SUBJECT: CT 81-13/PUD-25, SCHWAB - Request for a 3-unit/lot
Tentative Tract Map and Planned Unit Development
located immediately east of Skyline Drive and north of
Tamarack Avenue (extended). The property is located in
3 different zones. The eastern majority of the
property is in the P-C zone, the middle, the R-A-10,000
zone, and a small western section is located in the
R-1-15,000 zone.
I. PROJECT DESCRIPTION AND BACKGROUND
The applicant requests a 3-unit Tentative Tract Map and Planned
Unit Development on 1.72 acres of land as described above. The
applicant's intent is to subdivide the property and sell each
lot in an undeveloped state, allowing new owners to build custom
homes on them. Since the P-C zone does not have specific
development standards, the Planned Unit Development process is
used as a tool to provide standards for parcels zoned P-C which
are less than 100 acres in size. It should be noted that
certain development standards of the Planned Unit Development
Ordinance (i.e., common recreation areas, etc.) need not apply
to non-conforming (under 100 acre) parcels within the P-C zone.
The proposed project is a normal, single-family subdivision, not
a true Planned Unit Development, that meets the requirements of
the R-1 zone. Staff, through previous Planning Commission
action (CT 80-1/PUD-14), finds this acceptable.
II. ANALYSIS
Planning Issues
1) Is the proposed subdivision comprehensively designed
and compatible with surrounding developments?
2) Does the proposed subdivision meet all development
standards of the Zoning Ordinance and Subdivision
Ordinance?
III. DISCUSSION
The proposed 3-unit/lot subdivision has been designed to take
access off of future High Ridge Avenue, a street developed in
connection with approved CT 76-15. Lots along this street will
be single-family in nature and compatible with the three lots
requested in this subdivision. No access will be allowed from
Tamarack Avenue. Staff had some concern with regard to the
amount of grading required to create building pads. A total of
approximately 16,300 cubic yards of fill will take place on the
site. To mitigate this concern, staff recommends the inclusion
of a condition requiring the immediate planting of all slopes
after grading. Since the grading will be consistent with that
proposed for CT 76-15 and other projects in the vicinity, staff
feels it is acceptable and that it will not create substantial
adverse impacts to the site.
The proposed subdivision meets the development standards and
requirements as each lot has a substantial open area for private
recreation and vehicle storage. This subdivision conforms to all
the requirements of R-1 zoning and the Subdivision Ordinance.
IV. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project will not
have a significant impact upon the environment and, therefore,
has issued a Negative Declaration, dated May 1, 1981.
V. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the
Negative Declaration issued by the Planning Director and ADOPT
Planning Commission Resolution Nos: 1873 and 1874, recommending
APPROVAL of CT 81-13/PUD-25, to the City Council based on the
findings and subject to the conditions contained therein.

above described project pursuant to the Guidelines for Implementation
of the California Bavironmental Quality Act and the Environmental
Protection Ordinance of the City of Carlsbad. As a result of said
review, a Negative Declaration (declaration that the project will not
have a significant impact on the environment) is hereby issued for the
subject project. Justification for this action is on file in the
Planning Department.

Re: Illegal processing/approving of Planned Unit Developments (PUD) without
common areas designed for recreational use.
Dear Mr. Vincent F. Biondo, Jr.,
Since CT81-13/PUD 25 is in the Planned Community (PC) zone and any subdivision
of it, whether it will be a part of a master planned community or just in-
dependent lots, must be processed under the PUD ordinance. Therefore, this
project or any other project in a PC zone must meet all the legal/technical
requirements of the current PUD ordinance regardless of how inadequate and
ridiculous this ordinance may be.
Regardless of the city's desires, position papers and past practices, etc.,
there does not appear to be any valid legal basis for arbitrarily deleting
any or all of the PUD requirements. You either comply with the PUD ordinance
or you don't process. I don't believe the city has authority to process or
pass a PC zoned project on the basis that as long as the project meets all
minor subdivision standards it should pass. That may be very logical but I
doubt that it would withstand a court challenge in that the only means of
processing is in accordance with the PUD ordinance. While the niimber of
proposed lots in an R-l zoned project are important in deciding minor verses
major subdivision, that is not the case in PC zoned projects as the current
PUD ordinance does not differentiate between minor and major.
There currently appears to be discriminatory, arbitrary and inconsistent
application of a poorly written ordinance. Discussion with City Planning
Personnel have not lessened my convictions that the city is on shaky legal
grounds. All I ask is legal compliance with the current ordinances and
that they be uniformly applied.

installed by the applicant on the crib-wall subject to the
approval of the Parks and Recreation Department. The landscaping
and irrigation system shall be maintained by the city of
Carlsbad. Detailed plans for the design of the wall and
landscaping shall be approved prior to issuance of building
permits for any of the lots in this project."
We anticipate city council approval of the tentative tract map at
their December 1, 1981 meeting. Please send me a copy of the new
