REQUEST: APPROVAL OF A 1 LOT, 6 DWELLING
UNIT CONDOMINIUM PROJECT.
SECTION I: RECOMMENDATION
Staff recommends APPROVAL of Carlsbad Tract 77-4 for the following
reasons and subject to the following conditions:
FINDINGS
1) The proposed map is consistent with the General Plan because:
a) The Land Use Element designates the site for residential
land use at 20-30 dwelling units per acre. The project
provides about 20 dwelling units per acre.
2) The design or improvement of the proposed subdivision is consis-
tent with the General Plan because:
a) The project will provide orderly residential development; and
b) The project will not cause excessive expansion of public
facilities and/or expense to the taxpayer.
3) The site is physcially suitable for the type of development
because:
a) The site is an existing lot; and
b) All significant public improvements are existing including
street improvements.
4) The site is physically suitable for the proposed density of
development because:
a) Dwelling units to be provided per acre are consistent with
General Plan density; and
b) All pre-building site preparation has been accomplished
previ ously.
5) The design of the subdivision or the imposed improvements are
not likely to cause substantial environmental damage or sub-
stantially and unavoidably injure fish or wildlife or their
habitatbecause:
a) A negative declaration has been issued for the project
based on the following findings:
1) The project is surrounded by urban development;
2) Public facilities are adequate to serve the project; and
3) The project has been reviewed and approved by the
Coastal Commission.
6) The design of the subdivision or the type of improvements are not
likely to cause serious public health problems because:
a) Conditions of approval will insure adequate public health
facilities; and
b) Public sewer and water facilities are available to the site.
7) The design of the subdivision or the type of improvements will
not conflict with easements required by the public at large for
access through or use of property within the proposed subdivision
because:
a) No such easements are required.
8) The subdivision will not prohibit reasonable access to public
waterways, rivers, streams, lakes, reservoirs, coastlines or
shorelines because:
a) Public access to the beach already exists.
CONDITIONS :
1) The approval is granted for the land described in the application
and any attachments thereto and as shown on the plot plan submitted
labeled Exhibit A, dated January 31, 1977.
2) Park-in-lieu fees shall be paid to the satisfaction of the Parks
and Recreation Director prior to final map approval.
3) A landscape and irrigation plan shall be approved by the Parks
and Recreation Director prior to the issuance of building permits
and all landscaping and irrigation will be installed prior to
final occupancy.
4) No vehicular access shall be permitted along Carlsbad Boulevard.

The 12,988.25 sqaure foot parcel is located at the northeast corner
of Maple Avenue and Carlsbad Boulevard. The parcel is generally
rectangular in shape and lies across Carlsbad Boulevard from the
recently improved stretch of Carlsbad State Beach.

COMMON INTEREST SUBDIVISION GENERAL INFORMATION
The project described in the attached Subdivision Public Report is known as a common-interest
subdivision. Read the Public Report carefully for more information about the type of subdivision.
The subdivision includes common areas and facilities which will be owned and/or operated by an
owners' association. Purchase of a lot or unit automatically entitles and obligates you as a member of
the association and, in most cases, includes a beneficial interest in the areas and facilities. Since
membership in the association is mandatory, you should be aware of the following information
before you purchase:
Your ownership in this development and your rights
and remedies as a member of its association will be
controiled by goveming instruments which generally
include a Declaration of Restrictions (also known as
CC&R's), Articles of Incorporation (or association) and
Bylaws. The provisions of these documents are intended
to be, and in most cases are, enforceable in a court of law.
Study these documents carefully before entering into a
contract to purchase a subdivision interest.

is "you". Unless you serve as a member ofthe governing
board or on a committee appointed by the board, your
control of the operation of the common areas and
facilities is limited to your vote as a member of the
association. There are actions that can be taken by the

quality of life for association members.
In order to provide funds for operation and
maintenance of the common facilities, the association
will levy assessments against your lot/unit. If you are
delinquent in the payment of assessments, the association
may enforce payment through court proceedings or your
lot/unit may be liened and sold through the exercise of a
power of sale. The anticipated income and expenses of
the association, including the amount that you may
expect to pay through assessments, are outlined in the
proposed budget. Ask to see a copy of the budget if the
subdivider has not already made it available for your
examination.
A homeowner association provides a vehicle for the
ownership and use of recreational and other common
facilities which were designed to attract you to buy in this
subdivision. The association also provides a means to
accomplish architectural control and to provide a base
for homeowner interaction on a variety of issues. The
purchaser of an interest in a common-interest subdivision
should contemplate active participation in the affairs of
the association. He or she should be willing to serve on
the board of directors or on committees created by the

or units in a common-interest subdivision to elect a
majority of the goveming body, it is likely that the
subdivider will effectively control the affairs of the
association. It is frequently necessary and equitable that
the subdivider do so during the early stages of

subdivider to resident-owner control be accomplished in
an orderly manner and in a spirit of cooperation.
When contemplating the purchase of a dwelling in a
common-interest subdivision, you should consider
factors beyond the attractiveness of the dwelling units
themselves. Study the governing instruments and give
careful thought to whether you will be able to exist
happily in an atmosphere of cooperative living where the
interests of the group must be taken into account as well
as the interests of the individual. Remember that
managing a common-interest subdivision is very much
like governing a small community . . . the management
can serve you well, but you will have to work for its

Our district has reviewed the proposed 6-unit apartment building
generally located at the northeast corner of Carlsbad Boulevard and Maple
Avenue as referenced above and has evalxiated the impact of that develop-
ment on the facilities of our district.
The Governing Board wishes to advise the City officials and the
residents of Carlsbad that as residential units are added to the community,
it is likely that many classes in the district will be crowded, resulting
in possible impairment to the educational and transportational services
offered to the students. It is also likely that school schedules may have
to be changed, resulting in an increase in the year-round school program, or
double sessions, or both. However, the district is able to assure you that
school physical facilities will be available concurrent with need for this
development as it is presently proposed.

'ENTATIVE 'SUBDIVISION MAP<
Subdivision and development shall meet all requirements of the
subdivision, zoning, building codes, and General Plan and other
laws, ordinances or regulations of the Dity of Carlsbad, and other
governmental agencies. Some-of the more pertinent requirements
and procedures of the City are listed below for your information
and concurrence. Please read this list carefully and feel free
to ask for further information or explanation.
1. Final Map shall be completed within.18 months from the
date of final City Council action on the Tentative
Subdivision Map. Two. extensions of one-year each may
be approved by City Council upon staff review of the
original decision.
2. The Final Map shall substantially conform to the
Tentative Subdivision Map. If otherwise, the Final Map
will be rejected a'nd new Tentative Subdivision Map
, hearings will be required for the revised plan.
3. ' All public improvements shall be made in conformity with the c
• Subdivision Ordinance and other City Standards, to the satis-
faction of the City Engineer, without cost to the City of
Carlsbad and free of all liens and encumbrances.
4. Prior to any construct.ion, the applicant shall submit plans
to the*appropriate entity providing domestic water to the
proposed development, for its approval of the location,
type and adequacy of water lines.
5. Prior to any construction, the applicant shall obtain approval
from the City F.ire Department of the location and size of
fire hydrants.
6. The applicant shall install all required- fire hydrants and
-dry-stand pipes prior to framing construction, and said
fire appurtenances shall be functional prior to commencing
such work.
7. Street trees, as required by the City, shall be installed
by the applicant at his expense. Trees shall be of a
type approved by the Parks Department and shall be installed
to their specifications. 'If removal of any existing trees
is .required by "the City, said removal shall be at the
applicant's expense. It shall be the responsibility of
the applicant to make all arrangements with the Parks
Department concerning the requirements of this condition.

8. A detailed grading plan which includes proposed drainage
and erosion control landscaping and for other measures
such as desilting basins shall be approved by the City
Engineer prior to Final Map.
9. - Immediately after grading, erosion control landscaping
and/or other measures such as desilting basins shall
be installed. This control may be the final landscaping.
if so approved.
10. A detailed landscape and sprinkler plan shall be sub-
mitted for PIanning.Director's approval for all graded
slopes 5' or greater in height and any other areas re-
quired by the City,
Prior to final building inspection clearance, all land-
scaping shall be installed or adequate bonding accepted.
Said landscaping shall be maintained in a manner accept-
able to the Planning Director.

PROCEDURES
1) Application to Planning Commission: In an effort to aid the
applicant, the Planning Department requests that it be given
• an opportunity to evaluate and discuss the application in its
various stages of development prior to submittal. It is more
effective if applicant meets directly with staff; however,
written or telephone comm.unication'is acceptable. It is the
responsibility of the applicant to make the initial contact
for such meeting.
2) Submittal; Application will be accepted only if the applica-
tion, plans and other pertinent materials are complete.
Generally, the date application will be heard will be deter-
mined By the submittal date as indicated within the approved
planning Commission calendar.
r3) Planning Commission Calendar: The'Planning Commission adopts
an annual calendar that indicates application closing dates,
staff review dates, staff report completion dates, and Plan-
ning Commission hearing dates. You may acquire this calendar
at the Planning Department.
4) Staff Review: On the date as indicated on the Planning Commission
Calendar, City Staff conducts a review meeting on all items on
the Planning Commission agenda. The applicant is invited to
attend and to explain the project and respond to staff preliminary
recommendations. Upon completion of this review. Staff will pre-
pare final staff recommendations to be submitted to the Planning
Commission. The final report with recommendations will be
available at the Planning Department five days prior to the
Planning Commission hearing (Friday afternoon prior to the
Planning Commission meeting date).
5) Heari ng: The Planning Commission meets every 2nd and 4th
Wednesday of the month at 7:30 p.m. or as indicated on the
Planning Commission calendar. Depending on the type of appli-
cation, the Planning Commission will either make a finding
and forward to City Council ot make final action.
6) Appeal s': Final action by Planning Commission may be appealed
to the City Council, provided such appeal is filed within ten
(10) days after the Planning Commission action. The applicant
should review with staff the procedure on the various types of
applications.
7) Final Decision: The City will notify the applicant and property
owner of the final decision.
