The site is characterized by gently rolling ridges, deep canyons
and varied, native vegetation. There are excellent views to the
ocean and back country from most areas of the site.
The project will provide for 92 large view estate lots. Arch-
itectural guidelinwill restrict the design of each house to
the Spanish Colonial Revival style. This style will also carry
through to the landscaping of each home site and the streetscape.
In order to develop this concept to its full potential, a planned
unit development concept is required...
- to protect the site's unique environment.
- to allow for imaginative and innovative planning.
- to incorporate a system of setbacks which will allow for
a variety in the streetscape and house location.
CIRCULATION
Corintia Street (public) bisects the site into two areas. Access
to each will be by a private street through a controlled entry gate.
The street network will minimize paving -and promote a "country"
environment by providing for a varied streetscape of dense veg-
etation alternating with views from the ridges.
An elaborate security system will screen all visitors and provide
immediate response to any emergency.
OPEN SPACE AREAS/RECREATIONAL FACILITIES
The project will provide extensive equestrian trails, common
open space areas and possible future recreational facilities
as noted on the P.U.D. Plan. The preservation and maintenance
of these areas will be provided by a homeowners association.
SPECIAL DEVELOPMENT STANDARDS
The proposed Planned Unit Development will be designed in accord-
ance with Section 21.45.120 and 21.45.110.
In order to develop the full potential for the architectural
style, special setback conditions are requested:

This system of setbacks will allow a house to be located closer

access and driveway sight lines.

The site of the proposed development is on hilly terrain
overlooking the San Marcos Creek Basin. The prime topographical
characteristics of the area are of rolling eroded mesas and
ridges which fall sharply into steep ravines, side canyons and
the San Marcos Creek Canyon. The land forms fold and expand
and offer everchanging vistas as one moves through.
Coastal sage scrub and chapparal provide a low profile cover
over the site. Native plants over six feet in height are
few and present little relief from this cover.
The proposed plantings to be introduced for this environment
will, as much as possible, reflect the natural landforms, be
compatible with those chapparal belts preserved, and meet the
necessary requirements and amenities of the residential
developments. We intend to use large numbers of Eucalyptus
throughout the site as a unifying fabric of loose and random
nature which will provide the rural character sought for the
development. This concept is in keeping with the vast
plantings of Eucalyptus found throughout the San Diego Region.
Landscape treatment at the La Fuerte Avenue edge will respect
the private custom home sites across the street by the
installation of turf where possible and the supplementation
of the existing street tree, Podocarpus gracilior. Where
equestrian, trails border this edge, they will be guided by
low cedar pole fences. As a transition to the chapparal
beyond, large California Peppers and Cajeput trees will be
planted. These same trees will be planted within the site
at the intersections of secondary roads, gateways median
strips and as accents. It is our intent to provide a variety
of visual experiences as one travels the roads within the
site. At places, the plantings will close in and envelope,

at others it will open and expand toward views. The tree
plantings will be supplemented with an understory of shrub
massings of colorful Oleander, Photinia and Bougainvillea.
An integral part of the landscape development is the concept
of open meadow land.
To isolate the home sites from the flammable chapparal, we
propose large open areas of low grasses and fire retardant
perennials and sub-shrubs. These areas will also present
ground-plane continuity for the project and erosion control.
Within this meadow,between the home sites, we recommend the
planting of large shrub screens of Oleander, Photinia and
Acacia to visually separate the houses.
To complement the early California "Rancheros" theme of the
project, a list of appropriate plants will be included in
the restrictive covenants of the deeds. These plants will
provide choices for each homeowner to landscape the immediate
environs of his house. Among these will be Bougainvillea,
Oleander, Jasmine, Hibiscus, Palms, etc.
With the exception of a few, lots will open to the equestrian
trail systems which wind through the site.
The majority of the trails occurs within draws or small canyons
where stands of California Sycamores and Alders will be
planted to enhance the riding experience and provide visual
texture from the houses.
In conclusion, it is our desire to provide a balanced and
sensitive relationship between the man-built form of environ-
ment and the natural. Such aspirations involve strong
coordinated efforts among the consultants, architect and the
developers.
We are pleased to submit the schematic concept development and
look forward to furthering this effort.

STATEMENT OF AGREEMENT
TENTATIVE SUBDIVISION MAP
CITY OF CARLSBAD
The.-Subdivision Map Act and the Carlsbad Municipal Code sets a
fifty (5O) day time restriction on Planning Commission processing
of Tentative Maps and a thirty (30) day time limit for City
Council action. These time limits can only be extended by the
mutual concurrence of the applicant and the City. By accepting
applications for Tentative Maps concurrently with applications
for other approvals which are prerequisites to the map; i.e.,
Environmental Assessment, Environmental-Impact Report, Condominium
Plan, Planned Unit Development, etc., the fifty (50) day time
limits and the thirty (30) day time limits are often exceeded.
If you wish to have your application processed concurrently,
this agreement must be signed by the applicant or his agent. If
you choose not to sign the statement, the City will not accept
your application for the Tentative Map until all prior necessary
entitlements have been processed and approved.
The undersigned understands that the processing time required by
the City may exceed the time limits, therefore the undersigned
ag±ees to extend the time limits for Planning Commission and
City Council action and fully concurs with any extensions of
time up to one year from the date the application was accepted
as complete.to properly review all of the applications.

STANDARD CONDITIONS
CITY OF CARLSEAD
TENTATIVE SUBDIVISION MAP
Suhdivis±iDn and development shall meet all requirements of the
subdiisiion, zoning, building codes, and-General Plan and other
laws, ondinances or regulations of the City of Carlsbad, and other
governmental agencies. Some of the more pertinent requirements
and procedures of the city are listed below for your information
and concurrence. Please read this list carefully and feel free to
ask for further information or explanation.
1. Final map shall be completed within 18 months from the date
of final City Council action on the tentative subdivision map.
Two extensions of one year each may be approved by City Council
upon staff review of the original decision.
2. The final map shall substantially conform to the tentative
subdivision map. If otherwise, the final map will be rejected
and new tentative subdivision map hearings will berequired for
the revised plan. -
3. All public improvements shall be made in conformity with the
subdivision ordinance and other city standards, to the
satisfaction of the City Engineer, without cost to the City of
Carlsbad and free of all liens and encumbrances.
4. Prior to any construction, the applicant shall submit plans
to the appropriate entity providing domestic water to the
proposed development, for its approval of the location, type
and adequacy of water lines.
5. Prior to any construction, the applicant shall obtain approval
from the City Fire Department of the location and size of
Lire hydrants.
6. The applicant shall install all required fire hydrants and
dry-stand pipes prior to .framing construction, and said fire
appurtenances shall be functional prior to commencing such
work,
7. Street trees, as required by the city, shall be installed by
-the applicant at his expense. Trees shall be of a type approved
by the Parks Department and shall be installed to their
specifications. If removal of any existing trees is required
by the city, said removal shall be at the applicant's expense.
It shall be the responsibility of the applicant to make all
arrangements with the Parks Department concerning the
• requirements of this condition.
-8. A detailed grading plan which includes proposed drainage and
erosion control landscaping and for other measures such as
desilting basins shall be approved by the City Engineer prior
to final map.
9. Immediately after grading, erosion control landscaping and/or
other measures such as desilting basins shall be installed.
This control may be the final landscaping, if so approved.
10. A detailed landscape and sprinkler plan shall be submitted for
Planning Director's approval for all graded slopes 5' or
greater in height and any other areas required by the city.
11. Prior to final buildinq inspection clearance, all landscaping
shall be installed or adequate bonding accepted. Said
landscaping shall be maintained in a manner acceptable to the
Planning Director.

12. No signs or advertsinq of any type whatsoever shall be erected
or installed until plans thereof have been approved by the
City of Carlsbad.
As part of the approval process, the city may modify these conditions
or add others, especially those of a more specific nature. The
subdivider will be notified of these modifications or additions by
resolution.

PROCEDURES
I) Application to Planning Commission: In an effort to aid the
applicant, the Planning Department requests that it be given an
opportunity to evaluate and discuss the application in its. various
stages of development prior to submittal. It is more effective if
applicant meets directly with staff; however, written or telephone
communication is acceptable. It is the responsibility of the
applicant to make the initial contact for such meeting.
2) Submittal: Application will be accepted only if the application,
plans and other pertinent materials are included.
3) Review: After accepting the application staff will submit it to
the department review board (DCC) to ascertain if further information
is necessary. Staff will attempt to conclude this review within
two weeks, but in no case shall the review period be longer than
30 days from receipt of application.
4) Notice; Upon completion of the application review, the applicant
will be informed by letter if further information is required if
any,ôr if the application is complete what date it will be heard
by the Planning Commission.
5) Planning Commission Calendar: The Planning Commission adopts an
annual calendar that indicates application closing dates, staff
review dates, a staff recommended review dates as well as Planning
Commission hearing dates. Thedate your request will be heard is
selected from this calendar. You may acquire this calendar at the
Planning Department.
6) Staff Review: Staff prepares a report for the Planning Commission.
This report is reviewed by the Departmental Coordinating Committee
(DCC), which is made up of representatives from .the departments of
Planning, Engineering, Fire, City Manager and other as may. be
necessary. You are invited to this meeting to explain the project
and respond to staff recommendations. Upon completion of this
review, staff will prepare final staff recommendations to be sub-
mitted to the Planning Commission. The final report with rec-
orurnendatins will be avaiable at the Planning Department five days
prior to the Planning Commission hearing (Friday afternoon prior to
the Planning Commission meeting date).
7) Hearing: The Planning Commission meets every 2nd and 4th Wednesday
f the month at 7:00 P.M., or as indicated on the Planning
Commission calendar. Depending on the type of application, the
Planning Commission will either make a recommendation and forward
to City Council or take final action.
8) .ppeals: Final actions by the Planning Commission may be appealed
to the City Council, provided such appeal is filed within ten
(10) days after the Planning Commission action. The applicant
should review with staff the procedure on the various types of
appliations.
9) Final Decision: The City will notify the applicant-and property
owner of the final decision.

WHEREAS, Developer proposes a development project as follows:.
A Tentative Map to allow development of 92 residential lots

on said Property, which development carries the proposed name
of Rancheros De La* Costa
and is - hereafter referred to as "Development"; and .
WHEREAS, Developer filed on the 5th day of November .
1980, with the. City a request for Tentative Map •.
- (hereinafter referred to as Request"; and-
WHEREAS, the Public Facilities Element of the City General
Plan requires that-the City Council find that all public
facilities necessary to sevé a development will be-available
concurrent with need or such development shall not be approved
(said element is on file with the City Clerk and is incorporated

WHEREAS, Developer and City recognize the correctne of
- Council Policy . 17 ; dated August 29, 1979, on file with the City Clerk and
-Incorporated by this reference, and that, the City's public facilities and services
are at capacity and will not be available to accommodate the
additional need for public facilities and services resulting
from the proposed Development; and ... .
WHEREAS, Developer has asked the City -o find that public
. facilities and services will be available to meat the future
needs of the Development ,as it is presently proposed; but the
• Developer is aware that the City cannot and will not be ble•to
make any such finding without-,financial assistance to pay for
such services and facilities; and, therefore, Developer proposes

to help satisfy the General Plan as imp1mented by Council Policy
No, 17 by payment of a public facilities feet
NOW, THEREFORE, in consideration of the recitals and the
covenants contained herein, the parties agree as follows:
1, The Developer shall pay to the City a public fa'cilities
fee in an amount not to exceed 2% of the building permit valuation
of the buildings or structures to be constructed in the Development
pursuant, to the Request. The fee shall be paid prior to the
issuance of building or other construction permits for the develop
ment and shall be based on the valuation at that time. This fee
shall he in addition to any fees, dedications or improvements

required pursuant to Titles '18, 20 or 21 of the Carlsbad Municipal
Code. A credit toward such fee shall, be given 'for land which has
been dedicated fQr park purposes or for any fees paid in lieu
thereof pursuant to Chapter 20.44 of the Carlbad Municipal Code,
Developer shall pay a fee conversion of existing buildings or
structures into condominiums in an amount not to exceed 2% of the
building permit valuation at the time of conversion. The fee for a
condominium conversion shall he paid prior to the issuance of 'a
condominium conversion permit' as provided in 'Chapter 21.47 of the
• Carlsbad Municipal Code. Condominium shall include community
apartme'it or stock cooperative The terms "othe construction
permits", *other construction permit" and "entitlement for use" as
used in this agreement, except in reference to rnobilcho'rne sites or
projects, shall not .refer to grading permits or other permits for
the construction of underground or street improvements unless no
other permit is necessary prior to' the use or occupancy for which

the development is intended. Developer shall pay to City a pubii
facilities fee in the sum of $1,150 for each mobilehome space to be
- constructed pursuant to the Request. The fee shall he paid prior
to the issuance of building or other construction permits for the
development. This fee shall be in addition to any fees, dedications
or improvements required according to T±€]s 18, 20 or 21 of .the
Carlsbad Municipal Code. A credit toward such fee "shall' be given
for -laid which has been dedicated for park purposes or for any fees
paid in lieu thereof pursuant to Chapter 2'0.44 of the Carlsbad
Municipal Code. .
2. The Developer may offer to donate a site or sites for
public facilities in lieu of all or part of the financial obligation
agreed upon in Paragraph 1 above. If 'Developer offers to
• donate a site or sites for public facilities? the City shill
'donsider, but is not obligated to accept the offer The tLrie for
donation and amount of credit against the fee shall he determined
• by dity prior to the issuance of any building or other permits.
Such determination, when made, shall become a part. of this agree-
nient. Sites donated under this paragraph shall not include improvements
required pursuant to Titles 18 or 20 of the Carlsbad Municipal

eguired to ensure, the consistency of the Development with the
City's General Plan, If the fee is not paid as provided herein,
• the City will not have the funds to provide public facilities and
services, and the Development will not be consistent with the
General Plan and any approval or permit for the Development shall

be void. No building or other construction permit or entitleraen±

4. City agrees to deposit the fees paid pursuant to this
agreement in a public facilities fund for the financing of public :
facillities when the City Council determines the need exists to
provide the facilities and sufficient funds from the payment of
this and similar public facilities fees are available.
• 5. City agrees to provide upon reqëst reasonable assurances
to enable Developer to comply with any reuirements of other ublic
agencies as evidence of.adequaté public facilities and services
ufficient to accommodate the needs 'of the Development herein
described.

the Requests made by Developer are not apprQyed,.
.7. Any notice from .one party to the other shall be in

thereof to the City or by depositing same-in the United States

enclosed in a sealed envelope, addressed to the City for attention

8. This agreement shall he binding upon and shall inure to
the benefit of, and shall apply to, the respective successors and
assigns of Developer.and the City, and references to Dveloper
or City herein shall be deemed to be reference to and include thei
respective successors and assigns without specific mention of such
successors. and assigns. If Developer should cease to have any
interest in the Property, all obligations of Developer hereunder
shall terminate; provided, however, that any successor of Develop.er's
• interest in the Property shall have first assumed in writing the
Developers obligations hereunder.
9. This agreement shall he recorded but shall not create
a lien or security interest on the Property. When the obliations
of this agreement have been satisfied, City shall record a release.

City Council Policy Number 17 requiris that all developers
• requesting a discretionary action for a, project pay a public
.facilities fee in the amount. of two-percent of the building
valuation. The fee is computed by the Building Department and
• paid at the time the building permit is obtained. In the case
of a coridc;rui niurn conversion, the fee is calculated on the
building valuation at the time the fee is •paid and the fee must
he paid prior to obtaining-a final map on the project.
In addition to the aboVe, a completed, signed and no-tarized
agreement to pay the public facilities fee must be submitted
with any application for a discretionary action. This agçeernent
form should be completed as follows:
1. Selected the appropriate form for either (a) the developer
and owner are the same party, or (b) the developer and owner
• are different. -
2. Fill in the date the a9reernent i completed, the name and,
address of the- developer (and owner, if appropriate) and
state if each is an individual, partne;hip, corporation,
• etc. • -
3. Fill in the type of project proposed to be constructed
such as "a 12-unit condominium" or "_2 :_),000 square foot

Re: Sewer Service - La Costa Northeast
Please accept this letter as a replacement for our letter of
August 17, 1979.
The La Costa Land Company (Applicant) its successors, designees
or transferees, the fee owner of the land shown on Exhibit "A"
marked Parcels 1,2,3,4 & 5 has requested the San Marcos County
Water District (District) to provide a sewer service availability
letter for the referenced property.
Subject property is located within the Water.Ditrict and -.-within
the sewer service improvement district.
To be eligible for sewer service, applicant will be required to
meet the following conditions:
1. Construct all on-site and off-site sewer facilities
to connect the proposed project to District's facilities
and dedicate the facilities to the District in accord-
ance with the District's Standard Rules and Regulations.
2. Pay all fees required by the District on demand by the
District.

ilities, together with the applicant's providing security as required
