After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the application qualifies for substantial conformance with the approved permit and therefore, approves the exterior material change to the project based on Planning Director Administrative Policy No. 35. The requested use of stucco versus vertical wood siding does not affect the safety or functioning of the project nor does it change residential density, alter the approved footprint or height of the buildings. Visually, either wood or stucco could be found to be compatible with the surrounding development since both materials are used on adjacent structures and in fact the materials can be used together on a single structure successfully. The proposed use of earth tones is consistent with the direction to blend the development into the site. Please submit two (2) blueline copies (24" X 36") of all applicable exhibits for the project file. The blueline copies must be submitted, stamped "Substantial Conformance", and signed by the Planning Director prior to issuance of any building permits for the project. AUG n 9 1999 CITY OF CARLSBAD FRM0025 11/98 Hofman Planning Associates Planning Project Management Fiscal Analysis August 9, 1999 Christer Westman City of Carlsbad 2075 Las Palmas Drive Carlsbad, CA 92008 SUBJECT: SUBSTANTIAL CONFORMANCE SUBMITTAL FOR THE WINDSONG SHORES PROJECT Dear Christer: The purpose of this letter is to make a formal request for a Substantial Conformance Determination to be made for the Windsong Shores Project. The proposed project revision consists of an exterior material change from a wood to stucco finish and some minor floor plan variations. The use of stucco with our proposed color scheme will produce a longer lasting, more durable and more compatible product than that which was previously approved. In reviewing the old approved color scheme, it is easy to discern that these colors are outdated and should be revised. Furthermore, if the wood material is utilized, it would have to be treated with a weathering stain. This treatment is similar to painting the wood and effects its color and finish. This treatment must be done to prevent damage from the climate and produces an overall result which is less desirable. As illustrated on the submitted exhibits, the newly proposed stucco color scheme is far more attractive than the previously approved colors of teal trim on an off white shade of wood. The new stucco color scheme is also compatible with the surrounding buildings and land uses as demonstrated in the photograph exhibit. The proposed project revision is in compliance with all the findings outlined in the Substantial Conformance criteria which include: 5900 Pasteur Court ° Suite 150 ° Carlsbad • CA 92008 • (760)438-1465 • Fax: (760)438-2443 1) No project condition, feature, facility or amenity has been changed or deleted that had been essential to the project's design, quality, safety or function; 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood; 3) The proposed revision does not change the density or boundary of the subject property; 4) The proposed revision does not involve the addition of a new land use not shown on the original permit; 5) The proposed revision does not rearrange the major land uses within the development; 6) The proposed revision does not create changes greater than 10%; 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation; 8) The proposed change would not result in any health, safety, or welfare impacts; 9) The proposed change will not exacerbate any major issues or controversies associated with the original project; 10) The proposed change would not be readily discernible to he Project Planner or Planning Director as being substantially different from the project as originally approved.
