now have re-designed the building and will not need the variance,
we ask for a refund for that portion of our application.
