I. Project Description The applicant is requesting a tentative tract map and condominium permit to convert 8 existing apartment units into condominiums at the above described location. Also, the applicant requests two variances of the Zone Code: 1) to reduce the number of visitor parking spaces from four to two; and 2) to allow the location of two parking spaces in the required front yard setback. Approval of the condominium conversion is contingent upon approval of the variance since the applicant would not be able to meet the parking requirements of the condominium ordinance, II. Analysis Planning Issues; V-302 1. Can the four mandatory findings for approval of a variance be made? a. Are there exceptional or extraordinary cir- cumstances applicable to the property that do not apply to other property in the vicinity? b. Do other properties in the vicinity share a similar property right which is denied to this property? c. Will this variance adversely affect the comprehensive General Plan? o o d. Will this variance be detrimental to the public welfare or injurious to property in the vicinity? Discussion V-302 Section 21.24.040(2) of the RD-M zone permits a 10' front setback if carports or garages do not face onto the street and if the remaining front yard is land- scaped with flowers, shrubs and trees. The applicant is proposing spaces within this 10' area to meet the parking requirements of the Condominium Ordinance. The proposed parking stalls would be Ih feet from the front property line and 11^2 feet from La Costa Avenue. It should be noted, that even if the two parking stalls are provided, the applicant is still two spaces short of the required parking spaces, thus, approval of this variance would allow for a reduction of the required spaces. Staff cannot find sufficient facts to make the required four findings for either variance. Specifically, there are no extreme or extraordinary circumstances which exist relating to this property that do not apply to other properties in the same vicinity and zone. Because the project was built as an apartment, even though the applicant may have intended to convert to condominiums, staff feels this is not sufficient justi- fication for finding extreme or extraordinary circum- stances . Secondly, no other properties in the same vicinity and zone have either reduced parking or parking within the front yard setback, thus, no properties share a similar property right that is being denied to the applicant. The applicant has indicated that he is being denied a property right because on-street parking is permitted on some portions of La Costa Avenue in front of RDM zoned lots. Although this is true, it is almost certain that parking will have to be prohibited along the entire length of La Costa Avenue in the future because of high traffic volumes and the narrow width of the street. Although approval of the variance will not adversely affect the General Plan, such approval may be detrimental and injurious to the public health and welfare. Location of the parking stalls close to La Costa Avenue will potentially create traffic hazards on this street. Specifically, cars backing out of these two spaces would block entrance into the complex from La Costa Avenue, requiring cars to make a sudden stop on a secondary art- erial inducing rear end collisions. Because of the potential traffic hazard and the lack of sufficient facts to make all the four mandatory findings, staff is recommending that the variance be denied. Planning Issues - CT 80-8/CP-58 1. Does this project meet the development standards of the Condominium Ordinance? 2. Does this project meet the design criteria of the Condominium Ordinance? CT 80-8/CP-58 With respect to development standards, all have been met with the exception of parking. Open-recreation requirements are met by private patios and open decking as shown on Exhibit 'A'. Storage is provided within the units, the carports and underneath the proposed deck. Laundry facilities are in a separate 64 square foot building located between Units 3 and 4. As mentioned, the number of parking spaces is deficient by four spaces. If the encroachment variance is approved, parking would be deficient by two spaces. Since La Costa Avenue at this site is a "no parking" area, visitor parking cannot be provided on-street. Staff feels that visitor parking is important for a condominium develop- ment and that lack of such parking would be detrimental to the project and constitutes grounds for denial. Unless a variance can be approved to reduce the required number of parking spaces and allow parking in the front setback, CT 80-8 and CP-58 cannot be approved. Staff also, however, had a number of secondary concerns with the design of the project. These concerns include dominance of the driveway and the location of the carports and visitor parking spaces. The driveway enters from La Costa Avenue and, combined with the parking area, totals a little over 5336 square feet and takes up 31.4% of the .39 acre site. Staff feels it is a very dominant feature and does not meet the design criteria of the Condominium Ordinance. Secondly, the applicant has built carports directly in front of the entrys to units 1 and 2. AS' corridor has been created between the units and the carports creating an enclosed, and in staff's view, indefensible space. The use of carports at this location has further dimensioned the visual appearance of the project. Coupled with the location of the visitor parking spaces within 10' of La Costa Avenue as previously mentioned, the overall design of the parking area does not meet the intent and purpose of the design criteria of the Condominium Ordinance. Overall, staff feels neither the variances nor the condominium conversion can be supported for the reasons stated herein. Ill. Recommendation A. It is recommended that the Planning Commission adopt Resolution No. 1636, DENYING V-302, based on the findings contained therein; and B. It is recommended that the Planning Commission adopt Resolution No. 1635, DENYING CT 80-8/CP-58, based on the findings contained therein. II. DISCUSSION This item was originally heard at the Planning Com- mission meeting of May 14, 1980. At that time, the Commission continued the item indefinitely to allow the applicant time to redesign his project to meet the condominium ordinance requirements. Subsequent to that meeting, the condominium conversion moratorium became effective and the application could not be further processed. The application had been accepted and was considered complete on March 5, 1980. Pursuant to state law, the City Council must render a decision on the application within one year of this date. Since no further review of this project has taken place due to the condominium conversion moratorium, staff cannot prepare a recom- mendation for the Commission and Council to effect a decision prior to the year deadline date. Staff is therefore recommending that this item be denied with- out prejudice. If the Commission and Council take this action, the applicant will have to submit a new appli- cation. Since the applicant was not at fault for the delay of processing, the Commisson may wish to recommend to the City Council that the fees for a new application be waived on this property. RECOMMENDATION It is recommended that the Planning Commission adopt Resolution Nos. 1635 and 1636 DENYING WITHOUT PREJUDICE CT 80-8/CP-58 and V-302 based on the findings contained therein. CT 80-8/CP-58 Staff has a number of concerns with respect to the design of the project including dominance of the driveway, location of the carports and visitor parking spaces and location of the trash enclosure. The driveway enters from La Costa Avenue into a large parking area which takes up 33% of the site. Staff feels it is the most dominant feature of the project, and therefore, does not meet the design criteria of the Condominium Ordinance. Secondly, the applicant has built carports, enclosed by an 8' block wall, directly in front of the entrys to units 1, 2 & 3. A 5' corridor has been created between the units and the carport creating an enclosed, un- defensible space. The use of carports at this location has further dimensioned the visual appearance of the project. Coupled with the location of the visitor parking spaces within 10' of La Costa Avenue as previously mentioned, the overall design of the parking area does not meet the intent and purpose of the design criteria of the Condominium Ordinance. Finally, the trash enclosure as proposed would be located within the front yard setback facing La Costa Avenue forcing trash trucks to stop on La Costa Avenue to pick up trash. This would require that the bins be rolled over the sidewalk and curb creating damage and subsequent maintenance problems. Given the proposed design, there is no feasible alternative for an enclosure location on the site. With respect to development standards, the project does not meet either the open-recreational space require- ments nor the parking requirements. The applicant has provided private patios behind units 1 through 4, meeting open recreational space requirements for these units. Units 5 through 8, however, have only 5'xlO' balconies which do not qualify as open-recreational space since the minimum 6' dimension for a balcony is not provided. In terms of parking, the project would have 18 spaces if the variance is approved, however, it would still be short of the 20 spaces required by code. Overall, staff is displeased with the overall project design and standards and feels conversion of these units to condominiums is not appropriate. -3- III. Recojnmendation A. It is recommended that the Planning Coiranission adopt Resolution No. 1636, DENYING V-304, based on the findings contained therein; and B. It is recommended that the Planning Commission adopt Resolution No. 1635, DENYING CT 80-8/CP-58, based on the findings contained therein. The brief meeting with Mr. Hofman was very informative and Mr. Hofman was very helpful. My Dee meting is on 3-3-81 and the concerns I have are the following. I. The requested variance is the result of my project being denied the similar property right given to other properties in the RDM zone on the same street that is the same width. Specifically, on street parking is provided for other RDM properties on La Costa Avenue, This is not mentioned in the staff report. II. In reference to the last paragraph on page two of the preliminary staff report. "Specifically, cars backing out of these two spaces would block entrance into the complex from La Costa Ave. requiring cars to make a sudden stop on a major arterial inducing rear end collisions," 1. La Costa is a secondary arterial not a major arterial as stated in the report. We have discussed this in your office with our first meeting, 2. I believe the staff has overlooked the two way turn island in the center of La Costa Ave. and in front of the project which I believe solvees the problem of the sudden stops and rear end collisions. page 2 III. The design of the project has staffs concern on three counts. 1. Parking lot 2. Carports 3. Trash enclosure 1. Parking lot- The coverage in the preliminary staff report is stated at ^1?S which is in error. The actual coverage is 31^, This has been worked out by both Mf. Hofman and myself and he cordially said that it will be carrected by the final draft. My concern over this is that if an error of 25^ (31^ • has been made in stating the dominance of the parking when in actuality it is i less. This should relieve the staff concern of dominance of the parking lot. 2. Qarports. The last paragraph on page three of the preliminary staff report is in error. Ho carport exist in front of unit #3. In reviewing the tentative raap an error was made in the drawing by my engineer. It is clarified in my colored rendring or on the site plan located in my proposal given to Mr, Hofman, I apologize for my mistake in misleading the staff. However, this brings me to the conclusion that this would have to reduce the staffs concern by 33?^. Also no mention was made of the 15 automatic house meter lights 7 of which are located around the so called corridor area. This does not include the potential owners own front entry lights at each entry. IV, Trash enclosure, Mr. Hofman and myself discussed the one time approved trash enclosure in front of the building and both of us need an answer for the following question "Is the height of an apertenate structure in this case the trash enclosure, measured from natural finished grade?" page 3 Staff response with respect to development standards. All have been met except for parking. This parking was counted on but was taken away by a resolution while I was in one of the four moritoriums that 1 have been in the past four years. Reviev^> Striping Plans for La Costa Avenue from El Camino Real to Rancho Santa Fe Road Since the Commission wants to maintain a low accident rate on La Costa Avenue, but v;as very concerned about eliminating all the parking in front of residences facing La Costa Avenue, staff has designed a striping layout that will secure on-street parking in front of most of the homes along La Costa Avenue. The Commission recommended that the striping and no parking outlined in Plan "B" be implemented on La Costa Avenue, which would formally establish the NO PARKING zones. Features of this plan include: a) Retaining the existing no parking on both sides of La Costa Avenue from just v/est of Nuava Castilla V.'ay to east of Romeria; except, re- move some of the parking restriction along the north side, between Viejo Castilla and Calle Madero. b) Retaining parking along the north side from the SDG&E easement (near El Camino Real) to just west of Nueva Castilla Way. c) Retaining parking along the south side of La Costa Avenue from just east of Romeria Street to Levante Street. d) Enough street width to implement bike lanes as directed in the Circu- lation Element of the City's General Plan. e) Maintaining left turn lanes at every intersection. f) Establishing a continuous two-way left turn lane and only one'east- bound lane of traffic between Romeria Street to Levante Street. The total charges must be paid to the District at the time the application is submitted. If a service lateral is required, it will be installed by the Leucadia County Water District. The service lateral is that part of the sewer system that extends from the main collection line in the street (or easement) to the point in the street (at or near the applicant's property line) where the service lateral is connected to the applicant's building sewer. The applicant is responsible for the construction, at the applicant's expense, of the sewer pipeline (building sewer) from the appli- cant's plumbing to the point in the street (or easement) where a connection is made to the service lateral. The connection of the applicant's building sewer to the service lateral shall be made by the applicant at his expense. The connection must be made in conformity with the District's specifications, rules and regulations; and IT MUST BE INSPECTED AND APPROVED BY THE DISTRICT BEFORE THE SEWER SYSTEM MAY BE USED BY THE APPLICANT, THE APPLICANT, OR HIS AUTHORIZED REPRESENTATIVE, MUST NOTIFY THE DISTRICT AT THE TIME INSPECTION IS DESIRED. ANY CONNECTION MADE TO THE SERVICE LATERAL OR COLLEC- TION LINE WITHOUT PRIOR APPROVAL AND INSPECTION BY THE DISTRICT WILL BE CONSIDERED INVALID AND WILL NOT BE ACKNOWLEDGED. The prorated sewer service fee is based upon the date the District estimates that service will begin and covers the balance of the fiscal year. There will be no additional fee or refund if service actually consrnences on a different date. For succeeding fiscal years, the sewer service fee will be collected on tha tax roll in the same manner as property taxes.
